Stephen Mayer opened the meeting at 2:41 p.m. The Committee discussed The Growth
Management Department's comments on this Petition. The discussion included the
measures that were going to be taken to secure the parking lot. Staff was under the
impression that the entrance was going to be gated. Ron Jacoby stated he feels there
should be security guards as opposed to putting up an electronic gate. This parking lot is
going to be used for valet and employee parking only and this will be a way to stop other
people from parking here and also serve as security for employees going to their cars late
at night. There was also discussion about lighting the parking lot and Stephen stated that
the applicant needs to submit a Photometric Plan.
The Committee went on to talk about securing the remainder of the site with fencing and
there was discussion about whether they will use fencing or landscaping. Officer Julius
Barone spoke about which areas should be fenced and landscaped.
Stephen Mayer spoke about the need for an additional parking garage and staff would
like a commitment to build the garage as a condition to approving this Petition for
temporary parking. Ron Jacoby and Don Hearing agreed that they would like to do a
study on the parking before committing to the parking garage. They admit that there is a
parking problem but feel they need the time to conduct research and a study of how much
parking is needed. Ron Jacoby stated that he would like to see if moving 400 cars from
employee and valet parking will help the parking situation and then see how much
additional parking will be needed. There was also discussion about possible locations for
an additional garage.
The Committee discussed the sidewalks that will be needed for the temporary parking lot
and about the possibility of having a shuttle service for employees to get to and from their
cars.
Judy Dye pointed out on the plans the areas she is concerned about which includes some
of the roads, turning lanes, and the possibility of cars stacking into the roadway.
Mark Hendrickson discussed the landscaping plan. Brian Cheguis and Mark went over
the landscape plans and pointed out on the plans the areas that would be landscaped.
The meeting ended at 3:34 p.m.

A Development Review Committee meeting will be held on July 13, 20o6 at 2:30 p.m.,
in the City Council Chambers to review the following development application:
Petition MISC o6- o6 -o16: Downtown at the Gardens, Temporary Parking
A request by Don Hearing of Cotleur and Hearing, Inc., on behalf of Menin Acquisition,
LLC, for a miscellaneous petition to allow the construction of a temporary parking lot
consisting of 421 parking spaces for employees and valet parking service. The 6.6 acre
vacant property is generally located the corner of PGA Boulevard and Alternate AlA, south
of Kyoto Gardens Drive and west of the Gardens Medical Mall.
The applicant will be in attendance at this meeting. Our office requests your participation in
the review of this project. Please review this request and attend the meeting if possible,
bringing written comments. If you cannot attend, please forward any comments or
outstanding issues relative to the subject petition to our office. Should you have no
comments, please indicate so next to your name below and forward this memo to our office.

I have reviewed the above - referenced petition and have the following comments:
1. Staff recommends the applicant explain how the gated entrance will operate in order to restrict the use
for employees and maintenance crews.
2. The applicant shall provide a revised photometric plan which provides additional security lighting per
the comments from Jules Barone. Staff recommends the applicant meet with the Police Department
prior to resubmitting the photometric plan.
3. The applicant shall secure the site with perimeter fencing, but must maintain natural surveillance of the
lot from all sides.
4. The applicant shall explain the reason that the existing sign on the corner of PGA and Lake Victory
Gardens Avenue is identified to be relocated, or remove this reference from the plan.
5. By virtue of this application for temporary parking, the applicant acknowledges there is insufficient
parking for the Downtown at the Gardens site. Therefore, pursuant to condition 34 of Resolution
120,2005, the applicant must build the required parking garage within one year after the date of the
administrative approval.
6. Staff is concerned that the temporary parking lot will be required for overflow use when the parking
garage is under construction. The applicant shall provide the number of parking spaces that would be
affected during the construction and explain how the applicant will displace the loss of those parking
spaces.
7. The applicant should explain the reason the temporary parking is required for 2 years.
8. The applicant must provide more direct sidewalk access from the parking lot to the crosswalk on Kyoto
Gardens Drive. Also, staff recommends the applicant provide a similar sidewalk connection on the
corner of Alternate A1A and Kyoto Gardens Drive. By doing so, pedestrians may be directed to use the
controlled intersection instead of the crosswalk, which is a manner preferred by staff.
9. Staff recommends that the applicant submit a landscape plan.
10. The applicant shall provide an explanation on how emergency access will be addressed. The manner in
which the entries are gated may suffice.
ii. The applicant shall provide a shuttle program for employees, which is at least mandatory at night.
The applicant shall illustrate the shuttle drop off area on the plan and include identification signage
for the shuttle patrons. Staff recommends amenities such as a bench, canopy and /or waste
receptacle.
12. Staff recommends the applicant provide on -site security.
13. Staff recommends the applicant provide written consent from the owners of the adjacent properties
that are sharing an access with the temporary parking.
14. The applicant shall respond, in writing, to the comments listed above, and submit five (5) copies of
all plans including (i set signed and sealed) and all associated documents upon resubmittal.

1. The applicant shall submit a photometric plan that is signed and sealed by an
engineer who is registered in the state of Florida, which meets the requirements
of Section 78 -182 of the LDR. The plan received for this review was not signed
and sealed.
2. The applicant shall clarify the drainage of the parking lot, per Section 78 -525 of
the LDR, as the site plan indicates that the east boundary of the parking lot will
have a sidewalk along it. However, the applicant does not indicate if the walk is
flush with the pavement, or clarify that type "D" curb is not to be installed
along this boundary.

4. The applicant shall indicate that RCP pipe be utilized under the drives.
5. The applicant shall provide a conceptual detail of the pavement section in
accordance with Section 78 -46 of the LDR.
6. The applicant shall provide a conceptual detail section of the paver crosswalks
in accordance with Section 78 -46 of the LDR.
7. The applicant shall indicate the structural numbers for the "Asphalt Section"
and the "Paver Crosswalk" section in accordance with Section 78 -499 Table 41
of the LDR. The applicant shall provide a table indicating the layer, material,
LBR/FBV (specifying whether LBR or FBV is indicated), material thickness,
FDOT layer coefficient; the SN for the pavement section, base section, and
subgrade section; and the total SN for the total pavement section and the
required SN in accordance with the FDOT Flexible Design Manual.
8. The applicant shall identify the intended area of parking for the employees and
maintenance personnel following the 24 month temporary use of the lot.
9. The applicant shall provide a demolition plan showing the proposed site
following expiration of the 24 month temporary use. The demolition shall
include the removal of all pavement, walk and curb, as well as the regrading
and landscaping and the closing of the entry drives of the parcel per Section 78-
46 of the LDR.
10. The applicant shall clarify the bicycle spaces provided. The applicant indicates
the total required bicycle parking is equal to 18 spaces, whereas based on the
421 parking spaces shown they are required to provide 22 parking spaces per
Section 78 -414 of the LDR.
421 x 5% = 21.05 or 22 bicycle spaces required.
11. The applicant shall revise the parking stall dimensions for conformance with
Section 78 -344 of the LDR which requires minimum 10 -foot x 18.5 -foot
parking stalls, or the applicant shall modify the petition in order to request a
waiver from the City Council to allow the 9.5 -foot x 18.5 -foot stalls as shown.
Please note we remain in support of the City's LDR requirements.

12. We recommend that the applicant provide a minimum 100 -foot stacking
distance for the entrances of the parking lot in conformance with Section 78-
344 of the LDR.
13. The applicant shall dimension the stacking distance, conforming to Section 78-
344 of the LDR, which is provided for each ingress lane of the drives, on the
site plan.
14. The applicant shall provide a landscape island between parking stalls or modify
the petition in order to request a waiver from the City Council. No more than
nine parking stalls shall be provided between landscape islands in accordance
with Section 78 -228 of the LDR. Please note we remain in support of the City's
LDR requirements.
15. The applicant shall identify the trees to be removed or relocated to
accommodate the proposed design in accordance with Section 78 -46.
16. The applicant shall indicate the accessible route of emergency vehicles through
the parking lot in accordance with Section 78 -46.
17. The applicant shall provide handicap parking within the parking lot, or identify
the number and location of the additional handicap parking on the existing site
to meet the required ADA parking. Given the 421 proposed parking stalls, 8
handicap parking stalls are required.
18. The applicant shall identify the existing and proposed curb ramps on the site
plan as either "CR" or "HR" in accordance with Section 78 -46 of the LDR.
Non - Certification Issues
1. The applicant shall provide a cost estimate for the project, including public
infrastructure and all landscaping and irrigation costs for review and approval
by the City in order to establish surety. The cost estimate shall be signed and
sealed by an engineer and landscape architect registered in the state of Florida.
Surety will be based on 110% of the total combined approved cost estimates
and shall be posted with the City, prior to the issuance of the first land
alteration permit.

6. "Prior to issuance of the first land alteration permit, applicant shall submit
signed /sealed /dated construction plans (paving /grading /drainage and
water /sewer) and all pertinent calculations for review and comment. (City
Engineer)
7. "Prior to construction plan approval and the issuance of the first land
alteration permit, applicant shall schedule a pre permit meeting with City
staff. " (City Engineer)
8. "Prior to the issuance of the first land alteration permit the applicant shall
provide to the City letters of authorization from the applicable utility companies
allowing landscaping and light poles to be placed within the utility easements. "

9. "Applicant shall notify the City's Public Works Division at least 10 working
days prior to the commencement of any work/construction activity within any
public right -of -way within the City of Palm Beach Gardens. In the case of a city
right -of -way, the applicant has at least five working days to obtain a right -of-
way permit. Right -of -way permits may be obtained at the Building Division.
Failure to comply with this condition could result in a Stop Work Order of all
work/construction activity within the public right -of -way and the subject

The applicant is requested to return a copy of our comments with the
applicant's acknowledgement of each comment and the response. Compliance
will expedite the subsequent review.
The applicant is reminded that all submittals are to be made to the City of
Palm Beach Gardens Growth Management Department.

Subject: Downtown at the Gardens, Temporary Parking
Comments:
The need for additional parking has been well documented and discussed
as a result of the success experienced by the businesses on the south end of the
complex. The proposed location is hidden and isolated from the main complex and
has poor lighting along Kyoto Gardens Drive. The proposed landscaping and
existing nursing facility to the East will further reduce natural surveillance from
across the road. The site plan indicates (12) light fixtures, (5) fixtures along the East
boundary, (1) at the south end of second row, (5) for the next row and only (1) light
fixture along the back row which borders Alt. AIA. The proposed landscape buffer
along the Alt. may further reduce natural surveillance of the west side of parking
let. Additional lighting is needed in the parking lot and the lot needs to be secured
with fencing, roving security, video surveillance etc, to protect the users of the lot
and prevent vehicles from being burglarized or taken from the lot.
This temporary lot should relieve the over crowding that currently exists.
However, added security measures need to be considered as we could see unwanted
criminal activity at this location.

• Fire Rescue is concerned that the "Temporary" period of two years
is too long. A permanent solution needs to be provided sooner.
