Your comments must be forwarded to my attention by that date and time so that written comments can be given to the applicant in accordance with the timeframes established in the City's Land Development Code. Should you have no comments, please indicate so in a memo. Additional copies of the complete application are available in the Planning & Zoning Department. Petitions: PCDA- 12 -05- 000015 and MISC- 12 -05- 000085 October 10, 2012 MEETING DATE: A Development Review Committee meeting will be held on Tuesday, November 6, 2012, 2012 at 10:00 a.m., in the City Council Chambers to review the following development application: PALM BEACH GARDENS PETITIONS PCDA- 12 -05- 0000125 and MISC- 12 -05- 000085 Petition No. PCDA- 12 -05- 000125: A request on behalf of IMI Kyoto Gardens I LLC, IMI Kyoto Gardens III LLC, and the Macarthur Center Property Owner's Association, to modify and delete conditions of approval that are no longer applicable to the PCD. The subject PCD amendment will amend and restate the development order for the Regional Center PCD. The subject site is generally bounded by Alternate AIA to the east, PGA Boulevard to the south, Prosperity Farms Road and Meadows Mobile Home Park to the east, and Cabana Colony residential neighborhood to the north. MISC- 12 -05- 000085: A request on behalf of IMI Kyoto Gardens I LLC, IMI Kyoto Gardens III LLC, and the Macarthur Center Property Owner's Association, to rescind the Regional Center Development of Regional Impact (DRI) approval since recent State legislation (F.S. Section 380.06 (29)) no longer requires DRI lands to be monitored by the State of Florida. In addition, House Bill 7207 exempts DRIs within dense urban land areas (DULAs) from review. The City is classified as a DULA and this legislation granted the option for DRIs to rescind their development order, subject to the local government's approval. The subject site is generally bounded by Alternate AIA to the east, PGA Boulevard to the south, Prosperity Farms Road and Meadows Mobile Home Park to the east, and Cabana Colony residential neighborhood to the north. The Applicant will be in attendance at this meeting. Our office requests your participation in the review of this project. Please review this request and attend the meeting if possible.
