Ross for the top of each tower was on hold until the Florida Department of Transportation transmitted the As -Built plans for each tower to the City. However, since the FDOT experienced delays in obtaining the plans due to legal issues with their contractor, the City has authorized a change order for a not to exceed amount of $5,032 for the artist to obtain her own precise measurements for each tower. This project has been delayed approximately six months awaiting the plans. The change order was approved on October 6, 2005 by City Council. Ms. Ross has schedule her surveyors to take measurements on October 17th. After that, they can continue with the design process. Installation is estimated to occur in approximately one year. The City Council also approved a change order for $2,600 to authorize the additional "antiquing" application for each of four bas relief sculptures of the City Shield. A mock up rendition of the shield should be ready for the City's approval in approximately four weeks with installation occuring in December 2005. The lobby lighting and Costas Varotsos lighting authorizations were approved at the October 6th Council Meeting as well. Staff is awaiting purchase order approvals, then the products can be ordered. Ferris Date Prepared: October 4, 2005 Meeting Date: October 18, 2005 Petition AIPP- 05 -07- 000003 Page 2 of 3 BACKGROUND On November 6, 2003, the City Council adopted Resolution 181, 2003, which approved a 68,000 square -foot office building, including a 4,000 square -foot bank with three drive- through lanes, on Parcel 27.03 of the Regional Center Development of Regional Impact (DRI). The subject site has a future land -use designation of Professional Office (PO) and a zoning designation of Planned Community District (PCD) Overlay, as well as a Professional Office land -use designation on Map H of the Regional Center Development of Regional Impact (DRI). In accordance with Section 78 -262 of the Land Development Regulations, entitled Art in Public Places, Fee Imposed on Development, all budgets for new construction of private and public developments shall include one percent (1%) of the total budget for vertical construction as a fee for art in public places. The subject fee shall be used by the developer for the provision of artwork on the project site, or the developer may choose to contribute one percent (1 %) of the total vertical construction costs directly to the City for the provision of art on public property. Under the provisions of Section 78- 261(a)(1) of the City's Land Development Regulations entitled Deposit of Funds, prior to the issuance of a building permit on site, the petitioner is required to place $55,000 into an escrow account, which represents one percent (1 %) of the estimated total cost of vertical construction on site (please see the attached project budget breakdown). PROPOSED ART IN PUBLIC PLACES Location The current location, as depicted on the site plan, was shown on the site plan that was approved by the City Council through the adoption of Resolution 181, 2003. Although the applicant included the location during the development approval process, the location has not been reviewed by the then Art Advisory Committee; therefore, the Art in Public Places Advisory Board may review the art location and make recommendation. Art The bronze sculpture, entitled "Two Marlins," is approximately 70 "H x 46 "L x 40 "W and weighs 595 lbs (please see attached image and location maps). It will be mounted on a granite base that will be approximately 4 "H x 3"W. At night, the sculpture will be illuminated via down lighting from spotlights mounted on three specimen live oaks, as well as by bollard light fixtures surrounding the art. Artist Piero Bertelli is a Florentine sculptor who was hired by the prestigious "Marinelli" foundry in Florence at the early age of fifteen. He later managed the "Marinelli" foundry until 1998 when he retired, but continued to work on free -lance basis in cooperation with the foundry. Piero Bertelli's work is permanently displayed at the Peter Bazzanti & Son Art Gallery in Florence (please see attached artist resume and foundry information). Date Prepared: October 4, 2005 Meeting Date: October 18, 2005 Petition AIPP- 05 -07- 000003 Page 3 of 3 STAFF CONCERNS Staff has the following issues with respect to the proposed Art in Public Places: 1. It is staff's professional opinion that the proposed work of art is in conflict with City Council's direction that was given during the City Council meeting on March 17, 2005. At that meeting, a bronze piece of art of a Florida panther entitled Lion Around, for the Northcorp, Lot 4 project was discussed. During the discussion, Council gave direction that there is a sufficient number of animal art pieces in existence throughout the City, and therefore, future art should not include representations of animals (the applicant has been made aware of Council's direction). 2. The proposed art work, as shown on the site plan, will be in proximity of the south -west corner of the office building and will be located near the 55' landscape buffer that runs along PGA Boulevard. The intent of the Art in Public Places program is that art work that is placed on site is visible to the greatest number of passers -by. As a result, the eight crepe myrtle trees surrounding the walkway that leads up to the artwork should be relocated or the plant species should be modified in order to maintain visibility from PGA Boulevard. STAFF ANALYSIS The petitioner has satisfied the requirements established in the City's LDRs relating to the provision of Art in Public Places. STAFF RECOMMENDATION Based on City Council policy, staff recommends DENIAL of the proposed "Two Marlins" animal art sculpture. Should the Art in Public Places Advisory Board recommend approval of the proposed art to the City Council, staff recommends the following conditions of approval: 1. The applicant shall be responsible for maintenance of the work of art. (Planning & Zoning) 2. The applicant shall submit photographs of the installed artwork within 60 days of completion. Colours meld to form new colours and the feelings which they inspire. In the same breath, they split apart with an unequal divide to produce seemingly alike, but different colours and emotions. The Donald Ross Village Planned Unit Development (PUD) is an approximately 45 -acre site generally bounded by Donald Ross Road to the north, Central Boulevard to the west, and Military Trail to the east. On April 10, 2003, the City Council adopted Ordinance 53, 2002, thereby approving the master site plan for a planned unit development (PUD), including 256 multi - family residential units, a 93 -room hotel, 9,000 square feet of professional (business) office, 3,236 square feet of gas /convenience store, 4,000 square feet of bank, 88,987 square feet of general retail, 13,000 square feet of restaurant use, 2,400 square feet of outdoor seating area for retail, and 14,873 square feet of drug store use. Subsequently, on November 18, 2004, the City Council adopted Resolution 210, 2004, thereby approving an amendment to the Donald Ross Village Mixed -Use Planned Unit Development (PUD) for phase II of the subject site with a 93- room hotel, a 13,500 square foot retail building, an 18,387 square -foot medical office building, and a 20,000 square -foot fitness center. The site includes six vehicular entrances and a major plaza in the center of the project, which is located between two buildings and at the vista end of the main entrance to the site. At the age of fifteen he was hired by the prestigious "Marinelli" foundry in Florence as waxes retoucher and model creator. He studied drawing with the most popular painters in the area and from 1959 to 1961 went to the Nude School at the Fine Arts Academy in Florence. Before the mould art Piero Bertelli learned the casting "lost wax" method, the retouching refinements and the patina secrets. At the foundry's studio, in Via Corridoni, sculptors like Berti, Moschi, Innocenti, Tofanari and many others used to ask Piero Bertelli to retouch their waxes and to follow the casting of their works. Through this long work, side by side with the sculptors, this "Montelupino" fifteen years old boy, while working his still "tender" wax, expressed his love for the plastic harmony of the shape and a lot of attention for the realistic forms. This love pushed the young kid to study with the sculptor Terreni, who helped him after the hard hours spent in the foundry, to face the three years of the Free Nude School at the Florentine Academy, where Professor Settala was still teaching. Bertelli managed the "Marinelli" Foundry until 1998, when he retired: today he carries on sculpting and co- operates with the foundry on a free -lance basis. In 1970 he received the National Sport and Art prize at the Congress Palace in Florence and the "Lyceum" Prize for the Art Sculpture in Milan in May 1984. His most important figurative works are: the life -size of the sitting woman "Patrizia" or the woman making up titled "Woman at the mirror ", and the "two marlins ". He exhibits permanently in the prestigious Peter Bazzanti & Son Art Gallery in Florence. Fonderia Artistica Ferdinando Marinelli Information about the F oundary- The Fonderia Artistica Ferdinando Marinelli is the only remaining artistic foundry in Florence. Founded in 1910, it gained immediate fame for the quality and craftsmanship of its bronze casts, using the lost wax system and the same hand - finishing technique as the Florentine Renaissance sculptors. The Foundry's cast work includes, the Holy Door of Saint Peter's Cathedral at the Vatican, the Monumental Stairs of the Vatican Museums, monuments for the US Department of Defence, the monumental horses at the Arlington Memorial Bridge in Washington, D.C., the "The Pioneer's Cart" monument in Montevideo (Uruguay), the Monumental Fountain for the Broncos Stadium in Denver Colorado, the Kremlin restoration in Moscow and many others. When Pope Pius XII celebrated the mid - century Jubilee (1950) he substituted the old wooden door with a new bronze one. He commissioned it to the sculptor Vico Consorti from Siena and wanted the casting and chiseling of the "Holy Door" assigned to the "Marinelli" foundry of Florence, credited supplier of the Vatican and of the Vatican Museums. {I � M 4 a. The Kremlin, Moscow, Russia The most important Italian artisans received commissions for the reconstruction of S. Andrew and S. Alexander Halls at the Kremlin, Moscow, both destroyed by Stalin during the Russian Revolution. The "Marinelli" foundry was entrusted with the commission for the works in bronze.
