Ferris Meeting Date: June 4, 2013 PCDA- 13 -03- 000017 Page 2 of 6 A� , The subject request is to add a 0.28 -acre parcel of land to the Downtown at the Gardens (DTAG) site plan and make modifications to the parking lot located at the southern portion of the site. Staff is recommending approval of the petition. One (1) waiver is requested as part of the petition. On October 5, 1995, the City Council approved a Future Land Use (FLU) Map amendment via Ordinance 10, 1995, which amended the FLU designation of the DTAG parcel from Residential Medium (RM) to Professional Office (PO). DTAG is located within the Regional Center Planned Community Development (PCD). The DTAG site plan was initially approved by the City Council on June 5, 2003, via Resolution 91, 2003. The original DTAG site plan authorized the development of 26,000 square feet of neighborhood commercial, 220,745 square feet of retail / restaurant, 67,690 square feet (up to 3,220 seats) of cinema, and 20,000 square feet of professional office. A shared parking study was approved as part of that Resolution. On September 24, 2009, the City Council approved Resolution 58, 2009 to replace the most current shared parking analysis with parking regulations from City Code. The Applicant provided the parking required by Code in order to eliminate the need for the shared parking study. This also eliminated the need for a bond for the second parking garage that was associated with the shared parking study. On July 13, 2012, the City Council approved Resolution 58, 2012, extending the Applicant's use of the Gosman site for valet parking until December 21, 2013. On September 13, 2012, the City Council approved Resolution 81, 2012 approved a shared parking study for the DTAG site and modified conditions of approval related to lighting. The subject site is located within the Regional Center PCD. The site has a Professional Office (PO) future land -use designation and a PCD Zoning Overlay, with an approved Master Plan. Resolution 22, 2013 rescinded the development order approving the Regional Center Development of Regional Impact (DRI) and incorporated Map H as the PCD Master Plan Map. The build -out date for the Regional Center PCD is December 6, 2016. Site Details The Downtown at the Gardens (DTAG) site is bound by Gardens Parkway to the north, Kyoto Gardens Drive to the south, Alternate A1A to the west, and Lake Victoria Gardens Avenue to the east. DTAG is located within the Regional Center PCD. The site has access from PGA Boulevard via Lake Victoria Gardens Avenue, Alternate A1A, and Gardens Parkway via Lake Victoria Gardens Avenue. The parcel is approximately 49 acres (see attached Location Map). The Applicant is proposing to add a 0.28 -acre parcel of land to the DTAG site plan to accommodate additional parking spaces at the south portion of the site. The 0.28 -acre parcel is currently part of the Kyoto Gardens Drive right -of -way (ROW) and owned by the City. In exchange for the 0.28 -acre parcel, the Applicant will construct a dedication westbound right -turn lane on Kyoto Gardens Drive. Phasinq Plan The proposed improvements will be built in one (1) phase. Parking The Applicant is proposing to construct 73 new parking spaces at the southeast corner of the DTAG site. To accommodate the new parking spaces, two (2) existing rows of parking will be redesigned and two (2) new rows will be added. The southeast portion of the site is highly utilized by patrons of the shopping center. The additional parking will greatly improve the center's on -site operations. Meeting Date: June 4, 2013 PCDA- 13 -03- 000017 Page 4 of 6 Landscaping The proposed site alterations require the existing landscape buffer along Kyoto Gardens Drive to be reduced. The Applicant has requested a waiver for the reduced landscape buffer. City Code Section 78 -319 requires a 20 -foot landscape buffer adjacent to a ROW with a width of 100 feet or more; Kyoto Gardens Drive is 110 feet wide. The Applicant is proposing an eight- (8) foot wide landscape buffer between the new property line and Kyoto Gardens Drive, which is the greatest buffer width attainable due to the proposed modifications. However, there will be approximately 20 feet of green space within the ROW between the proposed property line and the edge of the roadway that is owned and controlled by the City. The ROW will contain a five- (5) foot wide pedestrian sidewalk and additional landscaping. In addition to the series of Live Oak trees existing within the ROW, the Applicant will be supplementing the ROW with Imperial Bromeliad shrubs and ground cover. Two (2) of the Oak trees in the ROW will be transplants from those affected by the proposed turn lane. Waiver Request The Applicant is requesting one (1) waiver with this petition. 78- 319(x)(2), 20 -foot landscape 8-foot 1 Minimum Buffer landscape 12 feet Approval Requirements buffer buffer 1) The Applicant is requesting a waiver from City Code Section 78- 319(x)(2), Minimum Buffer Requirements, to allow an eight- (8) foot wide landscape buffer for a limited area along the southern property line adjacent to Kyoto Gardens Drive. The proposed buffer will contain a number of Live Oak trees, East Palatka Holly trees, Ligustrums, Fan Palms, as well as a variety of shrubs and ground cover. The four (4) Oak tress affected by the proposed turn lane will be replanted in close proximity to the affected area. Vegetation has been provided to the greatest extent possible in consideration of utility easements on the site. Overall, the impacted Oak Trees will be replanted on site and the proposed changes to the DTAG site plan will greatly enhance the parking needs at the southern portion of the site. Staff supports the waiver request. STAFF ANALYSIS Meeting Date: June 4, 2013 PCDA- 13 -03- 000017 Page 5 of 6 In order to accommodate the additional parking spaces, the City will deed a 0.28 -acre parcel of land which is currently part of the Kyoto Gardens Drive ROW to the Applicant. In exchange for a portion of the ROW, the Applicant is proposing to construct dedicated a westbound right -turn lane on Kyoto Gardens Drive. The improvement would provide a benefit to the public wishing to travel north on Alternate Al from Kyoto Gardens Drive. The turn lane improvement will require four (4) Live Oak trees to be removed. The affected trees will be replanted in close proximity to the affected area in an effort to maintain the existing tree canopy cover. Three (3) of the Oak trees will be planted within the ROW and the fourth will be planted within an existing median in the southern parking area. On April 10, 2013, the subject petition was reviewed by the DRC. At this time, all certification issues have been satisfied. Staff recommends APPROVAL of petition PCDA- 13 -03- 000017 with the following conditions: Planning & Zoning 1. Prior to scheduling for City Council, all outstanding comments in staff's memo dated May 21, 2012 must be satisfied. 2. Prior to construction plan approval and issuance of the first land alteration permit, the Applicant shall schedule a pre - permit meeting with the Planning and Zoning Department. 3. Prior to the issuance of the Certificate of Completion for the subject site improvements, digital files (pdf and CAD) of the approved civil design and architectural drawings, including floor plans, shall be submitted to the GIS Manager. 4. This amendment is required because new land is being added to the project area and because waivers are requested. Downtown at the Gardens was first approved in 2003 as a commercial mixed -use project comprising of retail, office, research and development office, theater, and neighborhood commercial uses. Parking in the south part of the project has been in high demand for many years due to the cluster of popular restaurants and the Whole Foods market in this location. This additional parking will provide a better distribution of spaces in this area of the center where patrons visiting tenants such as Whole Foods and Yard House demand convenient parking. The proposed plan introduces 74 net parking spaces to the center by adding four net rows of parking. It should be noted that two existing rows of parking are being eliminated with the design proposed. The applicant is proposing to acquire 0.28 acres of City owned land currently located on the north side of the Kyoto Gardens Drive right of way, directly east of Alternate A1A. By adding this land to the Downtown at the Gardens site the applicant can add more parking to the south side of the site. It is important to note that there are no plans to expand Kyoto Gardens Drive by the City. The land is currently green space between the subject property and the sidewalk. The acquisition of the 0.28 acres by the applicant provides a public purpose because in return the applicant will construct a right turn lane on Kyoto Gardens Drive so that westbound traffic can easily head north on Alternate A1A. This turn lane will provide a great benefit to the City and the residents of Palm Beach Gardens. There is no other property owner that could benefit from the acquisition of this land because it is adjacent to Downtown at the Gardens. Another important aspect of this new parking area is that it allows the applicant to eliminate the valet parking currently functioning on the " Gosman" parcel (a.k.a. Gardens Corporate Center). Although this valet area is a temporary use it has provided much needed parking for the south end of the center. The parking on the Gosman parcel decreased the valet waiting periods for patrons by half. The south valet will now have more parking on the subject site and can eliminate the need for valet parking at an off -site location. On the other hand this request will not eliminate the contingent parking plan for the garage on the north side of the property that was approved last year. The 1,037 parking spaces proposed as part of that plan will remain in place. However only 22 of those spaces are now considered required (without shared parking) because of the 74 parking spaces that will be added to the south parking area. Maintaining the contingency plan will allow for greater flexibility of uses within the center in the future. Waiver The proposed plan requires one waiver request for a reduced landscape buffer. The applicant is proposing an 8 -foot landscape buffer between the new property line and the vehicle overhang of the parking area adjacent to Kyoto Gardens Drive. The code requires at least 20 -feet of landscape buffer to occur adjacent to a right of way over 100 -feet in width. The proposed right of way will be a maximum of 112 feet wide. A twenty foot wide landscape buffer cannot be provided in this location due to the expansion of the parking to the south. If more land was taken from the right of way to provide a twenty foot wide buffer the turn lane could not be installed. 2 Downtown at the Gardens CH 00- 1003.03 PCD Amendment Statement of Use March 6, 2013 (Whe request is consistent with the city's comprehensive plan. The subject waiver is consistent with the city's comprehensive plan. The underlying land use for the property is Professional Office. The applicant is proposing a waiver to decrease the width of the landscape buffer on the south boundary adjacent to Kyoto Gardens Drive. The comprehensive plan does not regulate landscape buffers. (2) The request is consistent with the purpose and intent of this section. The proposed request is consistent with the PUD requirements within the code. The purpose of PUD's is to encourage more efficient and creative development or redevelopment of property; to provide maximum opportunity for application of innovative concepts of development; to provide one or more specifically - identifiable benefits to city residents. The applicant has come up with a creative solution to a parking demand their use has created on -site. They have also provided a benefit to the city while providing a turn lane that everyone can use in a public right of way. (3) The request is in support of and furthers the city's goals, objectives, and policies to establish development possessing architectural significance, pedestrian amenities and linkages, employment opportunities, reductions in vehicle trips, and a sense of place. The decrease in the landscape buffer is directly related to a joint benefit for both the city and the applicant. Allowing for the reduced landscape buffer will permit the installation of a turn lane for the use of residents and visitors of the city, as well as additional parking for Downtown. Providing the additional parking will ensure that Downtown will remain a strong and viable center within the city providing a sense of place and landmark for its residents and visitors. (4) The request demonstrates that granting of the waiver will result in a development that exceeds one or more of the minimum requirements for PUDs. The center already exceeds many requirements for PUDs as it exists today including additional landscape, pedestrian connectivity, and amenities. However the proposed waiver will result in a project that further meets the intent of a PUD. First the PUD will have parking above the code requirement and located in the much contested "south end ". This additional parking will add flexibility for the center in the future. Second the applicant is proposing a right turn lane from Kyoto Gardens Drive onto Alternate A1A (north bound). This turn lane is not required as a result of the subject development and is above and beyond the requirements of the code. (5) The request for one or more waivers results from innovative design in which other minimum standards are exceeded. 3 Downtown at the Gardens CH 00- 1003.03 PCD Amendment Statement of Use March 6, 2013 The proposed waiver results from the innovative design of a parking area in the south end. There has been a constant demand by the city and its residents for more parking in the south end of the center. The applicant and their consultants have worked diligently to come up with a creative design solution to provide this additional parking at- grade, and at the same time meeting its internal lease agreements. (6) The request demonstrates that granting of the waiver will result in preservation of valuable natural resources, including environmentally - sensitive lands, drainage and recharge areas, and coastal areas. The applicant is not proposing to impact any valuable natural resources as a result of this request. (7) The request clearly demonstrates public benefits to be derived, including but not limited to such benefits as no -cost dedication of rights -of -way, extensions of pedestrian linkages outside of the project boundaries, preservation of important natural resources, and use of desirable architectural, building, and site design techniques. As discussed the applicant is proposing to construct a turn lane within the right of way of Kyoto Gardens Drive for the use of the public. The applicant is also proposing additional parking on the subject site that will benefit the center and its visitors. (8) Sufficient screening and buffering, if required, are provided to screen adjacent uses from adverse impacts caused by a waiver. The applicant is not proposing a use that requires a waiver. (9) The request is not based solely or predominantly on economic reasons. The request is not solely based on economic reasons. The waiver is needed to provide for the additional parking on site. The additional parking is actually a financial expenditure for the applicant and will not make any profit off of this amenity for its patrons. (1) The request will be compatible with existing and potential land uses adjacent to the development site. The 8 -foot buffer is adjacent to a public right of way and a parking lot. The buffering proposed is adequate for such uses. The parcel further to the south, known as the Gosman parcel, is commercial in nature and will be over 100 -feet away from the subject buffer. 29 Downtown at the Gardens CH 00- 1003.03 PCD Amendment Statement of Use March 6, 2013 (11) The request demonstrates the development will be in harmony with the general purpose and intent of this section, and that such waiver or waivers will not be injurious to the area involved or otherwise detrimental to the public health, safety, and welfare. The proposed waiver will not be injurious to the area or detrimental to the public health, safety, or welfare. The proposed buffer will continue to serve the purpose of the code which is to provide an aesthetic pleasing boundary around the perimeter of the center and screening unsightly parking areas. In no way will reducing the width of the buffer be injurious to the area or detrimental to the public health, safety an welfare. Conclusion Overall the proposed amendment will be a join public /private benefit. The turn lane will be a great benefit to the City and its residents. The additional parking will be a great benefit to Downtown and its patrons. If Downtown at the Gardens is strong and viable the City will benefit through increased taxes and by providing a sense of place with a real "downtown" for the City. The sign location is already approved, but the proposed sign is not consistent with the general design of the approved design scheme for signage at the MacArthur Center PCD. However, the sign has been designed to be consistent with the architectural elements of the building. Staff recommends approval of the subject request. BACKGROUND On February 16, 1984, the City Council adopted Resolution 9, 1984, approving the MacArthur Regional Center Development of Regional Impact (DRI). The DRI is approximately 458 acres, and is located on the parcel surrounded on the north by Atlantic Road, on the east by Prosperity Farms Road, on the west by Alternate A1A, and on the south by PGA Boulevard. The DRI was approved for a mixture of land uses consisting of retail, office, hotel, residential, open space, and community use. On September 1, 1994, the City Council adopted Resolution 118, 1994, approving the Medical Mall PUD (the former name for the Financial Center at the Gardens PUD), The PUD was approved for three (3) buildings with 478,000 square feet of medical and professional office space, including a 120 -bed skilled nursing facility. The approval also included two (2) monument signs, one (1) at the entrance of the PUD on Kyoto Gardens Drive, and another at the intersection of PGA Boulevard and Lake Victoria Gardens Avenue. The site has subsequently been amended by Resolution 89, 1995, Resolution 69, 1996, and Resolution 164, 1996 by the City Council, approving site plan and architectural elevation changes. On September 3, 1998, the City Council adopted Resolution 64, 1998, approving a Master Signage Program (MSP) for the MacArthur Center. The MSP contains seven (7) Main Entry signs, 13 Directional signs, 28 Building ID signs, Street Regulatory signs per code, and four (4) Temporary Site signs. The MSP permitted the subject site to have one (1) additional monument or Building ID sign (as referred to in the MSP). On January 18, 2001, the City Council adopted Resolution 10, 2001, granting waivers to allow additional wall signs and for two (2) signs to be located beneath the tenth floor parapet of the 3801 PGA Boulevard building in the Medical Mall PUD. On December 6, 2001, the City Council adopted Ordinance 42, 2001, approving an amendment to Phase Two (2) of the Medical Mall PUD to allow the construction of two (2) six (6) -story office buildings and one (1) six (6) -story parking structure. PROJECT DETAILS Site Details The subject PUD is approximately 15.6 acres in size and is located on the northwest corner of PGA Boulevard and Alternate A1A. The site has vehicular access from Kyoto Gardens Drive and Lake Victoria Gardens Avenue, Subject Request The Financial Center at the Gardens PUD is approved to have three (3) monument signs, of which two (2) have been installed: One (1) sign at the entrance of the site on Kyoto Gardens Drive; the other at the second entrance on Lake Victoria Gardens Avenue. Both signs are identical and follow the design guidelines set forth by the MacArthur Center Master Signage Program (MSP). The third monument sign location was approved prior to the MSP approval and is shown on the PUD site plan, and is proposed to be installed adjacent to the 3801 PGA Boulevard building. The Applicant is requesting approval for this sign to deviate from the two (2) existing signs. The proposed sign is permitted by Code. The Applicant is not requesting any waivers with the subject petition. STAFF ANALYSIS The sign will be visible from the intersection of PGA Boulevard and Lake Victoria Gardens Avenue, and will serve as a way finding sign for this large parcel. The two (2) existing signs have not incorporated any tenant names. The proposed sign will incorporate the names of five (5) tenants, as permitted by Code. There are strict limitations on the wall signs for the existing building. The proposed monument sign will allow vehicles accessing the parcel to be able to identify and locate certain professional and medical office tenants located within the site. However, several existing signs located such as in Downtown at the Gardens and the Gardens Mall have been designed in accordance with each site's individual design. With the third sign, the proposed materials and colors are consistent with the two (2) existing signs, but with a more modern design. The sign is also consistent with the architectural materials of the building. There will be ground lighting and sufficient landscaping provided at the base of the monument sign. The proposed design of the monument sign meets the City's code and is consistent with what the City Council originally approved for the Financial Center at the Gardens PUD. Specifically the applicant is proposing the design for the ground sign located on the east side of the Mediplex (3801 PGA Boulevard) site, also known as Gardens Corporate Center Phase One. The location of this sign was approved as part of the 1999 PUD approval for Gardens Corporate Center Master Plan, however it was never constructed. Two freestanding ground signs were built for the Gardens Corporate Center however neither is on the 3801 PGA Boulevard site. If the applicant were to submit a permit for the approved un -built sign it would need to adhere to the design regulations approved with the original PUD and be consistent with the two existing signs. The signs designed in 1999 are almost 15 years old and are outdated. It does not represent the right image for PGA Boulevard and the Corridor. The purpose of the sign is to better direct visitors coming from PGA Boulevard. Currently there is no ground sign facing PGA Boulevard in this vicinity. Once the new alignment of PGA Boulevard and the bridge was completed the subject building was slightly hidden due to the 3801 PGA Boulevard (a.k.a. GCC Phase 1) CH# 12 -0410 Justification Statement April 5, 2013 May 17, 2013 height of the wall. A sign in this location will be beneficial to drivers on PGA Boulevard as well as those coming from areas south of PGA Boulevard such as Legacy Place. This sign does not require any waivers and meets all code requirements. The sign is ten (10) feet in height and 15 feet wide at its widest point (the base) with a three (3) foot tall base. The sign is double sided as permitted by code. The applicant is proposing a total of 32.91 SF of copy area, significantly less then the 60 feet permitted by code. The sign will have two areas of copy; the building address area and the tenant name area. The building address will have a maximum height of 12'inch letters and will be made of brushed aluminum. The applicant is proposing five (5) tenant names, the maximum permitted by code. The letters in the tenant sign area will be a maximum height of six (6) inches. The tenant sign letters will be powder coat aluminum. They will be attached to a painted stucco sign face. RI d N I 2. Prior to the issuance of the first Certificate of occupancy for Phase 1, the following road and utilities therein shall be constructed and open to the public: a. The internal loop road within Phase 11 b. Southwest Drive from Alternate A -1 -A to Fairchild Gardens Avenue (A portion of this road is the responsibility of the Good Samaritan North PUD), including the construction of the 6 -foot sidewalks and landscaping on both sides of the road. c. West Drive from PGA Boulevard to Southwest Drive, including the construction of the 6 -foot sidewalks and landscaping on both sides of the road. 39 The future right -of -way requirements for the grade separation of the PGA Boulevard /Alternate A -1 -A intersection shall be dedicated to the FDOT at no charge as generally depicted to sheet C4, dated February 16, 1994, prepared by DiFonte & Thomas, Inc., within 30 days of the date of request by the FDOT. 4. The petitioner shall comply with the permit conditions set forth by Northern Palm Beach County Water Control District in their June 14, 1994, letter to James R. Brindell and the petitioner agrees to participate in and comply with the implementation of Phase I and Phase II programs as set forth in the report entitled, Feasibility Studv and Conceptual Plan for Satisfying Future Irrigation Demands in Unit 19, Northern Palm Beach Countv Water Control District and any amendments thereto. 5. The garage for each phase of the project shall provide a stand pipe and fire hose for purposes of fire suppres- sion, in addition to the garages being protected by an automatic sprinkler system. 6. Areas that have been allowed to have vegetation or ground cover removed pursuant to the approved site plan, and subsequently abandoned for any reason for more than three months, shall be seeded with grass immediately upon request by the City or the City shall have the work done at the owner's expense. 7. Prior to clearing or construction, trees or native areas designated for preservation shall be tagged or roped -off. Prior to land clearing, the developer shall erect and maintain protective barriers around the drip line of the trees to be protected. All work shall be inspected and approved by the Landscape Architect of Record and the City Forester prior to the issuance of any Building , Department permit requiring land clearing. Section 153.20 shall also be enforced during construction. I I 8. All tree protection /relocation and landscape work shall be performed using current professional landscaping standards. The Landscape Architect of Record shall monitor all tree protection efforts, all tree relocation work, all landscaping work, and any work that affects the outcome of the approved landscape plans. The Landscape Architect of Record shall notify the City prior to any modifications to the approved landscape plan. 9. All trees or plants designated for preservation/ relocation that die during construction or because of construction practices shall be replaced using the following schedule: For every inch of tree caliper lost, three inches of new tree caliper shall be replaced with like specie. The minimum replacement tree shall be three inches in diameter. Palms shall be replaced with like specie one for one with a minimum 10' height. Shrubs shall be replaced with like specie one for one with a minimum 30" height. If the site cannot support the total number of replacement trees as required above, City Council may permit the developer to donate excess trees to the City for planting on public lands. 10. Prior to the issuance of the Certificate of Occupancy for a particular building in the project, the Landscape Architect of record shall certify in writing to the City that the landscaping associated with that building has been completed per the approved landscape plans. Any major changes to the approved landscape plans shall be approved by the City Council. Once the City has the certified letter from the Landscape Architect, the City Forester shall inspect the site for compliance. Once compliance has been confirmed by the City Forester, the City Building Department shall be notified. 11. Project shall abide by Resolution 2, 1993, which requires, prior to filing of the plat, the petitioner shall post a bond for the installation of the infra- structure including the common and project landscaping/ buffer and entry feature for each phase in which a permit is issued. 12. Prior to the C.O. of Phase 2, if permitted by FDOT, the developer shall install permanent landscaping pursuant to the Landscape Plan in the portion of the median of Alternate A -1 -A that is adjacent to the project in conjunction with the State's improvements to Alternate A -1 -A, and said median landscaping shall match that of PGA Boulevard. If the Statefs improvements to Alternate A -1 -A will not be completed by the time that Phase 2 of the project is completed then, in conjunction with the landscaping of Phase 2 of the project, the developer shall install M N (if permitted by the FDOT) landscaping in the portion of the median of Alternate A -1 -A that is adjacent to the project; such landscaping shall conform to the interim landscaping provided by the Gardens East PCD in Alternate A -1 -A and shall be irrigated. 13. Any meandering sidewalk or roadway landscaping, including the median, along PGA Boulevard and Alternate A -1 -A adjacent to the project that is removed in conjunction with the required construction of an overpass at PGA Boulevard and Alternate A -1 -A or the widening of Alternate A -1 -A adjacent to the project shall be replaced, if acceptable to FDOT and acceptable to the City, one time by the property owner of the project within thirty days of request by the City. 14. The landscaping along Alternate A -1 -A property shall match the landscaping along PGA Boulevard. 15. Prior to the issuance of a building permit for Phase I, a bond shall be posted for the meandering sidewalk along Alternate A -1 -A and the first 55 feet of landscaping from PGA Boulevard to Southwest Drive, construction of which shall commence within 18 months of issuance of the first building permit for Phase I. 16. There shall be no clearing of Phase II except within the first 50 feet from the Phase I boundary during the construction of Phase I. 17. Medical ancillary uses as referenced in Exhibit "B ", attached hereto, shall not be physically accessible directly from the outside of the medical office buildings except for any required emergency exits. 18. No external signage (except for the directory sign pursuant to the approved sign plan) shall be allowed for the ancillary uses proposed within the medical office buildings. Section 4. Before the issuance of the first building permit, petitioner shall provide the City with a letter of credit or performance bond in a form approved by the city in a sum of money prescribed by the City and shall be posted with the City of Palm Beach Gardens to assure the completion of the infrastructure including on -site roadways, drainage and utility improvements required for the Planned Unit Development and common and project landscape /buffer and entry features. From time to time as improvements are completed and approved by the City, the amount of the letter of credit or performance bond shall be reduced by a proportionate amount. Upon completion of all on -site roadway, drainage and utility improvements required for the Planned Unit Development, the City shall release said letter of credit or performance bond. Section 5. The development of the Planned Unit Development shall be completed prior to the February 16, 2004, buildout period of the Regional Center Development of Regional Impact. Section 6. Modifications to the Planned Unit Development that are determined to be minor by the City Council may be approved by subsequent Resolution without the necessity of review by the Planning and Zoning Commission, advertisement or public hearing. Section 7. All references to Petitioner and /or Developer, together with all requirements of this Resolution shall apply to and be binding upon the successors and assigns. Section 8. No Building Permit for the Planned Unit Development shall be issued until the drainage and paving plans shall be approved by the City Engineer and all other building requirements of the City of Palm Beach Gardens Code and require- ments of other governmental agencies, if necessary, shall be met. Section 9. Petitioner, prior to the issuance of the first Building Permit within the Planned Unit Development, shall deliver to the City a recordable Unity of Control by all owners of the property in requisite form approved by the City Attorney, acknowledging that the lands described in Exhibit "A ", if developed shall be developed in accordance with this resolution, unless otherwise approved by the City Council. Section 10. If any part or portion of this Resolution is found to be void or defective, the remainder of the Resolution shall continue in full force and effect. Section 11. passage.
