A Development Review Committee meeting will be held on Thursday, November 8, 2007 at 9:00 a.m.,
in the City Council Chambers to review the following development application:
Petition PUDA- 07 -10- 000012: A request from Mr. Michael Sanchez of Johnston Group Land
Development Consultants, Inc., on behalf of RPBG1, LLC, for approval of a Planned Unit Development
(PUD) amendment to permit the construction of an additional ten (10) parking spaces in various locations
on the site, the conversion of two spaces that are currently designated as loading spaces to parking
spaces, and the approval of two requested waivers to the required open space in order to mitigate the
request for excess parking spaces and reduction of parking space dimensions. The project is located on a
4.4 -acre site on the west side of Riverside Drive, approximately 300 feet south of Burns Road (10415
Riverside Drive).
The applicant will be in attendance at this meeting. Our office requests your participation in the review of
this project. Please review this request and attend the meeting if possible. Receiving your comments
prior to the meeting will allow staff to compile comments before the meeting to ensure the proper
direction, code regulations and information are being conveyed to the applicant.

to accessible entrances. Please provide information indicating the accessible
spaces are in compliance with FBC 11 -4.6.2 Location of accessible parking
spaces.

I have reviewed the above - referenced application. The narrative of the application references
the a proposed metes and bounds (M &B) subdivision of this site and the proposed Property
Owner Association (POA) Declaration of Covenants as other documents that will be consistent
once the PUD amendment is changed. Since City Council can approve the subdivision of this
site, I have also provided comments to the applicant for the subdivision and covenants. The
following comments will try to reflect the concerns with the existing conflicts between all three
proposed documents:
The applicant has indicated proposed lots on the site plan. The lots could be approved
administratively by M &B or by City Council. The applicant has not submitted an
application for an Administrative Approval to date. The proposed plat took off the lots
from the original submittal. I suggest the lot -lines be removed from the site plan until
approved, or include it with the PUD amendment. The plat needs to be approved prior
to the first Certificate of Occupancy. All of the issues about this application is quite
confusing. The applicant needs to make a decision on the subdivision, so it does not
delay the plat.
• The applicant states in their narrative that the owner of Building 2 is requesting 14
reserved parking spaces. This is inconsistent with the proposed M &B and site plan
because the applicant is currently requesting Building 2 to be subdivided into three lots
(Lots 1, 2A and 26). The potential for three property owners having reserved parking
within a proposed lot (2C), which could be sold to a fourth owner, is not a good idea,
especially when the loading zone is included in Lot 2C. The solution is to assign
parking per Section 78 -342 (f).
• I am not in support of creating a fee simple lot of record for parking, specifically for
Building 2 because it would ultimately conflict with the "possible future pedestrian
connection' shown on the approved site plan by fencing off the lot and not allowing
access. However, if the applicant used the assigned parking code suggested above,
the connection is still possible.
• The applicant states in their narrative that proposed Lot 2C is a "Parking Lot." However,
the proposed Declaration of Covenants (Page 12, Item 11) states Lot 2C may be used
for parking, until a building is constructed on Lot 2C. This is completely inconsistent
with the applicant's request for reserved parking and their need for additional parking. It
appears that the applicant's intent is to create a buildable lot not for reserved parking,
but for a holding area, and create additional parking for some future building square
footage. At this time, all reference to Lot 2C or creating a lot for reserved
parking /building should be removed from the proposed site plan, POA documents, M &B
subdivision, or plat.
The approved site plan was successfully designed within a planned development with waivers
acceptable to the City. At this time, I am not in support of the proposed mitigation, possible
waivers, or any reduction of open space.

We have the following comments:
• The applicant is requesting the removal of the parking lot adjacent to Bldg #2 from the ownership of
the PUD and addition of 10 parking spaces to replace those lost by the removal of the parking lot.
Certification Issues
1. The applicant shall label on the site plan and engineering plan the stacking distance, from the right of
way line of Riverside Drive to the first parking stall, for both the north and south drive entrance for
conformance with Section 78 -344 of the LDR and consistent with prior approved plans.
2. The applicant shall provide a symbol in the legend for the crosshatched parking stalls, to identify the
intent for conformance with Section 78 -46 of the LDR.

3. The applicant shall modify the tag line for the note "Non- Mountable Type `D' Curb Typ." North of
the new stall location in the middle parking bay north of Bldg #3 on the site plan (Sheet 2 of 6) for
conformance with Section 78 -46 of the LDR. Currently the line indicates curb is proposed across the
north end of the parking stall.
4. The applicant shall revise the detail for the handicap symbol (Sheet 3 of 6) to reflect that
thermoplastic material conforming to FDOT standard specifications shall be used, in lieu of the paint
shown, for conformance with City Standards as noted, "All pavement marking and striping,
excluding parking stalls, shall be installed with thermoplastic materials. Also, paver bricks of
appropriate color shall be used on paver brick areas, in lieu of paint or thermoplastic material".
5. The applicant shall add the waiver request to the Waiver Request Table (Sheet 1 of 6) for
conformance with Section 78 -46 of the LDR.
6. The applicant shall identify the area of modification of the detention area on the site plan and
engineering plan for conformance to Section 78 -46 of the LDR.
Waiver Request
1. The applicant is requesting a waiver from Section 78 -345 of the LDR regarding parking in excess of
the required parking. Please note we remain in support of the City's LDRs.
Non Certification Issues
The following non certification comments are from our prior review of the en2ineerin2 plans
received October 15, 2007. We have addressed the prior review comments based on the plans
received for this review. It is noted that the applicant did not provide a written response to the
following items.
Satisfied. The applicant proposes to modify the landscape islands within the area of parking stalls.
The applicant submitted an application for an administrative amendment for review by the City
Planning Department.
2. Not Satisfied. The applicant shall revise the engineering plan (Sheet C -1) for the proposed roof
drain pipe materials under pavement, which was not included on the approved set of construction
plans and is currently shown to be PVC. The applicant is advised that PVC is not an acceptable
material for roof drains under pavement. The applicant is advised that the use of RCP, DI, SDR -26
PVC, or C -900 PVC are considered acceptable materials for roof drains under pavement sections.
3. Not Satisfied. The applicant shall clarify the 10.8' dimension shown south of the parking stalls of
the west parking bay of building #2 (Sheet HC).

4. Not Satisfied. The applicant shall clarify the dimension of the parking area west of building #1,
which was shown as 43.0' from the edge of curb on the south stall to the turnout curb, with +/- 5'
from the turnout curb to the sidewalk on the approved plan (Sheet HC). The distance is shown as
47.2' for the parking stall area only and the turnout curb is adjacent to the sidewalk with no setback
on the proposed plan submitted for this review (Sheet HC).
5. Not Satisfied. The applicant shall clarify the 30' radius for the north curb (Sheet HC), within the
parking lot, which is not consistent with the approved plan, which shows a 20' radius.
6. Not Satisfied. In our review of the proposed plan for the modification, we noted that there are
numerous changes on the proposed plan that are not consistent with the approved plan. The applicant
shall request approval of these changes in writing, noting the proposed change to the approved plan
and justifying each item. The above represent some but not all of the apparent changes by the
applicant to the approved plan.
Additional Non Certification Issues based on materials received for this review.
7. The applicant notes, in the first paragraph on page 3 of their narrative, that the detention area has
been modified to permit the proposed design. The applicant further indicates that justification and
calculations have been provided with this submittal. However, no data or justification addressing the
modification was included in materials received for this review. The applicant shall provide
justification and calculations to support the reduction in detention size.
The following are the approved conditions of approval as adopted by Resolution 18, 2007 and are
numbered consistent with said document.
City Engineer
13. Satisfied. Prior to the issuance of the Certificate of Occupancy, a public access easement shall be
granted for all public sidewalks within the property boundary. (City Engineer)
14. Satisfied. Prior to construction plan approval and the issuance of the first land alteration permit, the
Applicant shall provide written authorization from the appropriate utility companies (easement
holders) allowing landscaping within their respective existing and/or proposed easements. (City
Engineer)
15. Satisfied. Prior to the issuance of the first land alteration permit, the Applicant shall provide a cost
estimate for public infrastructure, landscaping, and irrigation. The cost estimate shall be signed and
sealed by an engineer and landscape architect registered in the State of Florida. The cost estimate
shall be based on 110% of the total combined approved cost estimates and shall be posted with the
City prior to the issuance of the first building permit. (City Engineer)

16. Satisfied. Prior to construction plan approval and the issuance of the first land alteration permit, the
Applicant shall provide cost estimates in accordance with LDR Sections 78 -309 and 78 -461 and for
on -site project improvements, not including public infrastructure, or landscaping and irrigation costs
for review and approval by the City. The cost estimates shall be signed and sealed by an engineer
and landscape architect registered in the State of Florida and shall be posted with the City prior to
the issuance of the first land alteration permit. (City Engineer)
17. Ongoing. The Applicant shall comply with all Federal Environmental Protection Agency and State
of Florida Department of Environmental Protection permit requirements for construction activities.

18. Satisfied. Prior to construction plan approval, the Applicant shall schedule a prepermit meeting with
City staff. (City Engineer)
19. Ongoing. The Applicant shall furnish to the City copies of all complete permit applications,
certifications, and approvals for the project to and from all regulatory agencies. (City Engineer)
This is ongoing due to the need to receive project approval letters from regulatory agencies upon
completion of construction.
20. Ongoing. Prior to the issuance of the first land alteration permit, the Applicant shall submit signed,
sealed, and dated construction plans (paving, grading & drainage, and water & sewer) and all
pertinent calculations for review and comment. (City Engineer)
While this was satisfied, the applicant has submitted revised plans for consideration relative to the
current administrative amendment.
21. Ongoing. The construction, operation, and/or maintenance of any elements of the subject project
shall not have any negative impacts on the existing drainage of surrounding areas. If at any time
during the project development it is determined by the City that any of the surrounding areas are
experiencing negative drainage impacts caused by the project, it shall be the Applicant's
responsibility to cure said impacts in a period of time and a manner acceptable to the City prior to
additional construction activities. (City Engineer)
22. Ongoing. The Applicant shall provide all necessary construction zone signage and fencing as
required by the City Engineer. (City Engineer)
23. Ongoing. The build -out date for Gardens Commerce Center shall be December 31, 2008, unless
extended per City Code Section 78 -61. (City Engineer)
The applicant shall provide a written response to all comments, indicating acknowledgement of
each comment and how each comment has been addressed. It is suggested that the applicant clearly
identify all changes to the plans by either "clouding ", or highlighting, the location of all changes.
Compliance will expedite the subsequent review.

have reviewed the above - referenced application. The following comments reflect the concerns
with the requested amendments to the approved site plan and waiver requests:
• The applicant is increasing the number of parking spaces by 10 spaces, which pursuant
to Section 78- 345(d)(4)(a) requires an additional open pervious space at a ratio of 1.5
square feet for each additional square foot of paved parking and vehicular circulation
area. Pursuant to Section 78- 345(d)(4)(b), the additional open space must be utilized to
enhance the visual appearance of the improved site, the vehicular entries, and the
parking areas. The applicant is requesting a waiver from this Section of the Code;
however, staff is satisfied with the justification of the waiver. The applicant states that in
lieu of the required open space, improvements will be added off -site to a linear park.
Staff notes that the enhancement of already existing open space is not a direct
mitigation to the elimination of open space and suggests providing additional open
space as mitigation.
• The applicant has reduced the parking space dimensions in the approved site plan and
provided the required additional open space pursuant to Section 78- 344(1)(2). However,
the applicant is eliminating the required open space that was used as criteria for
reduction of parking space dimensions. The applicant must provide the required open
space in the vehicular entries or parking areas, or request a waiver from this section of
the code. Furthermore, the applicant must provide justification for this waiver.
• Staff is not in support of utilizing the lot as an additional loading zone. If the intent of
providing 14 parking space above code is to accommodate trucks to off -load or unload
material.
• Staff notes that the stacking distance for the southern entry is being reduced and is
incorrectly stated on the site plan. Staff notes that the reduction of stacking distance
(which will be less than 100 feet), is not permitted by code. Staff suggests removing the
parking spaces that reduce the stacking distance, or request a waiver Section 78-
344(h).
The approved site plan was successfully designed within a planned development with waivers
acceptable to the City. At this time, Planning and Zoning is not in support of the proposed
mitigation, possible waivers, or any reduction of open space.
