Ferris [X] Not Required D21 �3 - -7-> "4-) t' \ C/,'� i i Date Prepared: March 9, 2006 Meeting Date: April 18, 2006 Petition AIPP- 05 -09- 000004 BACKGROUND The subject site is a 41.75 -acre parcel bounded by Hood Road on the north, Central Boulevard on the east and south, and Interstate 95 and Westwood Gardens /Westwood Lakes Planned Unit Development on the west. Land Design South, on behalf of EB Developers, Inc., is proposing to rezone the site in order to construct 180 condominium dwelling units, 99,934 square feet of commercial development, and a 141,706 square -foot parking garage. There will be three entrances to the site, one from Hood Road and two from Central Boulevard. Per Section 78 -262 of the Land Development Regulations, "Fee imposed on development," all budgets for new construction of private and public developments shall include 1% of the total budgets for vertical construction as a fee for art in public places. The subject fee shall be used by the developer for the provision of artwork on the project site, or the developer may choose to contribute one percent (1 %) of the total building construction costs directly to the City for the provision of art on public property. DISCUSSION The developer met with the Art in Public Places Advisory Board on September 25, 2005, and proposed three locations for the art. The developer is now proposing only two of the locations for the works of art and is eliminating the art at the entrance to the north residential parcel. According to Section 78- 261(a)(2), art is not required for residential developments. The two remaining locations are unchanged within the Commercial Mixed Use portion of the development. PROPOSED LOCATIONS FOR ART The applicant is proposing the two (2) following locations for the public art: 1. The roundabout located within the central commercial development; and 2. The pedestrian plaza situated on the 1.56 -acre lake tract within the commercial development. The applicant states the proposed locations are consistent with Land Development Regulations Section 78- 261(b)(5) as follows: a. Visibility: All proposed public art locations are visible to both internal and external pedestrian and vehicular traffic. In addition, both locations adjacent to the commercial core serve as major focal points that have been incorporated into the overall development plan. b. Planning Integration: Again, all public art locations are highly visible and serve as integral components of the proposed development. ART IN PUBLIC PLACES ADVISORY BOARD At its meeting on September 20, 2005, the Art in Public Places Advisory Board voted 7 -0 to approve the three art locations previously proposed by the applicant with the primary location being most visible from the street. La Mariposa) Petition No. PUD -04 -11 Dear Jackie: The purpose of this letter is to notify the Art in Public Places Advisory Board of a revision made to the site plan concerning the public art locations. At the previous AIPP meeting, the committee voiced concerns regarding the location of the public art piece located at the southeast entrance to the northern residential parcel. They believed it should be below the MXD use line within. the Commercial area. The site plan has now been revised to remove this art location and keep the existing two locations intact. The applicant feels this will satisfy the committee and also provide two more extraordinary pieces of art within the MXD portion of the property. Subsequently, staff visited the site and verified that the height of the existing fountain is in compliance with the City Council approved plans. Attached for your review is page twenty- eight, which reflects the approved height of the fountain. In addition, due to the Board's discussion of the location of the "Journeys" art piece at the Benjamin High School, the minutes from the December 15, 2004, AIPP Advisory Board meeting have been attached for your review.
