CITY OF PALM BEACH GARDENS PLANNING, ZONING AND APPEALS BOARD REGULAR MEETING July 9, 2013 CALL TO ORDER 6 The regular meeting was called to order at 6:00p.m. by Chair Hansen. 7 II. PLEDGE OF ALLEGIANCE 8 ill. ROLL CALL 9 Members Present: 10 Chair Randolph Hansen, Michael Panczak, Roma Josephs, Charles Hathaway, Howard 11 Rosenkranz, Robert Savel, Meriel (Honey) Bryan (arrived at 6:20p.m.) sitting for Vice Chair 12 Douglas Pennell · 13 Members Absent: Vice Chair Douglas Pennell. 14 Also Present: City Attorney, R. Max Lohman; Director of Planning and Zoning, Natalie Crowley. 15 IV. ADDITIONS, DELETIONS, MODIFICATIONS 16 None. 17 V. REPORT BY DIRECTOR OF PLANNNING AND ZONING: NATALIE 18 CROWLEY 19 Reported at the June 6, 2013 City Council Meeting, the Legacy Place Master Signage and the 20 Franklin Charter School Application was approved; the Renaissance School was not approved, 21 the applicant withdrew the petition; the September Planning, Zoning and Appeals Board meeting 22 is rescheduled to September 17, 2013; introduced Principal Planner, Kristen Tetsworth; 23 announced that a petition was submitted for Vavrus Property to the Planning and Zoning 24 Department. 25 VI. APPROVAL OF MINUTES 26 Board Member Hathaway made a motion to approve the minutes from the May 14, 2013 27 meeting and June 4, 2013 meeting. 28 Board Member Rosenkranz seconded. 29 Motion passed 6-0. 30 VII. PUBLIC HEARINGS 31 Chair Hansen asked for any exparte. 32 Board Member Hathaway yes. 33 Chair Hansen yes. 34 Those preparing to give testimony were sworn in. 35 1. Recommendation to City Council (Public Hearing)-QUASI-JUDICIAL HEARING 36 MISC-13-05-000095 -Gardens Plaza PUD A request from the property owner for an 37 amendment to the Gardens Plaza Planned Unit Development (PUD) to allow a principal tenant sign 38 to exceed the maximum permitted square footage. The subject site is generally located on the 39 southeast corner ofPGA Boulevard and Fairchild Gardens Avenue. 40 Chair Hansen opened the public hearing. 41 Petitioner: Anne Booth, Urban Design Kilday Studios. 42 StaffPresentation: Director of Planning and Zoning, Natalie Crowley. 43 Public comment: None. 44 Chair Hansen closed the public hearing. 45 Board Member Josephs made a motion to approve MISC-13-05-000095 -Gardens Plaza PUD. 46 Board Member Rosenkranz seconded. Recommendation to City Council (Public Hearing) -QUASI-JUDICIAL HEARING 3 PPUD-13-03-000029 -Trinity United Methodist Church A request by Kolter Acquisitions, 4 LLC for the rezoning of approximately 8 acres of property located at the northeast comer of East 5 Island Avenue and Gardenia Drive from Residential Low-3 (RL-3) to a Planned Unit Development 6 (PUD) Overlay with an underlying zoning designation of Residential Low-3 (RL-3). The Applicant 7 is requesting approval of a site plan to accommodate a 21 home subdivision and an update to the 8 Trinity United Methodist .Church master plan. 9 Chair Hansen opened the public hearing. , 1 o Petitioner: Donaldson Hearing, Cotleur and Hearing. 11 Staff Presentation: Senior Planner, Peter Hotheinz. 12 Public Comment: None. 13 Chair Hansen closed the public hearing. 14 Board Member Hathaway made a motion to approve PPUD-13-03-000029 -Trinity United 15 Methodist Church. 16 Board Member Rosenkranz seconded. 17 Motion passed 7-0. 18 3. Recommendation to City Council (Public Hearing) -QUASI-JUDICIAL HEARING 19 PUDA-12-10-000046 -The Learning Experience Day Care at the LA Fitness Plaza A 20 request from DIY Palm Beach Gardens, LLC, for approval of an amendment to the LA Fitness 21 Plaza Planned Unit Development (PUD) to construct a 10,000-square-foot child development day 22 care center with 180 students. The LA Fitness Plaza PUD is located at the southwest comer ofPGA 23 Boulevard and the Florida Turnpike. 24 Chair Hansen opened the public hearing. 25 Petitioner: Ken Tuma, Urban Design Kilday Studios. 26 StaffPresentaion: Senior Planner, Peter Hotheinz. 27 Public comment: None. 28 Chair Hansen closed the public hearing. 29 Discussion ensued regarding improvements to the back elevation of the building. 30 Board Member Rosenkranz made a motion to approve PUDA-12-10-000046-The Learning 31 Experience Day Care at the LA Fitness Plaza. 32 Board Member Savel seconded. 33 Motion passed 7-0. 34 4. Recommendation to City Council (Public Hearing) -QUASI-JUDICIAL HEARING 35 CUMJ-12-10-000025 -The Learning Experience Day Care at the LA Fitness Plaza. A 36 request from DIY Palm Beach Gardens, LLC, for approval of a Major Conditional Use for a 37 10,000-square-foot child development day care center with a 180 students located within the LA 38 Fitness Plaza Planned Unit Development (PUD). 39 Chair Hansen opened the public hearing. 40 Petitioner: Ken Tuma, Urban Design Kilday Studios. 41 Staff Presentation: Senior Planner, Peter Hotheinz. 42 Public comment: None. 43 Chair Hansen closed the public hearing. 44 Board Member Rosenkranz made a motion to approve CUMJ-12-10-000025 -The Learning 45 Experience Day Care at the LA Fitness Plaza. 46 Board Member Savel seconded.
