The meeting took place in the Council Chambers of the City of Palm Beach Gardens on Thursday, October 5, 2006 and started at 11:11 a.m. Purpose of the Meeting This Development Review Committee was held at the request of Mr. Kevin McGinley, Land Research Management, Inc. on behalf Of S &S Rentals, Inc. to rezone a 0.8 acre parcel at the corner of PGA Boulevard and Prosperity Farms Road from Commercial General 1 (CG 1) to Planned Unit Development (PUD) to allow for the redevelopment of an existing gas station/convenience store. Currently the subject property is operated as a "Speedway" gas station. Todd Miller distributed a package to those in attendance with comments for discussion. Comments and discussion followed on topics listed. Memo from Todd M. Miller, 10/4/2006, Re: Development Plans — Site Plan All site lighting shall be in compliance with Section 78 -182 of the City Code, entitled "Illumination of uses and buildings ", as amended by Ordinance 26 -06. Messrs. McGinley, Wensing and Vani assured staff that the lighting would be per their requirements. Memo from James Brown, 10/3/2006, Re: General Comments James Brown re- stated his comments from subject memo that separate permit(s) and application(s) would be required for paving, drainage, water and sewer improvements, common area landscaping, common area irrigation, common area site lighting, signage, fire sprinklers and fire alarms (if any). Applicants agreed that permits, applications and inspections would be done as required. Comments from Scott Fetterman, Deputy Chief Fire Rescue Scott Fetterman discussed his concern that the site plan did not indicate an emergency generator location and asked how the applicants proposed to meet the requirements of new State Legislation requiring that emergency generators be available to gasoline stations. Mr. Thomas Vani, the owners representative, stated they will have a portable generator fueled by on -site diesel. Mr. Richard Wensing stated the generator would have a transfer switch and that he will have it identified on the site plan and submitted to the City. DRC Review Meeting Date: 100506 Page 1 Sunoco Gas Station Memo from Bruce Gregg, Director of Operations SEACOAST UTILITY AUTHORITY, dated September 27, 2006 Judy Dye and Todd Miller discussed this memo with the applicants regarding Seacoast's concern that the site plan and landscape plans need to clearly depict the proposed water meter, backflow preventer, and water service line. The applicant assured staff that the site plan would address these concerns. Memorandum from City Police Department Special Operations Bureau, Officer Jules Barone — Convenience Store /Gas Station Needs and Miscellaneous Comments Officer Barone discussed these comments with the applicants, expressly commenting that they would need a waiver for the lighting and that the lighting needed to be upgraded in the back, noting the State requirements for safety. Richard Wensing stated they would do as Officer Barone requested and Thomas Vani said they would also have wall packs installed. Mr. Vani said this was going to be a raze and rebuild project and the floor plans had been re -done per Sunoco specifications. Officer Barone asked if security would be provided as required by the City, the applicants assured him security requirements would be fulfilled as required including fencing and screening. Mr. Vani will coordinate pricing the fencing and screening. Judy Dye will coordinate with the Code Enforcement Department regarding signage as mandated by the City. LBFH Inc, memorandum dated September 27, 2006 from Judy Dye This memorandum covered the Engineering Department comments including certification issues, non - certification issues, and conditions of approval. Judy Dye told applicants she needed clarification regarding a Boundary and Topographic Survey. Kevin McGinley stated he would see that the requested survey was provided. Judy Dye revised Item #4 of the memo to read "handicapped sign" rather than "stop sign ". Item #5 referring to cross access was discussed. Kevin McGinley asked if there was an easement. Thomas Vani said he would get with the property owner to find out for sure. Items #6 and #7 regarding a Drainage Statement and Site Electrical /Photometric Plan have already been provided to the City as requested. Todd Miller responded to Item #8 about revising the Waiver Justification Statement to reflect the current City Land Development Regulations (LDR). Mr. Miller will e -mail the code to Messrs. McGinley, Wensing and Vani. They will check to assure they are in agreement with Sunoco, they will adjust if need be to meet the code and will coordinate with Officer Barone. The remainder of items #9, #10 and #11 regarding LDR requirements are all Council granted waivers and not to be settled at this meeting. Judy Dye asked for a draft letter on the date of the Development Order (DO). Mr. Vani will have it drafted and comply. Judy Dye will confirm the language and notify Mr. Vani. Mr. McGinley stating that it will contain the standard County conveyance language. Judy Dye told the applicants that their County contact is Tony Miller. Todd Miller stated he wanted to keep a good schedule and he will e -mail a schedule. Mr. Vani stated they are "under the gun" from Sunoco to have permit by the end of the year. Judy Dye asked if a courtesy review would help. She commented that everything should be run concurrently. James Brown agreed that construction, building plans, site review and development order should be run concurrently to meet the first meeting of Planning Zoning Appeals Board (PZAB) in November, so they could present to Council in December for 1St and 2nd readings in a timely DRC Review Meeting Date: 100506 Page 2 Sunoco Gas Station Scott Fetterman asked applicants what they needed for environment. Mr. Vani stated they were doing it now, and were working on a closure report. Kevin McGinley stated a Plan of what has to be done needs to be done now so Scott Fetterman can stamp and sign off in order to meet what City Engineering needs. Mr. Vani stated he would be in contact with Engineering by October 6 2006, with planning update. Lighting locations shall not conflict with landscaping (to include longterm, tree canopy growth). 2. Lighting on building shall be around perimeter of all sides and on pedestrian walkways surrounding the building. 3. Have adequate lighting within and outside the establishment to make the store less appealing to a potential robber by making detection more likely. 4. The parking lot / gas pump area of the store shall be well lit during nighttime hours of operation. 5. Metal Halide lighting shall be used for parking lot and pedestrian walkways. 6. Landscaping should not obstruct view of windows and walkways so employees and patrons are able to see their surroundings. 7. Install convex mirrors and keep signs and shelves'low; where they don't obstruct employee view. 8. Install a drop safe. Have signage indicating that little cash is kept on hand. 9. Install video surveillance equipment and closed circuit TV (CCTV) to deter robberies by increasing the risk of identification. 10. Install silent alarms to notify police in the event of a problem. 11. Lock doors not in use. 12. Limit access into the store during late night hours by installing bullet- resistant enclosures with pass - through windows. 13. Put height markers on exit doors to help witnesses provide more complete descriptions of assailants. 14. Use door detectors to alert employees when persons enter the store. 15. Control access to the store with door buzzers for nighttime use or closing hours. 16. Bathrooms should be located in a conspicuous location where there will be a high volume of pedestrian traffic. Additionally, bathroom doors should be eliminated and replaced with what has been termed as a "maze" entry/exit. Having this design allows for quick escape in and emergency situation, a roll down shutter can be used to secure the bathrooms during closing hours. 17. Telephone kiosks should be placed in convenient and conspicuous locations, but not in close proximity to businesses. Many times having a telephone kiosk close to businesses provides a legitimate location to conduct illegitimate activity. By having telephone kiosks away from businesses it will help to prevent and / or eliminate potential illegitimate activity. 18. Cashier station area shall be centrally located or rear of the store for good visibility. For enhanced natural surveillance front glazing should be free of signs. Shelf orientation should not prevent clerks from observing customers. 19. If location is to have an eating area it should be located at the front of the store utilizing small seat and table design to attract adult customers. Miscellaneous: 1. Any storage areas with exterior roll up doors should be target hardened (IE: Secured locks, connected to alarm system). 2. Place fuel tanks and fuel pumps in an isolated area of the parking lot away from buildings and flow of parking lot traffic. 3. The applicant shall provide a Boundary and Topographic Survey identifying existing contours at one -foot intervals extending .100 feet beyond the parcel boundaries in accordance with LDR Section 78 -46. . 2. In accordance with LDR Section 78- 371, the applicant shall add the following note to the site plan and engineering plans, "All handicap accessible ramps shall meet all applicable local, regional, state, and federal accessibility guidelines and regulations. Additionally, we suggest the applicant provide a stop sign and stop bar for the ingress from Prosperity Center into the Sunoco site. 6. The applicant shall revise the Drainage Statement to specify that the parking lots and driveways will be protected from the 5-year/1-day storm event consistent with LDR Section 78 -523. ' The applicant shall provide a Site Electrical /Photometric Plan signed and sealed by a professional engineering licensed in the state of Florida in accordance with LDR Section 78 -46. The applicant shall coordinate with City staff and revise the Waiver Justification Statement to reflect the current City of Palm Beach Gardens Land Development Regulations (LDR). i ft The applicant shall revise the Site Electrical /Photometric Plan to eliminate the footcandle values greater than` 100 for consistency with the previously approved plans and consistent with Ordinance 6, 2001. The applicant has requested a waiver from Section 95(e) of the Zoning Code however, the applicant shall revise the waiver request to identify the correct code, LDR Section 78 -182. Please note we remain in support of the City's LDR requirements. 10. The applicant has requested a waiver from Section .185(A) of the Zoning Code which requires loading spaces however, the applicant shall revise the wavier request to identify the correct code, LDR Section 78 -362. The applicant has provided a justification statement for this waiver indicating the cross - access point with the property to the east prohibits the placement of-a designated loading space. The applicant further explains the area adjacent to the dumpster can serve as an adequate loading area without interfering with parking and circulations. Please note we remain in support of the City's LDR requirements. . 11. The applicant has requested a waiver from Section 179(h) of the Zoning Code which requires a minimum 100 feet of off street stacking distance however, the applicant shall revise the waiver request to identify the correct code, LDR Section 78- 344(h). The applicant has provided a justification statement for this waiver indicating the proposed redevelopment is significantly more conforming to code than the existing development and that stacking cannot be met due to the limited size of the parcel. Page 3 of 6 LBFH File No. 06 -4474 Non - Certification Issues NOTE: All engineering /infrastructure plans are considered conceptual during the planning and zoning review phase and are subject to further review during the final construction review. These non - certification comments shall be satisfied prior to construction plan approval and the issuance of the first land alteration permit_ 1. The applicant shall revise the plans to indicate reinforced concrete pipe (RCP) for drainage pipes under all load bearing pavement areas. The drainage pipe shown at the northeast corner and the southwest corner of the site are identified as PVC on the Paving and Drainage Plans. 2. The applicant shall revise the Water Management Calculations to justify the soil storage as a function of the season high water table. 3. The applicant shall revise the Water Management Calculations for the "Existing Discharge to SR 786" The applicant shall consider using the Santa Barbara Unit Hydrograph method consistent with the post - development analysis submitted. 4. The applicant shall justify the stage /storage data shown in the surface water management (SWM) model. 5. The applicant shall justify the Tail Water assumption represented in the Water Management Calculations. 6. The applicant shall provide bleeder sizing calculations justifying the 0.667 -foot bleeder identified in the Water Management Calculations. 7. The applicant shall revise the weir coefficient identified in the SWM model from 0.6 to a value more consistent with a sharp- crested weir. 8. The applicant shall revise the invert elevation of the bleeder identified in the SWM. model (elevation = 3.0 -feet) and Paving and Drainage Plan (elevation = 3.5 -feet) for consistency. 12. Prior to the issuance of the first land alteration permit, the applicant shall.provide a copy of the following approved permits, as applicable: a. SFWMD b. NPBCID C. PBC d. FDOT e. PBC Health Department /FDEP f. NPDES 9. The applicant shall provide a cost estimate for the project, including public infrastructure and all landscaping and irrigation costs for review and approval by the City in order to establish surety. The cost estimate shall be signed and sealed by an engineer and landscape architect registered in the state of Florida. "Prior to construction plan approval and the issuance of the first land alteration permit, applicant shall provide cost estimates in accordance with LDR Section 78- 309 and 78 -461 and for on -site project improvements, not including public infrastructure, or landscaping and irrigation costs for review and approval by the City. The cost estimates shall be signed and sealed by an engineer and landscape architect registered in the state of Florida and shall be posted with the City, prior to the issuance of the first land alteration permit. If, at any time during the project development, it is determined by the City that any of the surrounding areas are experiencing negative drainage impacts caused by the project, it shall be the applicant's responsibility to cure said impacts in a period of time and a manner acceptable to the City prior to additional construction activities.
