CALL TO ORDER: PLEDGE OF ALLEGIANCE: ROLL CALL Kevin Wagner, Special Magistrate Christine Tatum, City Attorney David Reyes, Operations Director Mitchell Wilson, Senior Code Compliance Officer Robert Creston, Code Compliance Officer QUASI - JUDICIAL PROCEEDINGS: The Code Compliance Special Magistrate shall have the jurisdiction and authority to hear and decide alleged violations of the codes and ordinances enacted by the City of Palm Beach Gardens, including, but not limited to, the following codes: building, electrical, fire, gas, landscape, plumbing, sign, zoning and other similar type codes which may be adopted by the City of Palm Beach Gardens in the future which regulate aesthetics, construction, safety, use of property, or location of any structure on real property in the City of Palm Beach Gardens. This authority is granted via Ordinance No. 8 -1995, Section 1, "Jurisdiction ". Special Magistrate Hearing 03.05.07 ,nom, AGENDA CITY OF PALM BEACH GARDENS CODE COMPLIANCE SPECIAL MAGISTRATE HEARING MARCH 5, 2007 COUNCIL CHAMBERS 5:30 P.M. Note: (Case No. 06 -08 -103 has 17 code violations and multiple code sections that apply to each violation) Violation Description and Code Section Violated: 1. A 20 HP boiler has been installed at the rear of the structure without permits or inspection. The boiler has been installed outdoors but is listed for indoor use. The boiler has been fitted with an atmospheric vent but is listed for use with a pressure rated vent. The boiler temperature and pressure relief vent has not been properly terminated. Also, an unauthorized hook -up of natural gas to the boiler was made. CODE SECTION: Chapter 69 -A -51 Boiler Safety The boiler has been installed and is being operated in violation of the applicable requirements contained in NFPA 85, NFPA 1,10.1.1, FBC 111.1, FBC 105.1. CODE SECTION: FBC 111.1— Connection of service utilities No person shall make connections from a utility, source of energy, fuel or power to any building or system that is regulated by this code for which a permit is required, until released by the building official. 2. Violation Description There is not a 2 hour separation between the dry cleaner and the beauty salon. In addition, there is not a 2 hour separation on both sides of the restaurant. The remaining businesses do not have a minimum of a one hour separation between them. Division of tenant space was done without proper permit or inspections has compromised the integrity of the required separation. CODE SECTION: NFPA 1, 10.1.1 Fundamental Requirements Every new and existing building or structure shall be constructed, arranged, equipped, maintained, and operated in accordance with this Code so as to provide a reasonable level of life safety, property protection, and public welfare from the actual and potential hazards created by fire, explosion, and other hazardous conditions. CODE SECTION: NFPA 1, 10.2.3 Owner /Occupant Responsibilities The owner, operator, or occupant of a building that is deemed unsafe by the AHJ (Authority Special Magistrate Hearing 03.05.07 AGENDA CITY OF PALM BEACH GARDENS CODE COMPLIANCE SPECIAL MAGISTRATE HEARING MARCH 5, 2007 COUNCIL CHAMBERS 5:30 P.M. Having Jurisdiction) shall abate, through corrective action approved by the AHJ, the condition causing the building to be unsafe either by repair, rehabilitation, demolition, or other corrective action approved by the AHJ. CODE SECTION: NFPA 90A 5.3* Penetrations — Protection of Openings. 5.3.1 Fire -Rated Walls and Partitions. 5.3.1.1 * Approved fire dampers shall be provided where air ducts penetrate or terminate at openings in walls or partitions required to have a fire resistance rating of 2 hours or more. 5.3.1.2 Approved fire dampers shall be provided in all air transfer openings in partitions that are required to have a fire resistance rating and in which other openings are required to be protected. CODE SECTION: FBC 302.3.2 Separated uses, FBC 105.1, ACI 530, ACI 530.1 Each portion of the building shall be individually classified as to use and shall be completely separated from adjacent areas by fire barrier walls or horizontal assemblies or both having a fire - resistance rating determined in accordance with Table 302.3.2 for uses being separated. Each fire area shall comply with this code based on the use of that space. Each fire area shall comply with the height limitations based on the use of that space and the type of construction classification. In each story, the building area shall be such that the sum of the ratios of the floor area of each use divided by the allowable area for each use shall not exceed one. 3. A wall and a counter were installed in the restaurant without permits and inspections and the egress components are not code compliant. CODE SECTION: NFPA 101 7.3.4 Means of Egress Minimum Width. The width of any means of egress shall be not less than that required for a given egress component in Chapter 7 or Chapters 12 through 42, and shall be not less than 36 in. (91 cm). Exception No. 1 *: The width of exit access formed by furniture and movable partitions, serving not more than six people and having a length not exceeding 50 ft (15 m), shall be not less than 18 in. (45.7 cm) at and below a height of 38 in. (96 cm), or 28 in. (71 cm) above a height of 38 in. (96 cm), provided that widths not less than 36 in. (91 cm) for new exit access and 28 in. (71 cm) for existing exit access are provided without moving pennanent walls. 4 Special Magistrate Hearing 03.05.07 AGENDA CITY OF PALM BEACH GARDENS CODE COMPLIANCE SPECIAL MAGISTRATE HEARING MARCH 5, 2007 COUNCIL CHAMBERS 5:30 P.M. 4. The current steps at the rear of the building are not code compliant as a means of egress for those suites that are currently using the rear exit as a means of egress. CODE SECTION: NFPA 101 7.1.7 Changes in Level in Means of Egress. Changes in level in means of egress shall be achieved either by a ramp or a stair where the elevation difference exceeds 21 in. (53.3 cm). 5. Clear spaces for electrical equipment, fixed counters, and other fixed equipment have been installed without permit and are obstructing the clear working space required for electrical service equipment. CODE SECTION: NFPA 70,110.26. (B) Clear Spaces Working space required by this section shall not be used for storage. When normally enclosed live parts are exposed for inspection, or servicing, the working space, if in a passageway or general open space shall be suitably guarded. 210.21 Outlet Devices. CODE SECTION: NFPA 70,110.26. (A) (2) Width of Working Space. The width of the working space in front of the equipment shall be the width of the equipment or 750 mm (30 in.), whichever is greater. In all cases, the work space shall permit at least a 90 degree opening of equipment doors or hinged panels. 6. Receptacles and wiring have been installed without permit and do not comply with the existing branch circuit ratings. CODE SECTION: NFPA 70 ARTICLE 210.21 Outlet Devices Outlet devices shall have an ampere rating that is not less than the load to be served and shall comply with 210.21(A) and (B). 7. Modifications to the structure have been made without benefit of permits or inspections by the division. Some of these modifications have created a significant hazard to the occupants of the structure and the general public. Several spaces have been divided without permitting and inspection. This has resulted in multiple tenants sharing the same electrical panel. Special Magistrate Hearing 03.05.07 AGENDA CITY OF PALM BEACH GARDENS CODE COMPLIANCE SPECIAL MAGISTRATE HEARING MARCH 5, 2007 COUNCIL CHAMBERS 5:30 P.M. CODE SECTION: NFPA 70 ARTICLE 225.35 Access to Occupants. In a multiple tenant building each occupant shall have access to the occupant's supply disconnecting means. FBC 105.1 8. A transfer switch has been installed in the pizzeria for an emergency generator without permit or inspections. Significant electrical work has been performed without permits or inspection which is in clear violation of applicable standards. This action resulted in the installation of illegal electrical components and wiring throughout the entire building and electrical room. Entire electrical system needs to be brought to code by a licensed electrical contractor. CODE SECTION: NFPA 70 ARTICLE 250.4 General Requirements for Grounding and Bonding. FBC 105.1 9. Residential appliances have been installed in the Latin restaurant. Cooking appliances must be installed in conformance with the manufacturer's listing. Mechanical ventilation and exhaust must be provided in commercial kitchens in conformance with the specific appliances and hoods served. Grease duct systems must comply with NFPA 96. CODE SECTION: NFPA 96 Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations 4. 1.1 Cooking equipment used in processes producing smoke or grease -laden vapors shall be equipped with an exhaust system that complies with all the equipment and performance requirements of this standard. CODE SECTION: FBC MECHANICAL 506.1, 506.4, 917.1 Cooking appliances. Cooking appliances that are designed for permanent installation, including ranges, ovens, stoves, broilers, grills, fryers, griddles and barbecues, shall be listed, labeled and installed in accordance with the manufacturer's installation instructions. Oil - burning stoves shall be tested in accordance with UL 896. Solid fuel -fired ovens shall be tested in accordance with UL 2162. 10. Fire hydrant does not have a clearance of 7 1/2' to the front and sides and 4' to the rear. 6 Special Magistrate Hearing 03.05.07 AGENDA CITY OF PALM BEACH GARDENS CODE COMPLIANCE SPECIAL MAGISTRATE HEARING MARCH 5, 2007 COUNCIL CHAMBERS 5:30 P.M. CODE SECTION: NFPA 1 Uniform Fire Code 18.3.4.1 Fire Hydrants- Clearances of seven and one half feet (7'- 6 ") in front of and to the sides of the fire hydrant, with a four foot (4') clearance to the rear of the fire hydrant. 11. The building's meter room is being used for the purpose of storage of materials and debris. CODE SECTION: NFPA 70 Article 110.26 Working space required by this section shall not be used for storage. When normally enclosed live parts are exposed for inspection, or servicing, the working space, if in a passageway or general open space shall be suitably guarded. 210.21 Outlet Devices. 12. Foreign systems have been installed in the dedicated equipment space in meter room outside. CODE SECTION: NFPA 70 Article 110.26(F (1) Working space required by this section shall not be used for storage. When normally enclosed live parts are exposed for inspection, or servicing, the working space, if in a passageway or general open space shall be suitably guarded. 210.21 Outlet Devices. 13. Multiple tenants are sharing air through penetrations made in required separations. CODE SECTION: FBC MECHANICAL 403.2.1 Recirculation of air. The air required by Section 403.3 shall not be recirculated. Air in excess of that required by Section 403.3 shall not be prohibited from being recirculated as a component of supply air to building spaces, except that: 1. Ventilation air shall not be recirculated from one dwelling unit to another or to dissimilar occupancies. 2. Where mechanical exhaust is required by Table 403.3, recirculation of air from such spaces shall be prohibited. All air supplied to such spaces shall be exhausted, including any air in excess of that required by Table 403.3 . CODE SECTION: FBC 712.3.3 Ducts and air transfer openings. Penetrations of fire - resistance -rated walls by ducts and air transfer openings that are not protected with fire dampers shall comply with this section. 14. Ventilation air is being re- circulated through differing occupancies. Special Magistrate Hearing 03.05.07 AGENDA CITY OF PALM BEACH GARDENS CODE COMPLIANCE SPECIAL MAGISTRATE HEARING MARCH 5, 2007 COUNCIL CHAMBERS 5:30 P.M. CODE SECTION: FBC 716.1.1 Ducts and air transfer openings without dampers. Ducts and air transfer openings that penetrate fire- resistance -rated assemblies and are not required by this section to have dampers shall comply with the requirements of Section 712 . 15. Handicap signage and striping for handicap parking spots is not installed as designated on plans. CODE SECTION: US DEPARTMENT OF JUSTICE ADA STANDARDS FOR ACCESSIBLE DESIGN 4.6 Parking and Passenger Loading Zones. 4.6.1 Minimum Number. Parking spaces required to be accessible by 4.1 shall comply with 4.6.2 through 4.6.5. Passenger loading zones required to be accessible by 4.1 shall comply with 4.6.5 and 4.6.6. 4.6.2 Location. Accessible parking spaces serving a particular building shall be located on the shortest accessible route of travel from adjacent parking to an accessible entrance. In parking facilities that do not serve a particular building, accessible parking shall be located on the shortest accessible route of travel to an accessible pedestrian entrance of the parking facility. In buildings with multiple accessible entrances with adjacent parking, accessible parking spaces shall be dispersed and located closest to the accessible entrances. 4.6.3* Parking Spaces. Accessible parking spaces shall be at least 96 in (2440 mm) wide. Parking access aisles shall be part of an accessible route to the building or facility entrance and shall comply with 4.3. Two accessible parking spaces may share a common access aisle (see Fes). Parked vehicle overhangs shall not reduce the clear width of an accessible route. Parking spaces and access aisles shall be level with surface slopes not exceeding 1:50 (2 %) in all directions. 4.6.4* Signage. Accessible parking spaces shall be designated as reserved by a sign showing the symbol of accessibility (see 4.30.7). Spaces complying with 4.1.2(5)(b) shall have an additional sign "Van- Accessible" mounted below the symbol of accessibility. Such signs shall be located so they cannot be obscured by a vehicle parked in the space. The following violations of the City of Palm Beach Gardens Code of Ordinances were observed: Special Magistrate Hearing 03.05.07 AGENDA CITY OF PALM BEACH GARDENS CODE COMPLIANCE SPECIAL MAGISTRATE HEARING MARCH 5, 2007 COUNCIL CHAMBERS 5:30 P.M. 16. The off - street parking facility has not been maintained and needs to be resurfaced. CODE SECTION: Sec. 78 -344. Construction and maintenance. (b) General requirements Off - street parking facilities shall be constructed, maintained, and operated in accordance with the requirements listed below. (c) Paving and drainage. Drainage for off - street parking facilities shall comply with the requirements of this chapter. Unless otherwise provided by this division, off - street parking facilities shall be paved with concrete, asphaltic concrete, asphalt, or other materials acceptable to the city engineer. (e) Wheel stops. Wheel stops, bumper stops, or nonmountable concrete curbing shall be installed within all parking spaces. The purpose of such parking control devices is to avoid encroachment into landscape areas, or avoid encroachment of parked cars into travel aisles or pedestrian facilities. (f) Striping (1) Parking stalls. Off - street parking facilities shall delineate each parking stall by stripes painted in white. The width of the painted stripe shall be four inches. All parking stalls nine feet or less in width shall be marked by double stripes. The separation from the inside edge of stripe to inside edge of stripe shall be no less than eight inches and no more than 16 inches. (2) Other striping. All other striping, excluding parking stalls, shall be installed with thermoplastic materials. (g) Lighting. If the off - street parking facility contains ten or more spaces, exterior lighting, shall be provided, pursuant to section 78 -182. (i) Prohibition of other uses. Required off - street parking areas shall not be used for the following: (1)The sale, repair, dismantling, or servicing of any vehicle; or (2) The sale, repair, storage, or servicing of other equipment or supplies. 19. Trash and debris are strewn throughout the property. CODE SECTION: Sec. 34 -121 and 79 -5. Enumerated conditions prohibited, declared nuisance and Property Maintenance Standards. The allowing of debris, rubbish, trash, tin cans, papers, or stagnant water to accumulate, or a dense growth of trees, vines, underbrush, weeds, wild growth, or grass in excess of 12 inches 9 Special Magistrate Hearing 03.05.07 AGENDA CITY OF PALM BEACH GARDENS CODE COMPLIANCE SPECIAL MAGISTRATE HEARING MARCH 5, 2007 COUNCIL CHAMBERS 5:30 P.M. in height from the ground on vacant lands contiguous to developed residential lots and on developed residential lots, and in excess of 18 inches from the ground on all other lands, to develop on any lot, tract, or parcel of land in the city, to the extent and in the manner that it constitutes or may reasonably become a menace to life, property, the public health, or the public welfare; creates a fire hazard; or provides a nest or breeding ground for sand flies, mosquitoes, rats, mice, other rodents, snakes, and other types of pests and vermin, shall be unlawful and is prohibited and declared to be a public nuisance. CODE SECTION: Sec. 34-122. Owner to keep property clear of rubbish, vegetation. (a) It shall be unlawful for any person to throw or permit to be deposited or scattered upon any private property within the city, whether owned by the person or not, any litter, debris, rubbish, trash, tin cans, or papers, except that the owner or person in control of the private property may deposit same in designated areas and containers for collection thereof as provided in other ordinances. (b) Any owner, lessee, or occupant of any lot, tract, or parcel of land in the city who permits debris, rubbish, trash, tin cans, papers, or stagnant water to accumulate, or a dense growth of trees, vines, underbrush, weeds, wild growth, or grass in excess of 12 inches in height from the ground on vacant lands contiguous to developed residential lots or on developed residential lots, or in excess of 18 inches from the ground on all other lands, to develop in any lot, tract, or parcel of land, improved or unimproved, within the city to the extent and in the manner that it constitutes or may reasonably become a menace to life, property, the public health, or the public welfare; creates a fire hazard; provides a nest and breeding ground for sand flies, mosquitoes, rats, mice, other rodents, snakes, and other types of pests and vermin shall be unlawful and in violation of this article. CODE SECTION: Sec. 78 -147. CGl- General commercial district. (a) Composition and intent. The CG 1 general commercial district provides both the retail goods and services supplied by the neighborhood business districts and the wider range of retail goods and services required by residents or a group of neighborhoods. This district is not intended to be suited for outdoor sales activities. The district shall be primarily oriented to intersections of major thoroughfares within the city. To protect the abutting and surrounding residential areas, only certain uses shall be permitted as provided in this article. (b) Permitted uses. Permitted uses are described in the chart in Table 21. (c) Property development regulations. Establishments allowed as permitted or conditional uses shall sell products only at retail. B.
