MILITARY TRAIL PALM BEACH GARDENS, FLORIDA 33410 -4698 March 21, 2007 Sent via FEDEX Ms. Wendy Ross Ross Sculpture Studio 6611 Landon Lane Bethesda, MD 20817 Re: Warranty Claim - PGA Blvd. Flyover Tower Sculptures Dear Ms. Ross: As you know, the four sculptures were completed and installed by Ross Sculpture Studio, and finally accepted by the City on November 8, 2006. Since then, severe corrosion has appeared on several surface areas on all four sculptures as well as portions of the associated lighting system. Enclosed are photographs taken by the City on March 6, 2007, which were also emailed to you that day. Section 4.2 of the agreement between Wendy Ross /Ross Sculpture Studio and the City states the following: Warranties of Quality and Condition. The Artist represents and warrants that: (a) the execution and fabrication of the Sculpture will be performed in a professional manner; (b) the Sculpture, as fabricated and installed will be free of defects material and workmanship, including any defects consisting of "inherent vice ", qualities which cause or accelerate deterioration of the Sculpture, or negligence, gross negligence in the material structure or installation methods of the Sculpture for a period of one year; and (c) maintenance of the Sculpture will not require procedures other than those described in the CD's, detailed plans, specifications, and drawings that were accepted and approved by the City. The Maintenance Plan submitted with your Construction Documents in December 2005 indicated that "the sculpture is in 316L stainless to resist rust or corrosion... Lower supports are coated to prevent any rust or corrosion with an expected life of 20 years." The artwork clearly does not meet the original expectations of the city. Therefore, the City is requesting, as per the agreement, the corrosion be addressed in a timely a manner. Within 30 .days of this notice, please submit to my attention a remediation plan to address the corrosion as well as an associated timeline.
