WHEREAS, the City Engineer has reviewed the Christ Fellowship Church North Campus replat; and WHEREAS, the City Engineer has determined that the proposed plat meets all the technical requirements of the City’s Land Development Regulations and Chapter 177, Florida Statutes, and recommends approval of the plat; and WHEREAS, the plat is consistent with the City’s Comprehensive Plan and LDRs; and WHEREAS, the City Council has deemed approval of this Resolution to be in the best interest of the citizens and residents of the City of Palm Beach Gardens. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, FLORIDA that: SECTION 1. The foregoing recitals are hereby affirmed and ratified. SECTION 2. Funding for the improvements has been budgeted within the Road Impact Fund. During the permitting process, Palm Beach County requested that roadway alterations be performed at the Gardens Parkway/Fairchild Gardens Drive and Hiatt Drive/Northlake Boulevard intersections to allow for the signal installation. This resolution includes the additional surveying and engineering services to complete the additional design requested by the County as well as bidding and construction oversight through completion of the projects. These developments are Gardens Pointe via Resolution 76, 2007 and Downtown at the Gardens via Resolution 66, 2007. Once the improvements are constructed and certified, the total cost will be determined and the pro-rata share shall be determined by the City Engineer. Those funds shall be collected by the City and returned to the Road Impact Fund along with any unspent appropriations. Gardens Parkwav/Fairchild Gardens Drive: (Funded via FY 2007/2008 Budget Book, page 234) Per a discussion between the previous City Engineer and City Council, the Road Impact Fund will pay for the surveying, design, permitting and construction of this signalized intersection. Future developments within the Regional Center will be required to pay for these services and replenish the Road Impact Fund. (Funded Hiatt Drive/Northlake Boulevard: (Funded via Ordinance 21, 2008) $451,000.00 has been collected by the City from the Montecito (fka/Gables) development via Resolution 94, 2005 to pay for these improvements. WHEREAS, the City wishes to complete three signalized intersection projects located at Kyoto Gardens Drive and Lake Victoria Gardens Drive, Gardens Parkway and Fairchild Gardens Drive, and Hiatt Drive and Northlake Boulevard; and WHEREAS, in order to provide for the design and construction of each project, professional surveying, design, permitting, and construction services are needed; and WHEREAS, the City Council of the City of Palm Beach Gardens has a continuing contract for engineering services with the engineering firm of Boyle Engineering Corporation; and WHEREAS, the City Staff has previously negotiated Work Authorizations with Boyle Engineering Corporation, attached hereto as Exhibit “A”, to perform certain services in connection with the above-mentioned projects; and WHEREAS, the City has received change orders from Boyle Engineering Corporation for additional services that are needed to complete the Projects; and WHEREAS, the City Council of the City of Palm Beach Gardens deems it to be in the best interests of the citizens and residents of the City of Palm Beach Gardens to issue such additional Work Authorizations to Boyle Engineering Corporation for the services provided for in their proposals, attached hereto as Exhibit “B”. Approved : Palm Beach Gardens FirelRescue (Hereinafter: CLIENT) &/ bate Name Date Vice President Title: Exhibit A Scope of Services Kyoto Gardens and Lake Victoria intersection Improvements Downtown at the Gardens, Palm Beach Gardens, Florida The following surveying and engineering services will be performed to add a signal to the intersection identified above ONLY, and does not include any improvements to the intersection of Lake Victoria Gardens Avenue and PGA Boulevard. This project is located immediately south of Downtown at the Gardens in Palm Beach Gardens, Palm Beach County, Florida. Our proposed Scope of Services is based on recent discussions with Dan Clark and as well as a joint site visit to identify the project on February 20, 2007. Our proposed services include assistance, consultation, and the preparation of site construction plans for the project, as well as attendance at meetings with the design team and regulatory personnel during the permitting process. Please note that the mmbering system for the work phases presented below refers to LBFH, Inc.’s StalJdard project accounting codes. SURVEYING Phase 12 - Route Survey: LBFH Inc. will conduct a Topographic route survey and prepare an engineering base map suitable for the design and construction of roadway improvements. The survey will be performed in general accordance with the Minimum Technical Standards Chapter 61917, Florida Administrative Codes and will be conducted over the following route: 300 feet north, south, east, and west from the intersection of Lake Victoria Gardens Avenue and Kyoto Gardens Drive. Note: The total route sw’vey length is approxiinate/y I, 200 Linear Feet. The route survey will include the following scope of services: LBFH Inc. shall establish horizontal control to establish a survey baseline for the above referenced project limits. The horizontal control shall be established in the Florida State Plane Coordinate System, East Zone, 198311990 adjustment. Control points will have a maximum spacing of 600 linear feet. LBFH Inc. shall establish elevations on the horizontal control points with a closed conventional bench loop establishing four benchmarks for the project. The elevation datum shall be established in the National Geodetic Vertical Datum of 1929 (NGVD 29). LBFH Inc. will collect cross-sections of the existing roadways at 100-foot intervals picking up all significant changes in elevation. LBFH Inc. will locate lane and traffic stripping. LBFH Inc. shall locate all above ground improvements and visible utilities along the route within the road right- of-ways. Storm or sanitary structures and subsurface pipes will be located along the route or crossing the route, together with invert elevations and pipe sizes (where possible, see special provisions). LBFH Inc. shall establish the road right-of-way lines to approximately 0.5’ of accuracy as based on recorded deeds, plats, and found local survey control. LBFH Inc will prepare drawings at a 1”=20’ plan view scale. Surveying Deliverables LBFH Inc. shall provide a digital copy of the base map for engineering design. LBFH Inc. shall deliver Six (6) signed and sealed copies of the topographic survey. Surveying schedule LBFH will commence Two (2) weeks from notice to proceed, and will be completed in a total of Six (6) weeks. Surveying Special Provisions: 1. The schedule referenced above is dependent upon any periods of extended inclement weather that may inhibit field operations. The client will be notified if this condition exists. 2. Location of any jurisdictional line(s) is not included in this estimate. 3. LBFH Inc. shall not enter into any underground sanitary or storm structures. Should the subsurface pipe inverts be obstructed, covered by water, or recessed from the structure walls, only a centerline bottom of structure shall be obtained. 4. This scope does not include creating a digital model terrain surface model of the site, or preparing cross- sections in profile view. Lump Sum Fee: $11,500 ENGINEERING Phase 14: Geotechnical Information: LBFH, Inc. will coordinate with Ardaman & Associates to get a signed and sealed letter describing the soil conditions at the signal mast arm foundations. The letter will be sufficient for design of the mast arm foundations and roadway improvements. Lump Sum Fee: $1,500 Phase 22: Prelirninarv Enqineering: LBFH, Inc. will coordinate with and assist the CITY in the review of the site conditions and prepare preliminary intersection improvement plans utilizing public available aerial imagery. These plans will include the basic construction elements (i.e. additional pavement, signals, signs and pavement markings). The plans will be used for review by the CITY, SFWMD, NPBC, FDOT and Palm Beach County as may be required, prior to final construction plans. Lump Sum Fee: $4,500 Phase 27: Utility Coordination: LBFH Inc. will coordinate with all existing facility owners within the project limits identified in the previously-mentioned survey phase. LBFH will request that these utility companies "redline" the layout with pertinent facilities (existing and proposed if applicable) within the general limits of construction. Upon receipt of the "redlined" plans, LBFH will incorporate the information onto the construction plans and will make provisions in the design to accommodate or minimize potential conflicts. Time & Expense Estimate: $1,000 Phase 29: Sirrnal Plans: LBFH Inc. will prepare signalization design and specifications for the intersection improvements. The construction plans will be prepared from the engineering base maps provided in the previously-mentioned survey phase and the preliminary plans, and will incorporate both the comments from the CLIENT and Palm Beach County, and the existing utility information obtained through our coordination phase. LBFH Inc. will also obtain soil borings in the vicinity of each signal pole. The plans will also include any changes required during the permitting process. The Code of Ordinances Section 38-1 provides definitions and conditions that establish a framework for reimbursement for responses to “hazardous” incidents within the City. Other cost recovery fees include rates for fire equipment and personnel for services provided during “special events” such as the Honda Classic and other similar events. Additionally, the City, through a contractual third party, bills patients for reimbursement of emergency medical supplies and mileage, which vary based on the level of medical service provided. BACKGROUND The current cost recovery idea was formed several years ago after conversations with numerous fire rescue agencies concerning their cost recovery programs. This concept provides a fee schedule for City responses to such things as motor vehicles crashes, vehicle fires and incidents that arise out of the actions and/or inactions of others, which require mitigation by City personnel and/or equipment. I have been advised by several insurance agents the insurance industry does in fact take these issues into account and they are covered by most policies under comprehensive coverage. The emergency responses are categorized into four levels, which are based on the complexity of services provided at the scene of the incident. The response information would then be forwarded to a third party service such as ADPI, our current EMS billing contractor and then only insurance providers would be billed for the service rendered. In researching the feasibility of implementing cost recovery as it relates to public safety, I have found several agencies within the state that are currently billing insurance providers for cost recovery. Interestingly these agencies are only recovering costs for responses to motor vehicle crashes and have not ventured into billing insurance providers for fires. However, my research did uncover the fact that cost recovery, while new to Florida, is not a new concept nationally. I have found that cost recovery is very prevalent in the Midwest particularly Ohio, Indiana, Kentucky and Michigan and is now spreading to Massachusetts and Pennsylvania. Additionally, my research has revealed that the fire service is embracing this concept and numerous agencies statewide are also now considering and/or preparing cost recovery ordinances. 2 Data analysis of Fire Rescue responses revealed that for calendar year 2007 we responded to 937 motor vehicle crashes. Based on the proposed fee schedule: if cost recovery had been in place, it would have generated an estimated $500,000 in new revenue. Attached is a draft ordinance, which has been prepared in coordination with the City Attorney. The proposed ordinance creates a new section 38-2, Recovery of City Response Costs and provides authority for all departments in the City that incur costs and provide services above and beyond the normal scope of daily operations the ability to seek reimbursement for costs associated with the response. Also attached is a copy of the current Master Fee Schedule relating to Cost Recovery. Response actions also include the provision of security fencing or other means to limit access, the provision of alternative water supplies, temporary evacuation of threatened individuals, and restoration of the site to pre-incident conditions. Response Costs shall mean and include, but is not limited to, those expenses that are extraordinary in nature and incurred in undertaking response actions, necessitated by the actions or inactions of others which require the assistance of City personnel and services to prevent, minimize, or mitigate the impact of an incident. Zoning and Appeals Board: Residency and at least one member fiom two specific types of professional disciplines, related to (1) architecture or planning, and (2) engineering, law, real estate, land surveying or the environment, and (3) resident at large. Currently, City Staff is drafting a text amendment to add the responsibilities to hear appeals of decisions and interpretations of the Building Official and consider variances of the technical codes to the duties and responsibilities of the Planning, Zoning, and Appeals Board. The Planning, Zoning, and Appeals Board will require additional professional disciplines in order to meet the requirements of membership for the proposed Construction Board of Adjustments and Appeals. The existing membership lacks a professional engineer, so it is recommended by staff that an Engineer to be placed on the Board. The Code provides for a total of five trustees, three of whom shall be legal residents of the City, one of whom shall be a member of the system, and a fifth trustee chosen by a majority of the previous four trustees. The three legal residents and one member of the system shall be appointed by the Council. The fifth trustee’s name shall be submitted to the Council. As a ministerial duty, the Council shall appoint such person as the fifth trustee. Currently, the Board consists of two residents, two employees, and a fifth trustee. One resident trustee (Kenneth Steele) and the fifth trustee (Allan Owens) terms have expired. Both of these members have expressed a desire to be reappointed to their trustee positions. In addition, in order to comply with the residency requirements of Section 3-128, staff is recommending one of the current employees (Jamie Smith), who is also a resident, be reappointed for the remainder of her term as a resident trustee. This action will bring the composition of the Board into alignment with Section 3-128 of the Code of Ordinances, reg a rdi ng residency requirements.
