A Development Review Committee meeting will be held on Thursday, January 24 at 2:00 a.m., in
the City Council Chambers to review the following development applications:
PALM BEACH GARDENS PETITION NUMBERS MNSP- 07 -12- 000003, REZN- 07 -12- 000002, and
CUMN- 07 -12- 000003 — Northlake Boulevard Shell Gas Station Annexation
A request by Dodi Glas of Gentile Holloway O'Mahoney & Associates, agent for the applicant, for an
approval of an annexation, small scale future land use amendment (FLUA), rezoning, and site plan
review with a minor conditional use. The site is located within the future annexation area of the City
Palm Beach Gardens, however, it is currently contained within unincorporated Palm Beach County. In
addition the site is within the Northlake Boulevard Overlay Zone (NBOZ). The 0.71 -acre subject site is
situated on the southwest comer of Northlake Boulevard and Military Trail.
The applicant will be in attendance at this meeting. Our office requests your participation in the
review of this project. Please review this request and attend the meeting if possible. Receiving your
comments prior to the meeting will provide staff with the ability to give proper direction to the
applicant.

Petition MNSP- 07 -12- 000003: Northlake Boulevard Shell Gas Station (Planning
Comments)
1. City Code Section 78- 225(d)(4)(a) states, "waivers from the NBOZ regulations
may be granted by the applicable reviewing jurisdiction in accordance applicable
jurisdiction's procedures for granting waivers fi-om its own Code." The Applicant
has indicated waivers are being requested with the subject petition. The Applicant
shall request a rezoning to a Planned Unit Development (PUD) if waivers are to
be requested for approval by City Council.
2. City Code Section 78 -52(d) requires that minor conditional uses demonstrate
compliance with 13 criteria. The Applicant has submitted an application to the City
requesting approval of a minor conditional use to co- locate a fast food restaurant
and convenience store on the subject site. The Applicant shall submit a conditional
use analysis for review by staff and the Development Review Committee for each of
the requests.
3. City Code Section 78- 229(a)(2) states, "a nonconforming sign is any sign which was
established pursuant to the issuance of a sign permit on or before the effective date
of these regulations, and which is nonconforming by the provisions of this section."
The Applicant shall acknowledge that the existing pole sign will be removed from
the site if the project is approved by City Council.
4. City Code Section 78 -229, Table 5 -5, requires that gasoline price signs be setback
from the property lines 20 feet. The Applicant has requested a waiver from a 10 foot
setback requirement for the proposed sign. The Applicant shall revise the requested
waiver to reflect the 20 foot requirement as noted in Table S -S.
S. City Code Section 78 -230, Table 6 -2, identifies the required setbacks for properties
located within the NBOZ. The Applicant shall indicate on the site plan the required
setbacks for parking in addition to the building setbacks already noted on the site
plan.
6. City Code Section 78- 230(c)(a -d) states, "adequate stacking for six vehicles per lane
at 20 feet per vehicle; proper ingress /egress to the facilities so as to preclude entering
and exiting directly from a public right -of -way; adequate space for a bypass lane;
and any other design deemed appropriate by the jurisdiction." The Applicant shall
indicate compliance with the required stacking or request an additional waiver.
7. The Applicant has indicated on the traffic study that 12 fiiel pumps are proposed for
the subject site. The project narrative indicates 6 fitel pumps are proposed for the
site. The Applicant shall revise the project narrative for consistency with the tragic
study and site plan.

CPTED Compliance:
Crime Prevention Through Environment Design is a branch of situational crime prevention
that maintains the basic premise that the physical environment can be designed or
manipulated to produce behavioral effects that will reduce the incident and fear of crime.
The review performed by the police officer listed above shall encompass but not be limited
to the following principles: natural surveillance, natural access control, territorial
reinforcement and maintenance. The police department has reviewed the site plan and
strongly recommends the following minimum conditions be met.
STANDARD CONDITIONS FOR APPROVAL:
Professional Office /Commercial /Industrial PUDs
1. Prior to the issuance of the first Certificate of Occupancy, all on -site lighting shall be installed. All
exterior on site lighting shall utilize 20 foot single poles, and all on -site lighting shall consist of
metal halide or equivalent lighting approved by the Police Department and shall not conflict with
planted landscaping. Luminaire type should optimize light distribution and minimize glare and up
lighting. (Police Department)
2 Landscaping shall not obstruct the view from windows or walkways. Ground cover should not
exceed "36" in height and high branched trees should be trimmed to seven feet. (Police Department)
3 Prior to the issuance of the first Certificate of Occupancy for the Shell Gas Station the
Applicant shall provide photocell sensor engaged lighting, "dusk to dawn ", above or near
entryways, all four sides of building and adjacent sidewalks for said building. (Police
Department)
4 Prior to the issuance of the first Certificate of Occupancy for the Shell Gas Station building all
entry doors(non -glass single /double) shall be equipped with astragal over the threshold of the
locking mechanism and case hardened deadbolt locks shall be provided on all exterior doors with
a minimum one (1) inch throw or mechanical interlock. Doors secured by electrical operation
shall have a keyed - switch or signal locking device to open the door when in the locked position.
Exterior doors should have a holding force of at least 10001bs. Door hinges shall employ non -
removable hinges, and the main entries to the building shall be wired for closed- circuit digital
camera surveillance system. (Police Department)
5 Prior to the issuance of the first building permit, the Applicant shall submit a construction site
security and management plan for review and approval by the Police Department. Non-
compliance with the approved security and management plan may result in a stop -work order for
the CPUD. (Police Department)
6 Prior to the issuance of the first Certificate of Occupancy for the building, the numerical
addresses shall be placed at the front of the building. The numerical address shall be illuminated
for nighttime visibility, with an uninterruptible A.C. power source, shall consist of twelve (12)
inch high numbers, and shall be a different color than the color of the surface to which it is
attached. The side door of the building shall have an illuminated 6 inch number on or alongside
the door /drive thru window. (Police Department)
7 Prior to the issuance of the first Certificate of Occupancy, buildings with a total square footage of
at least 10,000 square feet shall have roof top numbers placed parallel to the addressed street,
only visible from the air. The numerals should be blocked lettered, weather resistant material,
four feet in height and 18 inches wide. (Police Department)
Non- Certification Conditions of Approval:
Natural Surveillance
• Provide landscaping that does not create hiding spaces.
• Provide clearly marked transitional zones that indicate movement from public to
semi -public through use of brick pavers.
• Windows and exterior doors should be visible from parking area
• Parking areas should be visible.from windows not blocked by landscaping.
• Allow shrubbery to be no more than three feet high for clear visibility in vulnerable
areas.
All Structures shall be target hardened, to include but not limited to:
• Buildings shall be wired for an alarm system with silent alarm or panic alarm to notify
police in the event of a problem.
• Doors shall be equipped with metal plate over thresh- hold of the locking mechanism.
• Interior doors to offices shall have a 100 square inch vision panel.
• Case hardened commercial grade dead bolt locks shall be installed on all exterior doors
with minimum of one inch throw into the strike receiving the bolt. The cylinder shall
have a cylinder guard and a minimum of five -pin tumblers.
• Doors secured by electrical operation shall have a keyed - switch to open the door when
in a closed position, or by a signal locking device.
• Door detectors shall be installed to alert employees when persons enter the store.
• Place height markers on exit doors to help witnesses provide a more complete
description of suspects
• Glazing on interior /exterior doors and windows or impact resistant glass shall be
installed.
• Drive thru window shall have impact resistant glass or glazing. Shall also have a
mechanism installed to prevent the sliding glass window from being forced open or
lifted out of the track.
• Emergency doors shall have no exterior handle. Panic hardware shall have self locking
mechanism, may have one locking point and shall have a protective astragal attached to
the exterior of the door.
• South side exterior door shall have impact resistant glass vision panels inserted. Will help
with prevention of surprise attack when door opens.
• Enhance natural surveillance of restroom by placing them in central areas and install
maze entrances; avoid double door entry systems.
• A digital CCTV shall be installed which has the ability to produce an identifiable image
and to be able to be printed on scene, for identification purposes and to monitor
pedestrian usage. Camera system shall be installed not only inside the building to
monitor the front and rear doors and cash registers, but will also encompass the fuelling
areas to monitor gas thefts.
• Install convex mirrors and keep signs and shelves low, where they don't obstruct
employee view.
• Bicycle racks should be placed in close proximity to buildings and not within parking
lots.
• All hatchway openings to roof shall be secured from inside with a slide bolt or slide bars.
Outside hinges shall be equipped with non - removable pins.
• A drop safe or cash management devices shall be installed and maintained inside the
store at all times. The drop safe must offer protection against forced entry, while
providing a means for depositing currency, checks, coins and the like, or directly
deposited into the body of the safe.
• A conspicuous notice at the entrance which states that the cash register contains $50 or
less shall be posted.
• Window signage and window tinting must allow for a clear unobstructed view of the
cash registers and sales transaction area from inside or outside of the building and in a
normal line of site. The degree of window tinting shall allow for physical identification
of all individuals in the sales transaction area from outside the building and in a normal
line of sight at all times.
• A written cash management policy that is kept on site, limits the cash on hand at all
times after 11pm and before 5am, and provides for all the requirements of F.S.S.
812.1701 and 812.176, Chapter 2A -5.

I have reviewed the Land Development Regulations for the above referenced petition,
and provide the following comments for the DRC:
Certification Issues
1. In accordance with Section 78 -305 of the LDR, landscape plans should clearly
delineate and key landscape areas, landscape materials, and square footage of
open space and impervious areas. The applicant shall clarify what areas were used
in the calculation of required open space. The applicant shall provide
documentation showing what areas were designated as open space for the
property in CAD format on CD ROM. The CAD file will contain the DWG, DXF,
and DGN file extensions in version 2004 or earlier. The CAD file shall contain a
separate layer for each of the fo'lowing categories: property boundary, impervious
areas, pervious areas, and areas designated as open space. Open space shall
further be separated into perimeter buffers, easements, sod area and open space
used in the calculation of required landscape points. Each layer shall be clearly
labeled using the categories listed above. All drawings shall be defined as closed
polygons. Also provide these lavers printed on a plan page.
2. In accordance with Section 78 -306 of the LDR, all locations for proposed utilities,
easements, and light fixtures shall be shown on the landscape plan as to prevent
possible conflicts. The water lines are not shown from the meter to the building.
The FP &L box is shown, but the connection to the building is not. Please revise to
include all utilities and easements on the site plan and landscape plan, and provide
screening for all valves and FP &L equipment.
3. In accordance with Section 78 -228 (k)(3) of the LDR, the landscape buffer for
the road right of way should be 20 feet wide and the minimum landscape buffer is
8 feet. The Applicant has indicated the areas that do not meet the code, and has
requested a waiver, but the referenced code should be from the NBOZ. If the
drive through were eliminated from the proposed plan, this waiver would not be
necessary.
4. In accordance with Section 78 -228 (1)(1) of the LDR, minimum standards for
foundation landscaping and plantings. There are several parts missing from the
foundation plantings including: foundation landscaping required within 5 feet of
all facades of building, and 40 percent of the total length of the applicable side of
the structure required. The rear of the building is lacking any foundation plantings
because of the drive through lane, and other areas are less than the required width.
The Applicant is requesting a waiver, but the referenced code should be from the
NBOZ. If the drive through were eliminated from the proposed plan, this waiver
would not be necessary.
5. In accordance with Section 78 -225 (h)(8) Canopy trees are required every 30 feet
in the buffer. Please revise the plan to show a canopy tree or group of three palms
every 30 feet in the landscape buffers. This may also be a requirement not met in
the buffer along the south property line.
6. In accordance with Section78 -305 of the LDR, the surrounding landscaping
within 50 feet of the property shall be shown on the landscape plan. The
landscape plan shows the on site existing landscaping, but does not show the
offsite surrounding landscaping on the south property line and west property line.
7. In accordance with Section78 -228 (i)(3) of the LDR, perimeter walls and fences
shall be set back from property lines sufficiently to include landscaping on the
outside of the wall or fence. Please revise the plan to show the fence setback to
allow landscaping.
8. In accordance with Section 7S -324 of the LDR, the applicant shall provide a
beautification plan for the ro;id : houlder of Northlake Boulevard. Please revise the
landscape plan to show the sidewalk and landscaping for roadway beautification
similar to the Northlake Boulevard Task force design.
9. In accordance with Section 78- 228- (1)(3) of the LDR, foundation planting, at least
one shade tree or palm cluster shall be installed for each 30 linear feet or fraction
thereof of fagade width. The plan shows calculations for total of the facades,
instead of each facade individually. Please revise the plan to show meeting this
requirement for each facade of the building separately.
Non - Certification Issues
10. The sign at the northeast corner of the property appears to be in conflict with the
berm. The elevation appears to be indicated as 3 feet for the berm, which would
cover the base of the sign. Please revise.
11. On the plant list, the points are ;lot calculated for the sod. Please revise to include
points for sod at .25/10 square feel.
Also, please understand that additional information may be requested, and staff may have
additional comments as the review process continues.

• The applicant is requesting a concurrent review of the comprehensive plan, annexation, concurrency
certification and site plan. The applicant has provided the above documents to support their proposed
development. Comments on those reviews are provided under a separate memorandum.
• The applicant proposes to remove the existing gas station at the intersection of Military Trail and
Northlake Boulevard, which is currently in the county. The applicant proposes to replace the gas
station with a new gas station/convenience store and fast food restaurant with a drive thru facility.

pavement areas versus grass areas, easements, utilities, light fixtures, etc.
3. The applicant shall clearly identify the existing facilities that are to remain or be replaced by the
proposed design, on the site plan and engineering plan, for conformance with Section 78 -46 of the
LDR.
4. The applicant shall revise the note, on the site plan (Sheet SP -1), for conformance with the
following, "All pavement marking and striping,. excluding parking stalls, shall be installed with
thermoplastic materials. Also, paver bricks of appropriate color shall be used on paver brick areas,
in lieu of paint or thermoplastic material," in accordance with Section 78 -344 of the LDR. The
applicant is advised that the wording of the current note, on the site plan, does not agree with the
requirements of Section 78 -344 of the LDR,
5. The applicant shall add a note to the plan indicating that "All parking stalls shall be marked by
double stripes for conformance with Section 78 -344 of the LDR ".
6. The applicant shall revise the note, on the site plan (Sheet SP -1), for conformance with the
following, "All trees and landscaping will be field located to avoid conflict with the existing and
proposed utilities, light poles, drainage lines and lake maintenance easements."
7. The applicant shall revise the notes, on the site plan (Sheet SP -1) regarding handicap ramps to
indicate that all curb ramps shall conform to the FDOT Index 304 and ADA requirements for
truncated dome surface, as these ramps are external to the building and therefore do not come under
the FBC regulations.
9. The applicant shall provide cross sections of the site at all boundaries from the proposed buildings,
clearly showing how the site matches existing conditions, per Section 78 -46 of the LDR.
9. The applicant shall show and label the location and proposed pipe material for any proposed roof
drains on the engineering plan for conformance with section 78 -46 of the LDR. The applicant is
advised that the use of RCP, DI, SDR -26 PVC or C -900 PVC are considered acceptable materials for
roof drains under pavement sections.
10. The applicant shall identify the control structures (label "CS ") on the site plan and landscape plan,
consistent with the engineering plan, for conformance with Section 78 -46 of the LDR.
11. The applicant shall provide the following information on the landscape plan to address clearance
between existing and proposed trees and the proposed control structure:

13. The applicant shall identify and dimension a minimum width of ten feet for the pass -by lane for
conformance with Section 78- 373(4)(b).
14. The applicant shall identify the stacking distance for the drive -thru lane, clear of the bypass lane, for
conformance with Section 78 -230 of the LDR, which specifies that adequate stacking distance (120')
shall be provided for six vehicles per lane at 20 feet per vehicle. This distance shall be measured
from the center of the drive thru window to the point at which there is adequate clearance to utilize
the by pass lane.
15. The applicant shall dimension the proposed minimum sidewalk width at the building entry, from the
curb to the face of the roof columns and from the back of the roof columns to the building, for
conformance with Section 78 -506 of the LDR. The applicant is advised that the sidewalks width
shall be a minimum clear area width of five (5') feet, excluding the vehicle overhang area, in
accordance with Section 78 -506 of the LDR.
16. The applicant shall show and label all existing and proposed handicap ramps (identify as "HC" or
"CR "), on the site plan, at all locations where sidewalk intersects the raised curb for conformance
with Section 78 -46 of the LDR. Where the walk is proposed to be flush with the pavement, to avoid
the ramp requirement, the walk shall be labeled as flush walk ( "FW "). At the time of construction
plan review the applicant shall identify all curb ramps with the appropriate FDOT Index 304 curb
ramp number.

17. The applicant shall review and revise the site plan, landscape plan and engineering plan for
consistency, as to the location of existing and proposed curb ramps, for conformance with Section
78 -46 of the LDR.
18. The applicant shall clarify what appears to be a proposed ramp on the west side of the west entrance
roof overhang, on the site plan (Sheet SP -1) for conformance with Section 78 -46 of the LDR. This
location does not appear to be correct for the walks as shown.
19. The applicant shall provide a curb ramp, on the site plan and landscape plan, for the handicap access
aisle per ADA/FDOT requirements.
20. While the photometric plan agrees with the intent of the requirements of Ordinance 26, 2006 and the
City's Lighting Regulations, we would suggest that the applicant review the area immediately
outside the front entrance, which is shown to be below the minimum level, due to the intended use of
the area. The walls in this area is shown to have 0.50 fcs, which is below the minimum 0,60 fcs for
the pedestrian area, and the parking area is shown to have 0.70 fcs, which is below the minimum
1.00 fcs for the vehicle area. As these are random shots and the overall average is acceptable, as
noted we would suggest the applicant consider modifying the design in this area.
21. The applicant shall provide a dimensioned detail of the proposed lighting fixture and pole for
conformance with Ordinance 26, 2006 and the City's Lighting Regulations.
22. The applicant shall revise the drainage statement to indicate Northern Palm Beach County
Improvement District (NPBCID) as it currently states NPNCID.
23. The applicant shall provide a revised drainage statement to indicate that they shall also conform to
SFWMD (No Notice Permit) criteria and the City of Palm Beach Gardens drainage requirements, as
the applicant proposes annexation into the City of Palm Beach Gardens,

The applicant shall provide complete horizontal control of the project sufficient to construct the
project and determine the dimensions of all site improvements.
2. The applicant shall clearly show, label and dimension the engineering plan, to clearly identify all
existing and proposed site feature including but not limited to- curb (noting type), curb radii,
pavement width, drive aisle width, pavement radii where curb is not proposed, sidewalk and their
width (including public sidewalks on adjacent street right -of- ways), handicap ramps (labeled "HR"
or "CR "), flush walk with pavement (" rW "), raised walk in lieu of curb along the edge of the
pavement, parking stalls (standard and handicap), pavement areas versus grass areas, easements,
utilities, _light fixtures, etc. _
3. The applicant shall clearly identify the existing facilities that are to remain or be replaced by the
proposed design, on the engineering plan.
4. The applicant shall provide a note on the plan stating, "All pavement marking and striping, excluding
parking stalls, shall be installed with thermoplastic materials. Also, paver bricks of appropriate
color shall be used on paver brick areas, in lieu ofpaint or thermoplastic material."
5. The applicant shall add a note to the plan indicating that "All parking stalls shall be marked by
double stripes for conformance with Section 78 -344 of the LDR ".

6. The applicant shall add the following note to the plan, "Handicap parking signs shall be placed
behind the sidewalk in areas where sidewalk abuts the stall and outside the two and a half (2 %z ) foot

8. The applicant shall add a note to the engineering plan regarding the City's requirement for the taking
of tests to certify the minimum compaction specifications. The City's specifications shall apply,
except where the specific requirements of contract documents or Seacoast Utility Authority are
greater. The note shall read,
"Density Tests for trenches shall be taken in maximum one (1) foot lifts, measured from the top
of pipe. The tests shall be taken, at a maximum spacing of every 300 feet measured from the
structure, or at least one test at the center of the pipe segment between two structures if less than
300 feet, Where the pipe section crosses an existing or proposed paved area, at least one test
shall be taken of each backfill lift. Tests shall also be taken, on alternating sides of the structure
with each lift tested. The test location at the structure shall be ivithin five (5) feet of the
- structure. The location and depth of all tests shall be clearly indicated in the description area on
the test report and'or on a location map which shall he attached to the test report. Required
testing at structures shall include all inlets, manholes, culverts, vaults, and valves within any
paved area."
The applicant is further advised that the testing lab or engineer -of- record shall certify, on the test
report, the lift thickness for all subgrade, base and pavement tests taken for construction.
9. The applicant shall add a note to the plan indicating that "All existing and proposed structure rim
elevations shall be set to finished surface grade, unless otherwise specifically noted on the plan. This
shall include all sewer, water and drainage structures. " Where the design proposes that the structure
rim shall be set above or below the finished surface grade, the applicant shall show and label both
elevations clearly on the plan view.
10. The existing drainage system appears to be designed for on -site retention which is non - functioning.
Applicant shall clarify the intent of the existing system and what portion is any shall be utilized in
the proposed design.
11. The applicant shall submit signed and sealed drainage calculations (for pipe sizing), along with a
drainage area map indicating the drainage area for each contributtng,,strupture for the review of the

13. The applicant shall show the minimum road, building floor and perimeter berm elevations per flood
routing calculations for the SFWMD permit, on the Drainage Plans,
14. The applicant shall demonstrate, how the site and access drive will drain, through use of flow arrows
and illustrated high/low points.
15. The applicant shall clarify the abandonment of the existing non functioning storm sewer system.
16. The applicant shall show and label the location and proposed pipe material for any proposed roof
drains on the engineering plan. The applicant is advised that the use of RCP, DI, SDR -26 PVC or C-
900 PVC are considered acceptable materials for roof drains under pavement sections.
17. The applicant shall provide a typical cross - section of the flexible pavement areas specifying the
asphalt, base and stabilized subgrade meeting the requirements of Section 78 -499, Table 41 of the
LDR.
18. The applicant shall indicate the structural numbers for the `Asphalt Section (Typ.)' and the
`Vehicular Concrete Pavers' section detail on the Engineering Detail Sheet in accordance with
Section 78 -499 Table 41 of the LDR. The applicant shall provide a table indicating the layer,
material, LBR/FBV, material thickness, FDOT layer coefficient; the SN for the pavement section,
base section, and subgrade section; and the total SN for the total pavement section and the required
SN in accordance with
the FDOT Flexible Design Manual.

22. The applicant shall provide a detail showing filter fabric, wrapped around all pipe joints, a minimum
2 feet wide on center and overlapped by 2 feet per FDOT Index 280. The applicant shall also
reference FDOT Index 199, which specifies the required geotextile material for the pipe wrap.
23. The applicant shall provide a detail of the required truncated dome for the curb ramps conforming to
FDOT Index 304, or add a specific reference to the requirement of the truncated dome ramp surface
in accordance with FDOT Index 304.
24. The ADA requires that the detectable warning extend the entire length and width of the ramp. The
applicant is advised that while the City uses both the FDOT and the ,DA STANDARDS FOR
ACCESSIBLE DESIGN, where the ADA requirements exceed the FDOT standards the ADA
standards shall prevail.

A curb ramp shall have a detectable warning complying with 4.29.2. The detectable warning
shall extend the full width and depth of the curb ramp.

on Walking Surfaces. Detectable warnings shall consist of raised truncated domes with a

25. The applicant shall provide a cost estimate for the project, including public infrastructure and all
landscaping and irrigation costs for review and approval by the City in order to establish surety. The
cost estimate shall be signed and sealed by an engineer and landscape architect registered in the state

The applicant is advised of the following:
• Following site plan approval, the applicant shall provide construction plans for review and
approval of the City Engineer for conformance with the conditions of approval noted above.
Following construction plan approval and prior to issuance of the first permit for construction,
the applicant shall provide two (2) full sized (24" x 36 ") sets of signed and sealed construction
plans as approved, along with one (1) signed and sealed 11" x 17" plan set and one (1) CADD
or PDF copy of all of the construction plan sheets.
The electronic copy shall have a note on the cover sheet identifying it as the final set of
approved construction plans (or for construction). The final construction plan set shall include
the full engineering plans, stormwater management plans, sewer and water plans, all detail
and other supplemental sheets.
The applicant shall provide a written response to all comments, indicating acknowledgement of
each comment and how each comment has been addressed. Compliance will expedite the
subsequent review. It is suggested that the applicant clearly identify all changes to the plans by either
"clouding ", or highlighting, the location of all changes to further expedite the review.
The applicant is reminded that all submittals are to be made to the City of Palm Beach Gardens
Growth Management Department.
