Recommendation to City Council (Public Hearing) ANNX-13-07-000006: A 1.68-acre Parcel Annexation A request on behalf of the property owners, David E. Mackey and Roan Lane, LLC, to annex a 1.68-acre parcel (former Capital Lighting building and parking lot), generally located on the northeast corner of Northlake Boulevard and I-95. Exact legal description and/or survey for the cases may be obtained from the f iles in the Growth Management Department. g:\p&z_share\administration\pzab agenda\p & z agenda 2013\08.13.2013\pzab agenda 09.17.2013.docx City of Palm Beach Gardens A 1.68-acre Parcel Voluntary Annexation ANNX-13-07-000006 Planning, Zoning, and Appeals Board September 17, 2013 Request from the owners, Roan Lane, LLC., and David Mackey for a voluntary annexation Subject Request Florida Statutes Section 171.044 Voluntary Annexation Statutory Criteria 1.Owner of property that is contiguous to a municipality and reasonably compact may petition for a voluntary annexation. –Owner requested annexation –Site is contiguous to City on two sides –Site is reasonably compact Statutory Criteria 2.Ownership and public notice requirements a.Petition must bear signatures of all property owners b.Ordinance shall be passed after being published at least once for 2 consecutive weeks in a newspaper. c. Notice shall give the ordinance number and brief description of area with a map. –All property owner signatures received –Public notice for the adoption meeting will be published as required (tentatively scheduled for the November 7, 2013 City Council meeting) Statutory Criteria 3.Ordinance shall be filed with clerk of the circuit court and chief administrative officer of county within 7 days of adoption. –Ordinance will be filed within 7 days of the adoption meeting Statutory Criteria 4.This method of annexation is supplemental to any other procedure provided by general or special law, except this section shall not apply to municipalities in counties with charters which provide exclusive method of municipal annexation. –Palm Beach County does have additional notification requirements for Voluntary Annexation in its Charter, which were met Statutory Criteria 5.Annexed land shall not result in creation of enclaves.
