On February 18, 2010, Resolution 7, 2010 approved the appointment of the Supervisor of Elections as an additional member to the City's Canvassing Board. As a result, Susan Bucher has provided a certified copy of the results of the March 9, 2010, Municipal Election. STAFF RECOMMENDATION: Staff recommends approval of Resolution 11, 2010. RESOLUTION 11, 2010 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, FLORIDA, DECLARING THE RESULTS OF THE GENERAL ELECTION HELD ON MARCH 9,2010; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, on the 9t" day of March, 2010, the Election Clerks and Inspectors subscribed their oaths and performed their duties in said General Election in accordance with the law; and WHEREAS, the City's Canvassing Board certified the results of said General Election as follows: TOTAL REGISTERED VOTERS 35,091 TOTAL RECORDED AND ABSENTEE BALLOTS CAST FOR CITY COUNCIL, GROUP 2 (Three -Year Term) PAT HUGHEY 1,264 JOSEPH R. RUSSO 2,901 FOR CITY COUNCIL, GROUP 4 (Three -Year Term) DAVID LEVY 2,860 ROB PALLADINO 1,290 WHEREAS, the City's Canvassing Board has duly canvassed the returns of the described election and has certified the foregoing as true and correct tabulations of the total recorded and absentee votes cast, a copy of which certification is attached as Exhibit "A "; and WHEREAS, the City Council wishes to formally adopt and declare the voting results for the General Election; and WHEREAS, the City Council deems approval of this Resolution to be in the best interests of the health, safety, and welfare of the residents and citizens of the City of Palm Beach Gardens and the public at large. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, FLORIDA that: SECTION 1. The foregoing recitals are hereby affirmed and ratified. Resolution 11, 2010 SECTION 2. The DRI is approximately 458 acres, and is located on the parcel surrounded on the north by Atlantic Road, on the east by Prosperity Farms Road, on the west by Alternate Al A, and on the south by PGA Boulevard. The DRI was approved for a mixture of land uses consisting of retail, office, hotel, residential, open space, and community use. On September 3,1998, City Council adopted a master signage program for the MacArthur Center by Resolution 64, 1998. The master sign program contains seven (7) Main Entry signs, 13 Directional signs, 28 Building ID signs, Regulatory signs per code, and four (4) Temporary Site signs. The 28 Building ID signs are monument signs intended to "appear at the entry of each 'pod' of buildings" within the Regional Center (Staff Report for Resolution 64, 1998). Three (3) of the approved building ID signs are located within Gardens Business Center, also known as Parcel 27.05/.06 of the Regional Center DRI (see attached MacArthur Center Sign Location Plan). Two (2) of the signs are located on either side of Minsk Gardens Boulevard north of PGA Boulevard, and the third is located internal to Parcel 27.06. The subject petition (MISC- 09 -10- 000063) proposes to relocate one (1) of the approved Building ID (i.e. monument) signs for Gardens Business Center to the southwest corner of the BB &T Bank property, previously occupied by Wachovia Bank, located at Minsk Gardens Boulevard and PGA Boulevard (see SiQnage section). PROJECT DETAILS Buildinq Site The BB &T bank property is approximately 1. 15 acres in size and is located at the northeast corner of Minsk Gardens Boulevard and PGA Boulevard. The BUT building encompasses approximately 3,749 square feet of the site. The property is located within Parcel 27.05/.06 of the Regional Center DRI (see attached Location Map). Parking The subject petition will not affect the existing parking configuration. Site Access The site currently has access from Minsk Gardens Boulevard off of PGA Boulevard. No changes to the existing access are proposed with this petition. LandscaQinglBufferin_g The Applicant will provide the required foundation landscaping around the Building ID sign in accordance with the City's LDRs. Phasing This is not applicable to the subject petition. Drainage The subject petition will not affect the existing drainage. Si na e The Applicant, BB &T Bank, is seeking to relocate one (1) of the Building ID signs designated for the Gardens Business Center to the southwest corner of its property due to a lack of visibility from PGA Boulevard. The proposed monument sign incorporates a design consistent with existing monument signs within the Regional Center (see attached MacArthur Center Sign). The proposed sign is nine (9) feet tall, eight (8) feet in length, 44 inches wide, and maintains the required three (3) foot base. The monument sign will be painted beige and have a stucco finish. The palm tree logo will be satin gold vinyl, and all sign lettering is proposed to be burgundy. The sign contains the name of the parcel, Gardens Business Center, and panels for three (3) tenants to be listed below. Currently, BB &T is the only tenant shown on the monument sign (see attached Sign Exhibit). The proposed sign is in compliance with the City's regulations. Meeting Date: March 18, 2010 Resolution 10, 2010 Page 4 of 5 STAFF ANALYSIS Parcel 27.05/.06 was approved with three (3) Building ID signs. Two (2) of the monument signs are located on either side of Minsk Gardens Boulevard north of PGA Boulevard, and the third is located internal to Parcel 27.06 (see attached Parcel 27.05/.06 Site Plan). The subject monument sign is shown on the site plan at the northwest comer ofthe BB &T Bank parcel and is proposed to be relocated to the southwest corner of the property. This relocation would allow visibility from PGA Boulevard. The proposed monument sign is consistent with the existing signs within the Regional Center and has been approved by both the MacArthur and Gardens Business Center POAs. The subject request is motivated by existing issues with tenant visibility from PGA Boulevard. Currently, the tenants within the Gardens Business Center are experiencing a lack of exposure due to conflicts with required landscaping material, the relatively low building heights compared to others within the Regional Center, and the existing uses within the Center which rely heavily on drive -by traffic. All developments along PGA Boulevard are required to provide a 55 foot landscape buffer, which can create visibility constraints for buildings, particularly one (1) or two (2) story in height. The BB &T Bank has a building height of approximately 24 feet, is almost completely blocked by the landscaping material located in the buffer, and is further shielded by a landscape berm. Unlike other parcels within the Regional Center that front PGA Boulevard, Gardens Business Center contains mostly one (1) story buildings. Driving west on PGA Boulevard, the building heights begin to increase, ranging from 40 feet (Wachovia Bank) to 124 feet (Medical Mall). The taller buildings have the ability to locate signage above the second floor line, where permitted, which greatly increases the building's visibility and avoids landscape conflicts. Additionally, most of the tenants within the Gardens Business Center function as retail type uses; whereas, most other buildings along PGA Boulevard within the Regional Center contain office and medical uses (i.e. Wachovia, CH2M Hill, MacArthur Office Center, PBG Medical Pavilion, Grand Bank Center). The retail uses rely heavily on their signage exposure, while the office and medical uses are destination oriented and do not depend as much on drive by traffic. The intent of the City's sign code is to "...authorize the use of signs, provided they are compatible with their surroundings, appropriate to the activity that displays them, expressive of the identity of the individual activities and the community as a whole, and legible in the circumstances in which they are seen" (Section 78 -271). Staff has reviewed the proposed monument sign against these criteria and believes that relocating the Building ID sign to the BB &T property will greatly benefit both the tenants and users of the Gardens Business Center. The POA Board's approval is contingent and subject to the approval and/or agreement of the following conditions: 1. Approval of the design, location and operation of the proposed monument sign by the City of Palm Beach Gardens. 2. POA Board's approval is based on the condition that the words "Future Tenant" are not on the proposed monument sign and to be left blank for future use. 3. No additions and/or changes to the proposed monument sign will be made without the POA Board's prior approval. 4. BB &T shall maintain the proposed monument sign. Should said sign fall into a state of disrepair and BB &T fails to cure within seven days prior notice by the POA Board of needed repairs, then the POA Board retains the right, but not obligation, to make repairs at BB &T's expense. 5. The POA landscaping shall not be altered or removed without prior POA Board approval and at BB &T's expense. Accordingly, restoration of the FEC Ditch was included in the Capital Improvements Element of the City's Comprehensive Plan. With the exception of the FEC Ditch, all systems identified in the Stormwater Management Plan have been completed to date. Seacoast Utility Authority (SUA) has identified the FEC Ditch as a route for the installation of a raw water main from their well field at Richard Road to their water treatment plant on Hood Road. The limits of construction for the FEC Ditch are from just south of Burns Road, north to the C -17 Canal Right -of -Way (see attached map). During discussions with SUA, it was determined that it would be more beneficial to the City for the raw water main to be installed at the same time as the FEC Ditch restoration project. Conducting both projects together by utilizing SUA's contractor would be less disruptive to area residents while also realizing a significant cost savings to City taxpayers. In addition, several washouts along the Thompson River right -of -way were identified, which will be repaired by SUA per City Right -of -Way Permit No. BROW- 10 -02- 000004. Staff originally received a quote from an annual contractor for approximately $200,000 to restore the FEC Ditch. City staff requested that SUA amend their construction plans and specifications for the installation of the new raw water main to include the FEC Ditch restoration in order to obtain comparative pricing (see attached cross section plan sheet). SUA bid the project as amended and awarded a contract to Pipeline Utilities, Inc. The cost for the FEC Ditch restoration as bid by Pipeline Utilities, Inc. is $75,949.55. Approval of this Resolution and the Interlocal Agreement with SUA will allow SUA's contractor to perform the FEC Ditch restoration, which will save City taxpayers approximately $124,000. If approved, construction is tentatively scheduled for early April 2010. RECITALS: WHEREAS, Seacoast Utility Authority ( "SUA ") is an interlocal governmental entity created pursuant to Chapter 163, Florida Statutes, which provides water and sewer services to, among others, the residents of the City of Palm Beach Gardens, Florida; and WHEREAS, the City of Palm Beach Gardens ( "PBG ") is a Florida municipality; and WHEREAS, SUA is constructing various improvements to its water system consisting specifically of a 20" raw water main and a 20" finished water main which will connect SUA's Hood Road water treatment plant and its Richard Road water treatment plant (the "Project "); and WHEREAS, the pipelines which comprise the Project will transgress certain areas consisting of city -owned rights -of -way within the municipal boundaries of PBG, for which PBG is entitled to charge SUA a fee (the "Right -of -Way Fee "); and WHEREAS, SUA, in connection with the Project, will be performing certain work consisting of canal bank restoration and enhancement in the vicinity of the Project pipelines (the "Canal Bank Enhancements "); and WHEREAS, SUA and PBG wish to memorialize their agreement and understanding with regard to the Project, the Right -of -Way Fees, and the Canal Bank Enhancements. NOW, THEREFORE, in exchange for the mutual covenants and conditions hereinafter set forth, the parties do hereby agree as follows: 1. Recitals. The foregoing recitals are true and correct. 2. Right -of -Way Fees. SUA shall pay PBG all Right -of -Way Fees for the Project as they are due in accordance with PBG ordinances, policies, and procedures. 3. Canal Bank Enhancements. The scope of work for the Canal Bank Enhancements is: a. Cleaning and minor regrading of the drainage canal located adjacent to the FEC Railroad within the City of Palm Beach Gardens drainage easement between Burns Road and the C -17 Canal in accordance with engineering plans titled "20 -inch Raw Water Main from Richard Road WTP to Hood Road WTP" and as detailed on Sheets 38 and 39 dated July 3, 2009, for the Project reviewed and approved by the City of Palm Beach Gardens; and repair, reshape, and replace sod for up to six (6) existing washout areas contiguous to the 20- inch finished water main route along the east bank of the Thompson River. 4. Costs. SUA shall pay all costs associated with the Canal Bank Enhancements. Upon completion of the Canal Bank Enhancements, in a condition reasonably satisfactory to PBG, PBG shall reimburse SUA $75,949.55, which the parties agree is the reasonable value of the Canal Bank Enhancements, subject to reasonable increase in costs only for conditions not reasonably foreseeable by SUA or SUA's contractor. 5. Further, should other projects within this development be added by SUA or its agents and assigns, this Agreement shall be binding upon such future development. 8. Severability. If any part of this Agreement is contrary to, prohibited by, or deemed invalid under applicable law or regulation, such provision shall be inapplicable and deemed omitted to the extent so contrary, prohibited, or invalid, but the remainder hereof shall not be invalidated thereby and shall be given full force and effect so far as possible. 9. Governing Law and Venue. This Agreement and all transactions contemplated by this Agreement shall be governed by, and construed and enforced in accordance with, the laws of the State of Florida without regard to any contrary conflicts of law principle. Venue of all proceedings in connection herewith shall lie exclusively in Palm Beach County, 2 Florida, and each party hereby waives whatever its respective rights may have been in the selection of venue. 10. Headings. The headings contained in this Agreement are for convenience of reference only and shall not limit or otherwise affect in any way the meaning or interpretation of this Agreement. 11. Effective Date. The Effective Date of this Agreement shall be as of the date it has been executed by both the parties hereto and filed with the Clerk of the Court in accordance with Chapter 163, Florida Statutes. 12. Construction. The parties acknowledge that each has shared equally in the drafting and preparation of this Agreement, and accordingly, no Court or Administrative Hearing Officer construing this Agreement shall construe it more strictly against one party than the other, and every covenant, term, and provision of this Agreement shall be construed simply according to its fair meaning. 13. Attorneys' Fees. It is hereby understood and agreed that, in the event any lawsuit in the judicial system, federal or state, is brought to enforce compliance with this Agreement or interpret same, or if any administrative proceeding is brought for the same purposes, the non - prevailing party shall pay to the prevailing party reasonable attorneys' fees and costs, including appellate fees and costs. In July 2009, the City released nationally a "Call to Artist" Request for Proposal for two (2) artists to work with their own general contractor and engineer to design, fabricate, construct, and install outdoor bus shelters to be placed at up to four (4) separate locations along PGA Boulevard and up to four (4) separate locations along Military Trail within the City of Palm Beach Gardens. One (1) artist was to be selected for each roadway. On August 31, 2009, the City received a total of eleven (11) proposals for the artistic bus shelter project. Of the eleven (11) applications, ten (10) were accepted as complete. On September 15, 2009, the Selection Committee short- listed the proposals to five (5), per the Request for Proposal. The five (5) semi - finalists that were selected are: • Winslow Wedin; • Carlos Alves; • McMow Art and Glass, Inc.; • Mark Fuller (yellow proposal); and • Mark Fuller (green proposal). On January 19 and January 20, 2010, the semi - finalists presented more detailed proposal concepts to the Selection Committee. The Request for Proposal mandated that two (2) artists be chosen: one (1) for Military Trail and one (1) for PGA Boulevard. The Selection Committee was not satisfied with the design that was to be along Military Trail; therefore, on January 20, 2010, the Selection Committee recommended rejecting all proposals based on the criteria in the Request for Proposal. On February 16, 2010, the Art in Public Places Advisory Board discussed the semi - finalist presentations and recommended rejecting all proposals, thereby rejecting the Request for Proposal. The Art in Public Places Board liked Mark Fuller's green proposal for PGA Boulevard and wanted the same art concept along Military Trail but more downscaled. Therefore, the Art in Public Places Advisory Board made a second recommendation to City Council that the City enter into direct negotiations with artist Mark Fuller for both the bus shelters along PGA Boulevard as well as along Military Trail. At this time, it is necessary for City Council to provide direction for this project to continue. It is the basis of my concept design for the bus shelters you are planning along two of your major corridors (PGA Boulevard and Military Trail). This inspiration and my artistic style are the perfect complement to your desire to bring art to a functional part of your community. Since the series of bus shelters are for Palm Beach Gardens, my inspirations lean towards the idea relating to sitting in a garden. My benches feel organic —forms appearing to be growing out of the earth cast on concrete colored pods. Some of the seating areas will incorporate mosaic tiles, glass and recycled objects imbedded onto /into the durable weather - resistant, low maintenance concrete structures. The bevels will serve a dual purpose of being functional and aesthetic works of art. I envision the canopy to appear to be growing out of the seating structures. These abstract leaf -type shapes will be created using metal steel or aluminum with either glass panels or metal mesh welded onto the leaf -style shapes for shade. I designed these shelters for their aesthetics as well as functionality, providing both shelter from the elements while allowing air to flow through. The four designs are individual in their concept yet have a cohesive quality, so pedestrians can recognize their intended purpose. We intend to use recycled aluminum and glass and other materials. Our artwork has proved to be virtually maintenance free and able to resist the harsh Florida elements. The reinforced concrete bases - benches will be cast on site and some embellished with ceramic and concrete stain.. Pre -soak panels with a light water spray to loosen and remove incidental surface debris. It is recommended that the water pressure for cleaning Koda XT panels be 1,500 psi or less. 3form Koda XT is a tough material but can be dam- aged if high pressure Is concentrated in a single position too long. Use a gradual sweeping motion over the application. Never concentrate water spray in a single position. Pressure nozzle should never be positioned closer than 8" (203 mm) from the panel surtace. Test a portion of the sheet first before spraying. If test piece shows any sign of material fatigue, abrasion or delamination - discontinue pressure washing and proceed with manual cleaning instructions as described above. Team McMow Written Proposal Materials List Itemized Budget Team McMow PBG Art in Public Places Written proposal Team McMow became aware of this AIPP project while reading a newspaper article just days prior to the dead line for the proposal to be submitted. We believed with the artistic ability of the team already assembled and the success we have had working together on various projects we easily could create some stimulating concepts. Our relationship with Fiore Skylight Company from New Jersey was an added element that we believe gives us a more desirable finished product. Like many things that appear simple this project grew several sets of legs and morphed almost weekly and some times, day to day. We did submit a proposal to the AIPP for a concept using a re- design of a transit shelter frame that we added an artistic stained glass element to. We worked with Fiore to be sure we would be compliant with County, City and ADA codes. We were ecstatic to be notified that we were on the short list and were anxious to move up to the next level in the process. We received the audio disc from the committee and sent an email copy to the engineer and to Fiore's CEO, Richard Materio. We listened carefully to the comments given by the members about each proposal. Although we could not see the artistic designs submitted by each artist the committee was vocal about what they felt they wanted and the importance of certain elements of the art. The critique of the proposal submitted by Team McMow made a lot of sense to us and the suggestions really changed our scope. Still we struggled to create a code compliant artistic piece that would speak to the people of Palm Beach Gardens as well as to visitors and passing cars. We worked with a young architect and gave direction for a visual 3 -D model to be constructed. The model brought our visual concept to life. We could now discuss the construction challenges with the engineer. Quickly we learned that we had a cool design but were disappointed to find that it didn't readily lend itself to fabrication. Not only did we have to make design changes but we had to explore other materials for the "artistic" element we offered. We learned from the audio that the committee was concerned about the use of stained glass the ability for it to withstand not only impressive south Florida weather but vandalism and long term maintenance had to be addressed. A new product was brought to our attention by the model builder made by a company called 3 -Form. The material known as Koda XT is made for all weather external use. It is already being used in very harsh climates and the beauty for us is the ability to imbed our art into the material. It would not break, crack or fade and it is resistant to most possible acts of vandalism. Koda XT is the best way to create an artistic environment of stained glass without using glass at all. The Team finally found the product that would give us the look we wanted without compromise. Our goals never changed for the transit rider. We wanted them to feel they are invited into a natural environment safe and comfortable. The back panels of the shelter are created with Koda XT that Tricia Besley used individual pieces of stained glass photographing it on a light table. She designed the tree trunk and methodically placed the images into the Koda XT inch by inch. She did the same with the flowering canopies. This was a tedious approach but as you can see it turned out beautifully. We used this as an opportunity to include a learning experience for the public. Each canopy in the "walk in the Park" series is an indigenous flowering Florida tree. As an educational component to the project the name of the species of tree will be written onto a plaque embedded into the side wall of the shelter. In addition to the name of the tree information about each tree will also be embedded for the riders to read while they experience sitting under the full flowering canopy, and they never need watering. The exact bench material has not been decided yet but the two options we are considering are both 100% recycled material. Our project will be PE stamped by a Florida licensed engineer that has worked with us since the beginning of this project. He has experience working with installations of custom transit shelters for other Cities and has created them with Fiore Skylights. It is important to us that we have an engineer that understands and is willing to work with us to create an artistic approach with a sound structure. The ceiling panels, walls, and benches are created from recycled material. The power source for the lighting is located in the back ceiling panel. It is solar - photovoltaic system powered by the sun. Which we all agree we do have plenty of and when we don't the storage cells offer additional lighting options. All of the aluminum being used on the project will be powder coated with a custom color to represent as best possible bark of a tree trunk. All of the materials we propose are fabricated for long term usability and are resistant to both graffiti and damage done by vandalism. The bench is comfortable to sit but discourages lying down with an arm rest between each of the 3 seats. What we are most proud of is the fact that we able to offer you an artistic option for a transit shelter that does not compromise our artistic vision, building codes, construction or maintenance. It is a shelter that invites the transit rider into a natural experience with an almost intimate close view of nature. Team McMow has designed a transit shelter for the pleasure of fast moving traffic as well as treating the weary transit user to a fresh relaxing moment. Finally, after listening to the audio of the committee and realize that we have worked on several successful projects with Burckhardt Construction specifically with Vince Burckhardt. We met with Mr. Vince Burckhardt and he has agreed to be on Team McMow as our contractor. The proposal submitted by Mr. Burckhardt is completely thorough and includes all site work and has addressed the possible need of rails for ADA compliance on the 3 PGA sites. Our team has enjoyed exploring other options and mediums during this project. We feel we have grown from the challenge and have been rewarded by the knowledge we have gained about material, products and people. We applaud the Palm Beach Gardens Art in Public Places vision to include functional Art for use by mass transit riders. WE can only hope that this is as successful in real use as it feels to us it will be and other Cities, towns and states will feel compelled to off the same options to their transit systems. Project budget including artist fees (see also 2 -q and 2 -r): The construction budget is $45,000 including a 10% contingency for each shelter and the Artists fee is $10,000 each inclusive, for a total of $55,000 each of 4 shelters. g. All materials: Materials will be unique for each of the four designs., and will be a combination of steel frame, reinforced cement plaster with a ceramic tile coating and impact resistant glass all attached to a brick, tile or similar on a 4" concrete base. h. Fabrication (see also 2 -c): All fabrication shall be done at the contractor's facility with the exception of site specific finishes and attachments. j. Transportation (of the shelter facility to site) The pre fabricated shelter assemblies will be transported to the site by the contractor utilizing his equipment and unloaded at the secured site by his crew, ready for installation by his crew. k. On site project management: The contractor and his crew and the Artist will work together at the pre - fabrication site on a daily basis as required. The Artist and contractor will supervise site installation per construction documents and code. The engineer will assist as deemed necessary. The engineer has provided technical information incorporated into the construction documents. The work may be video or photographically documented. I. Site modification required: The site will be prepared for installation of the shelter and grades adjusted for proper drainage, bus loading requirements verified and concrete footing and foundation work completed. m. Installation Equipment [which will be required]: The Contractor shall provide all installation equipment, materials and traffic safety provisions (cones, barricades etc.) coordinating with local requirements. n. Engineering Fees: All engineering fees are included in the $55 000 budget p Insurance fees ( ?) The contractor will have proper insurance as required and is included in the $45,000 budget. q. Optimal protection from the elements, while providing an increase (from traditional shelter designs) for breeze access, along with logical choices for ingress and egress, ease of maintenance, and dynamic visual charecteristics enhance the functionality of these proposed designs. With 24" roof overhangs, these designs provide more protection from the rain, more shade, and allows more breeze to enter the structure in any wind direction than traditional shelter designs, and offer the pedestrian a safe refuge from the elements 100% of the time. Once all items are cut, the parts are assembled to form a component with welding, application of any scheduled adhesives and various required stainless steel mechanical fasteners. All finish surfaces are sanded, solvent cleaned prior to the application of the final surface finish. Some parts may be finished prior to their being assembled in their relative component, while some components will be finished as a completed unit. The various components (corner units, roof structure, etc...) are designed to be preassembled in -shop, and assembled in 'kit' form on site. Unfortunately I cannot be present this evening because I am out of town attending a family gathering scheduled a year ago. I am aware that the reorganization of the council is scheduled to occur this evening and though I will not be able to vote, I wanted you to know my thoughts on who I feel should be Mayor this coming year. It has been my privilege to serve on this council for nearly eighteen years and in that time I have had both the honor and privilege of serving alongside my friend and colleague Joe Russo. He has served this city with distinction for over twenty years as Councilman, Vice Mayor and Mayor. I too have had the honor to serve this city as well as its' Vice Mayor and Mayor and while I have every intention to continue my work on this council I feel that it is time for some of our newer members to step up and assume a leadership role. David Levy has served on this council for the past six years and has done an outstanding job as councilman and last year as Vice Mayor. He has, in my estimation, worked very hard and grown every year in the job. David's passion for the city is evident in every task he takes on and consequently I believe he is ready to assume even more responsibility. If 1 were there with you this evening I would be asking to be recognized to place David Levy's name in nomination for Mayor. I also feel that Councilman Bert Premerosso should be considered for Vice Mayor. The nation is struggling to address an obesity epidemic and some schools are cutting resources for physical education programs although physical education advocates say regular physical activity can boost academic achievement; and WHEREAS, the community must take whatever action it reasonably can to facilitate efforts to reduce the epidemic numbers of overweight and obese children and adolescents and the attendant health and fitness strategies for overweight and obese children and adolescents to include awareness of proper nutrition, diet and exercise. WHEREAS, to promote preventative health and fitness strategies, including awareness of the Egoscue Foundation's Patch Project Initiative which aims to reduce childhood obesity statistics by donating the Patch Obstacle Course and Patch Fitness Curriculum to schools and community centers in Palm Beach Gardens and nationally.
