Approximately five acres, or 57% of the site is within the City of Palm Beach Gardens, and approximately 3.71 acres, or 43% of the site, is within the Town of Lake Park. In August 2002, the City and the Town signed an interlocal joint development agreement to provide for a coordinated development review process and centralized permitting and code enforcement to develop the subject property in accordance with the land development regulations of both municipalities. As such, each municipality will review the application under its respective land development regulations as well as the Northlake Boulevard Overlay Zoning District (NBOZ). Each jurisdiction, however, shall take separate action regarding the development at jointly held meetings. Should a conflict arise between regulations of the two jurisdictions, the regulations of the NBOZ will apply. Both the Planning and Zoning Commissions of the Town and the City will jointly review the project, and both governing bodies will also jointly review and hold public hearings, but take final actions separately. The City of Palm Beach Gardens is responsible for leading the processing of the development application of the subject site in accordance with the interlocal agreement. LAND USE AND ZONING The site is currently zoned Research and Light Industrial Park (MI), has a future land-use designation of Commercial (C), and is designated Commercial (C) on the Vision Plan. The is within the "Central District" of the Northlake Boulevard Overlay Zoning District. The applicant is proposing to rezone the site to Planned Unit Development (PUD) Overlay with underlying zoning of General Commercial (CG-1). The zoning under the Town of Lake Park is currently Traditional Neighborhood District (TND), with a future land-use designation of Mixed Use Commercial/Light Industrial. The applicant is proposing to rezone the parcel to Commercial-1 (C-1). CONSISTENCY WITH THE NORTHLAKE BLVD. OVERLAY ZONING DISTRICT The proposed development is not consistent with the overall intent of the NBOZ. The following reflects the specific inconsistencies between the proposed project and the NBOZ: Section 78-225. General Provisions. Purpose and Intent. The purpose and intent of the Northlake Boulevard Overlay Zoning District (NBOZ) is to implement objectives of the Northlake Boulevard Corridor Conceptual Streetscape Plan adopted by the Northlake Boulevard Corridor Task Force. These objectives include: Date Prepared: September 18, 2003 Meeting Date: October 16, 2003 Ordinance 35, 2003 & Resolution 176, 2003 (No. 1 through 4 omitted for brevity) 5)Development of a unifying community design and development theme to work in conjunction with the proposed corridor streetscaping. 7) Creation of the opportunity for new development to respect existing scale, style, and character, while preserving the positive aspects of the corridor. The proposed development is not consistent with the above listed objectives. The buildings do not create a corridor streetscape, although there is opportunity to do so. In contrast, the buildings have been set back from the street to accommodate vehicle parking. The proposed location of the buildings within the project will not be unified with the parcels immediately across the street on the north side of Northlake Boulevard, which has been developed with the buildings positioned closer to the street. Section 78-227 of the LDRs, Architectural Elements. Design Treatments & Unity of Character. (1)Building design. Structures shall be required to provide three of the following minimum design treatments: a. The main facade shall incorporate architectural elements, which create a better human scale, such as: 1. Canopies or porticos integrated with the building’s massing and style; 2. Overhangs proportional in size to the mass of the building; and 3. Arcades. b. Pedestrian amenities such as benches, sculptures, tables with umbrellas, and trash receptacles; c. Peaked roofs with minimum 12 inch overhangs; d. Architectural treatment on all four facades/elevations. 1. Articulation of individual storefronts or facades greater than 50 feet wide; 2.Window and door openings expressed as individual units as opposed to window wall strips; 3.Uniform design; and 4.Any other treatment determined by the jurisdiction to meet the intent of this section. (2)Unity of character. Buildings or structures, which are part of an existing or future complex, shall have unity of character and design. Date Prepared: September 18, 2003 Meeting Date: October 16, 2003 Ordinance 35, 2003 & Resolution 176, 2003 The proposed project does not meet the listed NBOZ requirements, which include ornamental and structural architectural details, four-sided architecture, and unity of character. The design may benefit from better organization by creating more "people places ", and more engagement between the CVS pharmacy building and restaurant~retail building and Northlake Boulevard. Furthermore, the design of the CVS pharmacy building and restaurant~retail design building do not reflect four-sided architecture into their design. CONSISTENCY WITH THE COMPREHENSIVE PLAN The proposed development is not consistent with the overall intent of the goals, objectives and policies of the City’s Comprehensive Plan. The following goals, objectives, and policies indicate the specific inconsistency between the Comprehensive Plan and the proposed project: Policy 1.1.1.5.: The City shall maintain land development regulations which provide for a Planned Unit Development (PUD) technique which shall implement the following concepts: ao The intent of a Planned Unit Development (PUD) is to ensure the desired character of the community is furthered or enhances on development sites within the City, particularly on sites where the development is proposed is rather intense. Master plans for Planned Unit Developments include, at a minimum, site plans showing all local roads and landscaping plans. Supporting documentation is also to be included which indicates, at a minimum, development phasing and a list of permitted uses for commercial and industrial PUDs. (Emphasis Supplied). The proposed PUD is not consistent with Policy 1.1.1.5. The intent of the Policy is to promote a desired "character of the communi_ty that.., enhances...development sites within the City..." The principal elements of desired community character are found in the following: ¯ Strong consistent design themes. ¯ Peopleplaces. ¯ Focal Points. ¯Pedestrian linkages within the site. ¯Promotion of pedestrian activity byplacing buildings closer to the street. The proposed development can be improved if these elements are incorporated into the site plan, which would create a relationship between the amenities and the buildings. Although a number of landscaped trellises have been included on the site plan, the placement of these features are random, and have not been placed in locations on the site where people will interact or gather. There is more opportunity for the CVS pharmacy to be closer to the street. The restaurant~retail building previously included four rows of parking on the north side of the building, but was modified to include only three rows with additional fagade treatments including a colonnade, 4 Date Prepared: September 18, 2003 Meeting Date: October 16, 2003 Ordinance 35, 2003 & Resolution 176, 2003 after the applicant removed one row of parking spaces immediately behind the restaurant~retail building, and relocated the spaces to the south side. Staff has consistently encouraged the applicant to modify the CVS pharmacy to be consistent this modification; however, the applicant has not made an attempt to adjust the location of the pharmacy building. The LA Fitness building has established the overall theme for the PUD, but the two remaining buildings have not consistently followed the design and architecture of the principal building on site. Both the CVS pharmacy building and the restaurant~retail building do not reflect four-sided architecture. The south wall of the restaurant~retail building is especially important because it is faces the central place of gathering place outside of the entrance of the LA Fitness building, and the proposed landscaping will not completely shield it from this gathering area. Furthermore, because so few vacant and undeveloped sites exist along Northlake Boulevard, it is imperative to establish a desired standard of site design, landscaping, and architectural elements for the parcels that have the opportunity to incorporate these elements at the design level. The proposed PUD does not meet the goals, objectives and standards of the City’s Comprehensive Plan. CONCURRENCY The applicant has received traffic concurrency from Palm Beach County and the City; the build- out date for the project is December 31, 2004. The applicant has reserved water and sewer capacity and waste management service for the site. PROJECT DETAILS Building Site The 8.80-acre site consists of a two-story fitness center totaling 41,000 square feet, a 12,389 square-foot pharmacy with a two-lane drive-through facility, and a 12,000 square-foot multi- tenant restaurant/retail building including a 828 square-foot outdoor seating area. LA Fitness, the proposed tenant for the fitness center, is the principal structure on the site. The 48’- high building will be located at the southwest comer of the site. CVS pharmacy, the proposed tenant for the pharmacy building, is located on the eastern side of the site. The applicant is proposing a two-lane drive-through facility on the western side of the pharmacy building, and a loading area on the south side. The multi-tenant restaurant/retail building is located west of the 24’ main access ch-iveway connecting to Northlake Boulevard. The applicant is proposing an outdoor seating area on the northern side of the restaurant/retail building, parallel to the access driveway. Northlake Square West is the second project in the City of Palm Beach Gardens to be reviewed under the NBOZ. 5 Date Prepared: September 18, 2003 Meeting Date: October 16, 2003 Ordinance 35, 2003 & Resolution 176, 2003 Site Access Vehicular access to the site is available by a two-way driveway off of Northlake Boulevard, and a two-way driveway off of Congress Avenue. A right-turn lane will be provided before each access point for both Northlake Boulevard and Congress Avenue. A cross-access driveway is also provided from the southern adjacent property to the subject site. A curb cut, aligned with the driveway, is proposed along Congress Avenue to provide access into both the Lowe’s site (Lake Park) and the subject site from traffic heading north on Congress Avenue. Signage The applicant is requesting a total of four sign waivers for the project: A waiver from Section 78-284 of the City’s LDRs to allow for an additional wall sign for all three buildings; waiver from Section 78-284 of the City’s LDRs to allow for an inconsistent color and design for the proposed signs on all three buildings; a waiver from Article V, Table 5-6 of the NBOZ and the City’s LDRs to allow for a monument sign to be placed closer than 50’ from a non right-of-way property line; and a waiver from the NBOZ Article V, Table 5-6, to allow for more than one message to be located on each monument sign. In this case for example, although the applicant is permitted three tenant names on a monument under the City’s regular sign code, under the NBOZ only one sign is permitted. Therefore, under the more restrictive requirement, the applicant is limited to one monument name within a monument sign. Landscaping~Buffering The applicant is providing 16,482 landscaping points when 10,913 points are required, and is providing a 15’ landscape buffer along Northlake Boulevard and Congress Avenue. In addition, foundation landscaping will be provided around all buildings. If the project is approved, the applicant shall be responsible for the installation of landscaping, irrigation, and maintenance of the roadway shoulders and medians on Congress Avenue within six months of the development order approval. The applicant has provided a meandering sidewalk and road shoulder landscape plan for Northlake Boulevard. The applicant, however, has not provided silver buttonwood trees along the road shoulder of Northlake Boulevard to be consistent with the approved Micheal Redd Streetscape Plan. The applicant is required to provide a minimum of 0.88 acres of open space within the project. However, 61%, or approximately 0.97 acres, of the proposed open space for the entire project is located within the dry detention area in the southwest comer of the site, behind the LA Fitness building. Consequently, very little open space has been provided as usable and visible open space within the project. Phasing The proposed project will be built in one phase, according to the applicant. Date Prepared: September 18, 2003 Meeting Date: October 16, 2003 Ordinance 35, 2003 & Resolution 176, 2003 Drainage The surface water management system will be under the jurisdiction of the South Florida Water Management District (SFWMD). An on-site dry retention area will be provided for surface storage and water quality enhancement. The on-site drainage system will consist of a series of catch basins and storm water piping that will discharge to a dry detention area to provide water quality and storm water reduction. A water pipe from the dry detention area will connect to the C-17 Canal to allow for additional storm water discharge. Parking The applicant meets the minimum parking requirements for the entire site if a waiver is granted from Section 78-345 of the LDRs to reduce the width of all parking spaces from 10’ wide to 9.5’ wide, and a secondary waiver is granted from Section 78-315 (b) of the LDRs to allow for more than nine parking spaces in a row without a landscape island. The entire project, based on the proposed square footage of all buildings and outdoor seating, requires 395 parking spaces. The applicant is proposing 395 parking spaces, including eight handicap spaces. The applicant has provided an alternate parking plan demonstrating that the required number of spaces for the project can be met and the additional pavement has been dedicated toward open space. City Gateway Sign If the project is approved, Staff requests that the applicant locate a City Gateway Sign on the south end of the center median along Congress Avenue, subject to the approval of Palm Beach County. If this location is not permitted by Palm Beach Country, staff would request that the City Gateway entry sign be located on Parcel 34.01 East, on the southeast corner of Congress Avenue and Northlake Boulevard. Design and Architecture The proposed LA Fitness building will be 48’ in height. The building’s principal feature is the tower/rotunda in the northwest corner of the building. The restaurant/retail building includes a central tower/rotunda feature, with end towers. The CVS building includes a central tower feature at the entrance. It is staff’s professional opinion that the architecture on the CVS pharmacy and the restaurant/retail building could be considerably improved. The latter building could be improved by adding more windows and details on the south, west, and east elevations. Date Prepared: September 18, 2003 Meeting Date: October 16, 2003 Ordinance 35, 2003 & Resolution 176, 2003 The CVS pharmacy could be improved by adding more windows on all elevations, and including columns on the west elevation, since they are reflected on all other elevations of the building. Additionally, the height of the rotunda feature could be increased above the main doorway so that it is more consistent with the feature on the LA Fitness building. In order to qualify for the reduced parking stall width waiver, the applicant must demonstrate that open space is being provided, at a ratio of 1.5 square feet for every square foot of reduced pavement. Although the applicant may be able to meet this requirement, 61% of the open space provided on site is within the dry detention area. Very minimal useable open space exists on site, and as such, staff does not support the waiver. Staff is not in support of any of the requested sign waivers. It is staff’s opinion that the requested waivers are inconsistent with the intent and spirit of the NBOZ, which intentionally established a restrictive sign code to address the existing sign clutter that exists along the corridor today, and enhance and protect the physical appearance of the corridor. The proliferation of signage was discussed considerably during the drafting of the NBOZ, and as such, waivers from the code should be cautiously granted and only when adequate justification is presented. Due to the height and location of all three Date Prepared: September 18, 2003 Meeting Date: October 16, 2003 Ordinance 35, 2003 & Resolution 176, 2003 buildings, each building identification sign will be highly visible from Northlake Blvd. and/or Congress Ave., thereby providing adequate exposure to all three buildings. Furthermore, the permitted monument sign will provide additional signage along Northlake Boulevard. The applicant has not provided adequate justifications for the waivers. Furthermore, if sign waivers are granted, it will establish an undesirable precedent for signs included within future development and redevelopment along the Corridor. (3)The applicant is requesting a waiver from Section 78-345 for a reduction in the amount of required loading zones. In this case, five loading spaces are being provided when six loading spaces are required. Staff recommends an additional loading space be provided for the restaurant/retail building so that the minimum code requirement is met, since the applicant has not adequately justified this waiver. (4)A waiver is being requested to allow for more than nine parking spaces in a row without a landscape island. The applicant is providing ten parking spaces in a row in a number of parking rows on site. Staff is not in support of the requested waiver. (5)A waiver is being requested to allow for the foot-candles under the pharmacy canopy to exceed the maximum 10 foot-candle level. Staff is not in support of the requested waiver. * The Town of Lake Park variances not listed. SUMMARY OF OUTSTANDING ISSUES In summary, the overall site design and pedestrian connectivity are not consistent with the intent of the LDRs, the NBOZ, and the City’s Comprehensive Plan. Since only two undeveloped parcels in the City exist along Northlake Boulevard, it is critical to set a desirable character of development so that a precedent is established for future parcels. Site Design and Pedestrian Connectivity In order to create a strong and pedestrian-friendly site plan, it is important to locate the buildings closer to the street to create a vibrant streetscape, which promotes pedestrian activity along Northlake Boulevard. The CVS and restaurant/retail buildings have four and three rows of parking in front of the buildings, respectively, along Northlake Boulevard. The parking area creates a distance of over 150’ between the street and the buildings along Northlake Boulevard. Furthermore, three developments in the City of Palm Beach Gardens adjacent to the subject site (i.e. Applebee’s restaurant, Pep Boys, and Walgreens) have no more than two rows of parking along Northlake Boulevard. In addition, the three stand-alone buildings lack strong connectivity to one another and are not massed together as the LDRs requires in Section 78-227, General 10 Date Prepared: September 18, 2003 Meeting Date: October 16, 2003 Ordinance 35, 2003 & Resolution 176, 2003 Provisions, Compatibility with setting. Policy 1.1.1.9 of the City’s Comprehensive Plan furthermore promotes the importance of creating, "people places" within new developments. The proposed buildings within the PUD have been spaced far away from one another; each building appears and functions as an out- parcel. Architecture& Design Section 78-227, Design Treatments of the LDRs, encourages design treatments on all buildings, including the use of four-sided architecture, ornamentation, recesses, projections, avoidance of blank walls, and window and door treatments for all buildings. The CVS pharmacy building maintain blank walls on south and west elevations, and the restaurant/retail building maintains blank walls on the south, west, and east elevation. Overall, these two buildings lack four-sided architecture, and require additional treatments on all of their elevations. PLANNING AND ZONING RECOMMENDATION On June 24, 2003, the Planning & Zoning Commission held a Joint Planning and Zoning Public Hearing for this petition. Both Commissions recommended approval to the City Council, with a vote of 4 in favor and 1 against for the Town of Lake Park, and a vote of 5 in favor and 0 opposed for the City. RECOMMENDATION Staff recommends denial of Ordinance 35, 2003, and Resolution 176, 2003, as proposed by the applicant based on the following findings of fact listed below. However, should the City Council approve this Ordinance and Resolution, staff recommends the conditions of approval provided therein. The proposed plan lacks four-sided architecture, as required by Section 78-225 of the LDRs, General Provisions, Compatibility with Setting and 78-227 of the LDRs, Design Treatments, Building Design, which additionally promotes building ornamentation, recesses, projections, avoidance of blank walls, and window and door treatments for all buildings. The pharmacy building and the restaurant/retail building do not adequately meet this requirement; however, the latter especially lacks four-sided architecture, and needs additional treatments on the east, west, and south elevations. The intent of using landscaping to shield blank facades is not consistent with this code requirement. 2.The pharmacy building and the restaurant/retail building are not compatible with the design and setbacks across the street on the north side of Northlake Boulevard, as required by Section 78-225 of the LDRs General Provisions, Purpose and Intent, which 11 o o o Date Prepared: September 18, 2003 Meeting Date: October 16, 2003 Ordinance 35, 2003 & Resolution 176, 2003 requires the creation of the opportunity for new development to respect existing scale, style, and character, while preserving the positive aspects of the corridor. Locating the building in a closer proximity to Northlake Boulevard and treating the front fagade of the CVS pharmacy with more embellishments and features would better improve the style and character within the project. The project does not include a unif, cing community design and development theme to work in conjunction with the proposed corridor streetscaping as required in Section 78- 225 of the LDRs: General Provisions. Purpose and Intent. The LA Fitness building has established the theme for the PUD, but has not been consistent applied throughout the design and architecture of the two remaining buildings within the project, which both lack four-sided architecture. Considering the parcel is a City entryway to both the City and the Town, the proposed project should include outstanding architecture and site design elements consistent with the LDRs and NBOZ. The applicant has not provided adequate justification for the requested waivers as required by Section 78-158 of the LDRs: Waivers to planned development district requirements. The waivers have been requested for the convenience of the applicant, and nothing has been provided on the site plan to substantiate the eight requested waivers. The project represents one of the few opportunities for new development along the Northlake Corridor, and the second after the Banyan tree PUD. If new developments seek waivers that do not further the spirit and intent the NBOZ, redevelopment along the Corridor will also seek similar waivers that do not achieve this goal. In the event a Special District is not created, the City of Palm Beach Gardens reserves the right to bill the applicant, successors, or assigns for their fair share of the maintenance of the aforementioned Northlake Boulevard right-of-way irrigation and landscaping. WHEREAS, the owners of portions of a 8.80 acres, more or less parcel of land generally located on the southwest comer of Congress Avenue and Northlake Boulevard seek to develop the Site ("Site") as a unified project; and WHEREAS, approximately 5 acres or 57% of the site is within the City of Palm Beach Gardens and 3.71 acres or 43% of the "Site" is within the Town of Lake Park, more particularly described on Exhibit "A" attached hereto and incorporated herein; and WHEREAS, the Site is significant because of its location as a gateway to both the Town and the City; and WHEREAS, it is the intent of the City and Town to implement the Northlake Boulevard Overlay Zoning District and to establish consistent land development regulations for the Site; and WHEREAS, the City and Town propose to provide a process for centralized development review, permitting and code enforcement so as to enable the owner(s) of the Site to utilize the property in accordance with zoning and enforcement procedures that are consistent in each municipality; and WHEREAS, the City and Town are authorized pursuant to Section 163.01, Part I, chapter 163, Florida Statutes to enter into this Agreement; and WHEREAS, in the spirit ofintergovernmental coordination and in support of the efforts of the Northlake Boulevard Corridor Task Force and the desire to promote good community pl.ann!ng. within and beyond the boundaries of both municipalities, the City and the Town recognize that it is in their mutual best interests to enter into this Agreement. \\Uds_server\VOLl\COMMONMobskParcel 34.01W~devagmt.080102R.wpd LCC35 Page 1 of 5 NOW, THEREFORE, in consideration of the obligations and undertakings described below, the City and Town do hereby enter into this Interlocal Agreement and represent, covenant and agree as follows: 1. RECITALS: The foregoing recitals are true and correct and express the City’s and Town’s mutual interest in development of the Site. 2. IMPLEMENTATION OF AGREEMENT: (a) City and Town shall each appoint an "Administrator," for the purposes of this Interlocal Agreement to coordinate the administration between the municipalities. (b) The City’s Growth Management Director and the Town’s Community Development Director are hereby required to meet with the Administrators to review applications for zoning, permits, site plans and building plans in order to facilitate such applications, all of which shall be processed pursuant to the City’s applications procedures, but jointly with the Town on a set schedule mutually established by the Administrators. (c) It is contemplated that the proposed development on the Site will be treated as rezoning by both the Town and City. Each municipality shall be responsible for reviewing all applications against their respective land development regulations and the regulations of the proposed Northlake Boulevard Overlay Zoning District (NBOZ), but each jurisdiction shall take separate action at jointly held meetings for the approval of such applications. In case of conflict with other municipal code provisions, the provisions of the NBOZ for waivers or variances, as permitted under each jurisdiction’s municipal code, shall apply. (d) In order to maintain an orderly development review process, the City shall solely responsible for leading the processing of all development applications with regard to the Site, in accordance with the City’s procedures and the procedures set forth in the proposed Northlake Boulevard Overlay Zoning District regulations. The Town and City shall review applications jointly and the recommendations by both municipal Planning and Zoning bodies, first and second readings of ordinances, public hearings and final action by the City Council and Town Commission shall occur at joint meetings to be scheduled through the Administrators. (e) This Agreement shall apply to any expansion or contraction area of the Site which is contiguous to the original site and thereby changing the percentage of land area in the respective jurisdictions and corresponding prorata calculations as defined herein. The general development application fee shall be paid in full to each municipality, as required. ’ (g) Property taxes for the buildings and other improvement shall be prorated ~o each municipality based on percentage of site located with in the municipality. Property taxes for land shall be paid in accordance with the normal procedure of the Palm Beach County tax collector. (h) Police protection, fire protection, building permits and fees, building inspections, Certificates of Occupancy, and occupational licenses shall be under the direction of the jurisdiction with the largest percentage of each structure or improvement requiring inspection located in its jurisdiction, unless otherwise provided for in the final development order. The City shall inspect ALL Site work including parking and landscaping areas, with the exception foundation plantings, for final certificate of occupancy. (i) All property of the subject Site shall be required to provide Unity of Control for the affected property. A single plat for the Site shall be approved by both governing bodies. (j) All future development applications including amendments to ~he development order and/or redevelopment plans for the site shall require joint review and approval by the governing bodies of each municipalities. Such review and approval shall be conducted consistent with the above described process unless otherwise agreed to by the owner of the site and each governing body of each municipality. 3.NORTHLAKE BOULEVARD OVERLAY DISTRICT The Town and City hereby acknowledge that each municipality has been working toward a common goal regarding development review and procedures on Northlake Boulevard and each has adopted or anticipates adopting the procedures and requirements of the Northlake Boulevard Overlay Zoning District. In an effort to provide consistent and fair code enforcement by each municipality, the code enforcement officers of each municipality shall coordinate their activities to ensure consistent enforcement throughout the Site. 4. MODIFICATION OF AGREEMENT This Agreement may be modified only upon majority vote of the governing body in each municipality. "", TOWN of LAKE PARK TOWN COMMISSION Meeting Date: October 16, 2003 Date Prepared: October 7, 2003 SUBJECT/AGENDA ITEM Northlake Square West A request by Urban Design Studio, agent for Congress Plaza West, Joint Venture Partnership, for a rezoning from Research and Light Industrial Park to Planned Unit Development (PUD) Overlay with an underlying zoning of General Commercial (CG-1) the City of Palm Beach Gardens, and rezoning from Traditional Neighborhood District (TND) to Commercial -1 (C-1) in the Town of Lake Park, to allow for the development a 41,000 square-foot fitness center, a 12,389 square-foot pharmacy with a two-lane drive-through, and a 12,000 square-foot restaurant/retail building including an 828 square foot outdoor seating area on an 8.80-acre site. The site is located at the southwest corner of the intersection of Northlake Boulevard and Congress Avenue within the municipal boundaries of the City of Palm Beach Gardens and the Town of Lake Park. PUBLIC COMMENT SUMMARY: Attached to this report is one letter that was received in support of this project. BACKGROUND: The 8.80-acre subject site is located within two municipal boundaries. Approximately five acres, or 57% of the site is within the City of Palm Beach Gardens, and approximately 3.71 acres, or 43% of the site, is within the Town of Lake Park. In August 2002, the City and the Town signed an inter-local joint development agreement to provide for a coordinated development review process and centralized permitting and code enforcement to develop the subject property in accordance with the land development regulations of both municipalities. As such, each municipality has reviewed this application under their respective land development regulations, as well as the Northlake Boulevard Overlay Zoning District (NBOZ). Each jurisdiction, however, shall take separate action regarding the development at jointly held meetings. Should a conflict arise between regulations of the two jurisdictions, the regulations of the NBOZ will apply. Both the Planning and Zoning Commissions of the Town and the City wilt jointly review the project, and both governing bodies will also jointly review and hold public hearings, but take final actions separately. The City of Palm Beach Gardens is responsible for leading the processing of the development application of the subject site in accordance with the inter-local agreement. LAND USE AND ZONING: The portion of the within the Town of Lake Park is currently zoned Traditional Neighborhood District (TND), with a future land-use designation of Mixed Use Commercial/Light Industrial. The applicant has requested to rezone the parcel to Commercial-1 (C-1). The property is also located within Northlake Boulevard Overlay Zone, and subject to the site design regulations established by the Northlake Boulevard Overlay Zoning District Design Guidelines. The current zoning under the City of Palm Beach Gardens is Research and Light Industrial Park (MI), and has a future land-use designation of Commercial (C). applicant is proposing to rezone the site to Planned Unit Development (PUD) Overlay with an underlying zoning of General Commercial (CG-1). CONSISTENCY WITH THE COMPREHENSIVE PLAN: The proposed development is consistent with the overall intent of the goals, objectives and policies of the Town’s Comprehensive Plan. The following policies indicate the consistency between the Comprehensive Plan and the proposed project: FUTURE LAND USE ELEMENT Policy 1.8: New development shall be permitted only when central water and wastewater systems are available or will be provided concurrent with the impacts of development. The roadway, water and wastewater infrastructure currently exists in the area to service the project. Policy 3.1: The development of residential, commercial and mixed commercial/industrial lands shall be timed and staged in conjunction with provisions of supporting community facilities, such as streets, utilities, police and fire protection service .... Subsequent to the installation and construction of adequate infrastructure along Congress Avenue, the applicant’s request is considered a suitable development at this location. VARIANCES: The applicant did request one Variance from the Town’s Land Development Code that requires a 10-foot wide parking stall width. The request was presented to the Board of Adjustment at a Special Call Meeting on August 18th 2003. The Board of Adjustment approved the request in a 4-0 vote. CONSISTENCY WITH THE NORTHLAKE BLVD. OVERLAY ZONING DISTRICT "The purpose and intent of the Northlake Boulevard Design Guidelines is to implement the objectives of the NBOZ Conceptual Streetscape Plan adopted by the Northlake Boulevard Task Force." The applicant’s request has undergone an extensive review based upon the design guideline provisions, which supersede the Town’s existing Land Development Code, as they are more restrictive. Although the applicant’s site development plan does incorporate many of the standards established by the Design Guidelines, the architectural renderings are not consistent with the intent of Architectural Element found within the NBOZ Design Guidelines. Sec. 3-1 General Provisions requires that all new buildings or structures constructed within the NBOZ conform to one hundred percent of the Overlay Design Guidelines. The NBOZ requires 4-sided architecture as referenced in Sec. 3-2.5. Although the proposed architecture is unique, the buildings lack architectural continuity and detailing along all faces of the buildings. CONCURRENCY: The applicant has received traffic concurrency from Palm Beach County and the City; the build-out date for the project is December 31, 2004. The applicant has reserved water and sewer capacity and waste management service for the site. PROJECT DETAILS: Buildinq Site The 8.80-acre subject site is located within two (2) separate municipal boundaries. Approximately five acres, or 57% of the site is within the City of Palm Beach Gardens, and approximately 3.71 acres, or 43% of the site, is within the Town of Lake Park. In August 2002, the City and the Town signed an inter-local joint development agreement to provide for a coordinated development review process, and centralized permitting and code enforcement, to develop the property in accordance with the land development regulations of both municipalities. As such, each municipality will review the application under its respective land development regulations as well as the Northlake Boulevard Overlay Zoning District (NBOZ). Each jurisdiction, however, shall take separate action regarding the development at jointly held meetings. Should a conflict arise between regulations of the two jurisdictions, the regulations of the NBOZ will apply. Both the Planning and Zoning bodies of the Town and the City will jointly review the project, and both governing bodies will also jointly review and hold public hearings, but take final actions separately. The City of Palm Beach Gardens is responsible for leading the process of all development applications of this site in accordance with the Inter-local Agreement. The developer wishes to construct a two-story fitness center totaling 41,000 square feet, a one-story 12,389 square-foot pharmacy with a two-lane drive-through facility, and a one-story 12,000 square-foot multi-tenant restaurant/retail building with an 828 square foot outdoor seating area. LA Fitness, the proposed tenant for the fitness center, is the principal structure on the site. The 48 foot high building will be located at the southwest corner of the site. CVS pharmacy, the proposed tenant for the pharmacy building, is located on the northeasterly side of the site. The applicant is proposing a two-lane drive- through facility on the western side of the pharmacy building, and a loading area on the south side. The multi-tenant restaurant/retail building is located west of the 24’ main access driveway connecting to Northlake Boulevard. The applicant is proposing an outdoor seating area on the northern side of the restaurant/retail building, parallel to the access driveway. The site is within the "Central District" of the Northlake Boulevard Overlay Zoning District. The portion of the site that is within the Town of Lake Park is currently zoned Traditional Neighborhood District (TND) and has a Mixed-Use Commercial/Light Industrial (MC/LI) Land Use Designation. The applicant is proposing to rezone the parcel to Commercial-1 (C-1), which is consistent with the MC/LI designation. The remainder the subject site is within the municipal boundaries of the City of Palm Beach Gardens and is currently zoned Research and Light Industrial Park (MI). The City’s future land- use designation for this site is Commercial (C), and the property is also designated Commercial (C) on the City’s Vision Plan. The applicant is proposing to rezone the site to Planned Unit Development (PUD) with an underlying zoning classification of General Commercial (CG-1). Site Access A two-way driveway provides vehicular access to the site from Northlake Boulevard, and a two-way driveway from Congress Avenue. A right-turn lane will be provided before each access point for both Northlake Boulevard and Congress Avenue. A cross-access driveway is also provided from the adjacent property to the south of the subject site. A curb cut aligned with the driveway is proposed along Congress Avenue, to provide access into both Lowe’s and the subject property from vehicular traffic driving north on Congress Avenue. S~clna_qe Signage standards found within the Town’s Land Development Regulations are fairly liberal. As the NBOZ requirements are more restrictive, Staff is required by the Joint- Development Agreement to review the proposed signage using the more restrictive of the two codes. The applicant is requesting two monument signs located along Northlake Boulevard and Congress Avenue. The applicant is requesting a waiver from Article V, Table 5-6 of the NBOZ to allow for a monument sign to be placed closer than 50’ from a non right- of-way property line; and a waiver from to allow for more than one message to be located on each monument sign. Staff recommends denial of these waivers, as relief from the sign standards of the NBOZ will set a precedence and perpetuate non- conforming signage along the corridor. Landscapin.q/Bufferinq The applicant is providing 16,482 landscaping points when 10,913 points are required by the NBOZ regulations. The applicant is also providing a 15’ landscape buffer along Northlake Boulevard and Congress Avenue. Foundation landscaping is proposed around all buildings. If approved, the applicant shall be responsible for the installation, construction and maintenance of landscaping, irrigation, roadway shoulders and medians on Congress Avenue within six months of the development order approval. The applicant has provided a meandering sidewalk and road shoulder landscape plan for Northlake Boulevard. The applicant, however, has specified Silver Buttonwood trees for the road shoulder of Northlake Boulevard as conveyed in the approved Streetscape Plan designed by Michael Redd. The applicant is required to provide a minimum of 0.88 acres of usable open space onsite. However, 61%, or approximately 0.97 acres, of the proposed open space is the dry detention area in the southwest corner of the site, located behind the LA Fitness building. Consequently, very little open space has been provided as usable and visible open space within the project. Phasinq According to the applicant, the proposed project will be built in one phase. Drainaqe The surface water management system will be under the jurisdiction of the South Florida Water Management District (SFWMD). An on-site dry retention area will be provided for surface storage and water quality enhancement. The on-site drainage system will consist of a series of catch basins and storm water pipes discharging into the dry detention area, providing enhanced water quality and storm water reduction. An outflow pipe from the detention area connects to the C-17 Canal and allows additional storm water discharge. Parkinq With approval of the requested parking stall variance, the applicant meets all the minimum parking requirements. Waivers Staff does not support the requested signage waivers and considers the waivers inconsistent with the intent and spirit of the NBOZ, which intentionally established a restrictive sign code to address signage clutter along Northlake Boulevard and to enhance and protect the physical appearance of the corridor. The proliferation of discordant signage was considered throughout the drafting of the NBOZ regulations, and as such, waivers from this particular code requirement should be considered and granted cautiously on a case-by-case basis. The proposed building locations and wall mounted identification signage heights will provide adequate signage visibility from Northlake Blvd. and Congress Ave. Furthermore, the permitted monument sign will provide suitable additional signage along Northlake Boulevard. PLANNING AND ZONING RECOMMENDATION On June 24, 2003, the Planning & Zoning Commission held a Joint Planning and Zoning Public Hearing for this petition. Both Commissions recommended approval to the City Council, with a vote of 4 in favor and 1 against for the Town of Lake Park, and a vote of 5 in favor and 0 opposed for the City of Palm Beach Gardens. RECOMMENDATION: Generally, staff is supportive of the proposed site and development plan and believes the applicant has made a good faith effort to satisfy many of the NBOZ Design Guidelines. The respective municipal staffs from Lake Park and Palm Beach Gardens disagree on this point. It should also be noted however, that the City of Palm Beach Gardens has a more restrictive Land Development Code than the NBOZ Design Guidelines, and the City does require superior architectural and site design on development projects within it’s jurisdiction. The applicant throughout this process has been made aware of Palm Beach Garden’s stringent requirements. The applicant has not produced a project (architecture, site design, amenities) satisfying Palm Beach Garden’s standards. Lake Park staff has also found the proposed project plans to be inconsistent with the NBOZ Design Guidelines. Throughout the review process, staff requested that the applicant provide architecture with continuity on all building facades/faces, as well as permanence amongst the proposed structures. Staff disagrees with the applicant that the proposed architecture meets the intent of the design guidelines. Approval of the requested sign waivers is in conflict with the intent of the NBOZ. Permitting the requested sign waivers would re-enforce and perpetuate the proliferation of non- conforming signage along the corridor. Therefore, Staff recommends denial of the requested waiver requests and recommends the applicant amend, adjust or modify the architecture and proposed signage to conform to the NBOZ Design Guidelines. Similar to the previously approved agreement, the proposed agreement will provide for the joint development review between the City of Palm Beach Gardens and the Town of Lake Park for a parcel of land located at the southeast comer of Northlake Boulevard and Congress Avenue. Approximately 8.29 acres (43%) of the site is within the City of Palm Beach Gardens, and 10.83 acres (57%) of the site is in the Town of Lake Park. The proposed Interlocal Agreement will allow the Town of Lake Park and the City of Palm Beach Gardens to mutually review and approve the development application for the subject parcel called Northlake Square East, which includes a 125,739 square-foot retail building with a 6,100 square-foot garden center. The proposed tenant will be Target. SUMMARY OF INTERLOCAL AGREEMENT The lnterlocal Agreement will establish a process for review, permitting, code enforcement, and the provision of public services for the subject parcel. A brief summary of the Interlocal Agreement is provided below: ¯The City of Palm Beach Gardens will be responsible for leading the processing of all development applications with regard to the Site. ¯Fire and police services for the entire site will be the responsibility of the City of Palm Beach Gardens. ¯Property taxes for the buildings and other improvements on the Site will be prorated to each municipality based on the percentage of the Site located within the municipality. ¯Fees will provided to the City through a separate agreement between the City and the parcel owner for payment of fees to the City in lieu of road, fire, and police impact fees. ¯The City and Town will both collect required application fees and related costs for planning, legal, engineering and other professional services. ¯The agreement will be terminated if the site is not developed as a unified parcel required joint approvals by both the Town and the City. WHEREAS, the owners of portions of a 8.80 acres, more or less parcel of land generally located on the southwest comer of Congress Avenue and Northlake Boulevard seek to develop the Site ("Site") as a unified project; and WHEREAS, approximately 5 acres or 57% of the site is within the City of Palm Beach Gardens and 3.71 acres or 43% of the’ "Site" is within the Town of Lake Park, more particularly described on Exhibit "A" attached hereto and incorporated herein; and WHEREAS, the Site is significant because of its location as a gateway to both the Town and the City; and WHEREAS, it is the intent of the City and Town to implement the Northlake Boulevard Overlay Zoning District and to establish consistent land development regulations for the Site; and WHEREAS, the City and Town propose to provide a process for centralized development review, permitting and code enforcement so as to enable the owner(s) of the Site to utilize the property in accordance with zoning and enforcement procedures that are consistent in each municipality; and WHEREAS, the City and Town are authorized pursuant to Section 163.01, Part I, chapter 163, Florida Statutes to enter into this Agreement; and WHEREAS, in the spirit ofintergovemmental coordination and in support of the efforts of the Northlake Boulevard Corridor Task Force and the desire to promote good community planning within and beyond the boundaries of both municipalities, the City and the Town recognize that it is in their mutual best interests to enter into this Agreement. \\Uds_serveAVOLl \COMMONklohsWaree134.01VAdevagmt070102R.wpd LCC35 Page l’of 5 "Exhibit B" NOW, THEREFORE, in consideration of the obligations and undertakings described below, the City and Town do hereby enter into this Interlocal Agreement and represent, covenant and agree as follows: 1. RECITALS: The foregoing recitals are true and correct and express the City’s and Town’s mutual interest in development of the Site. 2. IMPLEMENTATION OF AGREEMENT: (a) City and Town shall each appoint an "Administrator," for the purposes of this Interlocal Agreement to coordinate the administration between the municipalities. (b) The City’s Growth Management Director and the Town’s Community Development Director are hereby required to meet with the Administrators to review applications for zoning, permits, site plans and building plans in order to facilitate such applications, all of which shall be processed pursuant to the City’s applications procedures, but jointly with the Town on a set schedule mutually established by the Administrators. (c) It is contemplated that the proposed development on the Site will be treated as rezoning by both the Town and City. Each municipality shall be responsible for reviewing all applications against their respective land development regulations and the regulations of tl~e proposed Northlake Boulevard Overlay Zoning District (NBOZ), but each jurisdiction shall take separate action at jointly held meetings for the approval of such applications. In case of conflict with other municipal code provisions, the provisions of the NBOZ for waivers or variances, as permitted under each jurisdiction’s municipal code, shall apply. (d) In order to maintain an orderly development review process, the City shall solely responsible for leading the processing of all development applications with regard to the Site, in accordance with the City’s procedures and the procedures set forth in the proposed Northlake Boulevard Overlay Zoning District regulations. The Town and City shall review applications jointly and the recommendations by both municipal Planning and Zoning bodies, first and second readings of ordinances, public hearings and final action by the City Council and Town Commission shall occur at joint meetings to be scheduled through the Administrators. The general development application fee shall be paid in full to each municipality, as required. (g) Property taxes for the buildings and other improvement shall be prorated to ea’eh municipality based on percentage of site located with in the municipality. Property taxes for land shall be paid in accordance with the normal procedure of the Palm Beach County tax collector. (h) Police protection, fire protection, building permits and fees, building inspections, Certificates of Occupancy, and occupational licenses shall be under the direction of the jurisdiction with the largest percentage of each structure or improvement requiring inspection located in its jurisdiction, unless otherwise provided for in the final development order. The City shall inspect ALL Site work including parking and landscaping areas, with the exception foundation plantings, for final certificate of occupancy. (i) All property of the subject Site shall be required to provide Unity of Control for the affected property. A single plat for the Site shall be approved by both governing bodies. (j) All future development applications including amendments to the development order and/or redevelopment plans for the site shall require joint review and approval by the governing bodies of each.municipalities. Such review and approval shall be conducted consistent with the above described process unless otherwise agreed to by the owner of the site and each governing body of each municipality. 3.NORTHLAKE BOULEVARD OVERLAY DISTRICT The Town and City hereby acknowledge that each municipality has been working toward a common goal regarding development review and procedures on Northlake Boulevard and each has adopted or anticipates adopting the procedures and requirements of the Northlake Boulevard Overlay Zoning District. In an effort to provide consistent and fair code enforcement by each municipality, the code enforcement officers of each mtmicipality shall coordinate their activities to ensure consistent enforcement throughout the Site. 4. MODIFICATION OF AGREEMENT This Agreement may be modified only upon majority vote of the governing body in each municipality. 5. WHEREAS, the City of Palm Beach Gardens and the Town of Lake Park wish to enter into a contract for joint development review of a parcel of land located at the southeast corner of Northlake Boulevard and Congress Avenue; and WHEREAS, the Interlocal Agreement establishes a process for review, permitting, code enforcement, and the provision of public services for the subject parcel, as more particularly described herein; and WHEREAS, the objective of the Interlocal Agreement is consistent with the intent and regulations of the Northlake Boulevard Overlay Zoning District; and WHEREAS, the Growth Management Department has recommended approval of the Interlocal Agreement; and WHEREAS, such agreement has been prepared and is attached hereto. WHEREAS, the owners of portions of a 19.12-acre ("owners"), more or less, parcel of land generally located on the southeast corner of Congress Avenue and Northlake Boulevard seek to develop the Site ("Site") as a unified project; and WHEREAS, approximately 8.29 acres or 43% of the site is within the City of Palm Beach Gardens ("City") and 10.83 acres or 57% of the "Site" is within the Town Lake Park ("Town"), the legal description of which is more particularly described Exhibit "A," which is attached hereto and incorporated herein; and WHEREAS, because the Site is planned to be developed by making use of the property located in both the Town and the City, an Interlocal Agreement is in the best interest of all parties; and WHEREAS, the Site is significant because of its location as a gateway to both the Town and the City; and WHEREAS, it is the intent of the City and Town to implement the Northlake Boulevard Overlay Zoning District ("NBOZ") and to establish consistent land development regulations for the Site; and WHEREAS, the City and Town propose to provide a process for centralized development review, permitting, and code enforcement so as to enable the owner(s) the Site to develop and utilize the property in accordance with the comprehensive plans and land development regulations of both municipalities; and WHEREAS, the City and Town are authorized pursuant to Section 163.01, Florida Statutes, to enter into this Agreement; and WHEREAS, in the spirit of intergovernmental coordination and in support of the efforts of the Northlake Boulevard Corridor Task Force and a mutual desire to promote good community planning within and beyond the boundaries of both municipalities, the City and the Town recognize that it is in their mutual best interests to enter into this Agreement. NOW, THEREFORE, in consideration of the obligations and undertakings described below, the City and Town do hereby enter into this Interlocal Agreement and represent, covenant, and agree as follows: 1.RECITALS. The foregoing recitals are true and correct and express the City’s and Town’s mutual interest in development of the Site. 2.IMPLEMENTATION OF AGREEMENT. (a)City and Town shall each appoint an "Administrator" for the purposes of this Interlocal Agreement to coordinate the administration of the review of applications for applications for development of the Site between the municipalities. (b)It is contemplated that the proposed development of the Site will require a rezoning by both the Town and City. Each municipality shall be responsible for reviewing all applications for consistency with their respective land development regulations, comprehensive plans, and the regulations of the NBOZ, but each jurisdiction shall take separate action at jointly held meetings for the approval of such applications. In case of conflict with other municipal code provisions, the provisions of the NBOZ for waivers or variances, as permitted under each jurisdiction’s municipal code, shall apply. (c)In order to maintain an orderly development review process, the City shall be responsible for leading the processing of all development applications with regard to the Site, in accordance with the City’s procedures and the procedures set forth in the NBOZ regulations. The Town and City shall review applications jointly, which shall include the City’s DRC process, and the recommendations by both municipalities’ Planning and Zoning bodies and the City Council and Town Commission shall occur at joint public meetings to be noticed and scheduled through the Administrators. (d)This Agreement shall apply to any expansion or contraction area of the Site which is contiguous to the original site and thereby changing the percentage of land area in the respective jurisdictions and corresponding pro-rata calculations as defined herein. (e)Prior to the Planning and Zoning public hearing, the parcel owner shall submit an agreement acceptable to the City to provide for payment of fees to the City in lieu of road, fire, and police impact fees. (f)Property taxes for the buildings and other improvements on the Site shall be prorated to each municipality based on percentage of the Site located within the municipality. Property taxes for land shall be paid in accordance with the normal procedure of the Palm Beach County Tax Collector. 2 (g) Service provision shall be as described below: (1)The Town and City shall both collect the required application fees and related costs for planning, legal, engineering, and other professional services. The municipality in which the structure is located shall collect the required building permit fees and occupational license fees. Site development permits for the entire site shall be reviewed and approved by both municipalities and issued by each municipality for the portion of the site located within that municipality. All applications for building and landscaping permits and certificates of occupancy shall be submitted simultaneously to the City and Town for review. The Town shall not issue any such permits or certificates of occupancy until the City has approved such applications and notified the Town in writing. (h)A single plat for the Site shall be approved by both municipalities. The owner shall be required to provide a Unity of Control acceptable to the City and Town for the affected property should it ever be subdivided into separate tracts under different ownership. (i)All future development applications, including amendments to the development order for the Site, shall require joint review and approval by the municipalities, consistent with the above-described process. 3.FIRE AND POLICE PROTECTION AND CODE ENFORCEMENT. The parties agree that it is in the best interest of both municipalities that fire and police protection and code enforcement for the entire site be the responsibility of the City. The parties agree to enter into a separate Interlocal Agreement to establish the specific terms and conditions under which fire and police protection and code enforcement will be provided by the City. 4.NORTHLAKE BOULEVARD OVERLAY DISTRICT. The Town and City hereby acknowledge that each municipality has a common goal regarding development review and procedures on Northlake Boulevard, and each has adopted the procedures and requirements of the NBOZ. The municipal boundaries for each municipality shall be designated on the approved Site Plan. Jurisdiction for the enforcement of applicable code requirements shall be based upon the physical/geographical location of any alleged violation and the municipality in which the alleged violation is located shall have code enforcement jurisdiction. In the event that an alleged violation exists in both municipalities and/or a violation of one or more conditions of approval of the approved Site Plan or plat exists, both municipalities shall have concurrent jurisdiction for purposes of code enforcement. 5.MODIFICATION OF AGREEMENT. This Agreement may be modified only upon majority vote of the governing body in each municipality. 6.DURATION. This Agreement shall be terminated if the site is not developed as a unified parcel requiring joint approvals by both the Town and City. This Agreement shall remain in effect as long as a unified development exists on the site, but may be terminated or amended in writing by both parties with adequate notice to the property owner of record. 7.RECORDATION IN PUBLIC RECORDS. This Agreement shall be filed in the Public Records of Palm Beach County. 8.LEGISLATIVE POWER. This Agreement is not intended nor shall it be constructed as a delegation of legislative power to the other municipality or the Administrator. 9.GOVERNING LAW.
