SUBJECT: Update on PGA Flyover Art
As requested at the May 20, 2008, AIPP meeting, staff is providing an update on the remediation
between the City and Ms. Wendy Ross (please see enclosed Memorandum of Agreement). Wendy
Ross and her subcontractor, Oceaneering International, Inc., who installed the sculpture, have
cooperated with the City in seeking a remedy for the rusting which was caused by a defect in the
manufacturing of the stainless steel mesh which was purchased from a Chinese manufacturer.
Both Ms. Ross and Oceaneering International state that they complied fully with the stainless steel
specifications set forth and accepted by the City and were unaware that the mesh contained wire
strands that were not stainless steel as had been specified and ordered. The problem was never
structural, but was of an aesthetic nature. Ms. Ross and Oceaneering International are fully
honoring their warranty to ensure the integrity and beauty of the sculptures.
In order to put into effect the remediation plan, the florets that contain the stainless steel mesh
were removed from the towers on May 21, 2008. The entire process should be completed within 8
weeks of commencing the remediation. When the remediation is complete, an additional one -year
warranty period will commence.

MEMORANDUM OF AGREEMENT

T 1S MEMORANDUM OF AGREEMENT is entered into this day of
2008, by and between Wendy Ross /Ross Sculpture Studio
(he inafter referred to as "Artist ") and the City of Palm Beach Gardens, a Florida
municipal corporation (hereinafter referred to as "City ")
WHEREAS, the Artist and the City entered into an Agreement on October 28, 2005,
for the design, fabrication, and installation of four sets of artwork in four towers located on
the PGA Boulevard Flyover in Palm Beach Gardens; and
WHEREAS, the four sculptures were completed and installed and finally ac ce ted
by the City on November 8, 2006; and 7
WHEREAS, after installation, certain discoloration, staining, and corrosion occurred
on the "floret" portions of the artwork; and
WHEREAS, the Artist has provided the City with a remediation plan to correct the
deficiencies and has agreed to an extended warranty upon completion of the remediation.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, it
is hereby agreed as follows:
The Artist shall within 7 days of the execution of this Memorandum of
Agreement ensure that the Remediation Process identified in the "PGA
Flyover Sculpture Remediation Plan (Revised)" attached as Exhibit A
commences. Said work is estimated to be completed within eight weeks of
initiation of the remediation work, subject to the removal and reinstallation
times designated by the City in paragraph 2 below.
2. The Artist shall notify the City five business days prior to the date the florets
will be removed from the towers and replaced in the towers. The Artist shall
be responsible for the removal and reinstallation which shall be performed at
times designated by the City, and the City shall be responsible for
coordinating and executing the Maintenance of Traffic Plan for the time
periods of removal and reinstallation.
3. The Artist provides the City with an additional one -year warranty from the date
the florets are reinstalled ensuring that the corrosion of the wire in the florets
which led to the staining that previously occurred does not recur during the
warranty period, provided that the City has performed the maintenance
described in paragraph #4 below. The provisions of said warranty are
attached hereto as Exhibit B.
4. The City shall, upon reinstallation of the artwork, perform the maintenance
described in the "Revised Remediation Plan ", consisting of spraying the entire
sculpture every two months with fresh water under low pressure, as more
particularly described in the Maintenance section of that plan, and shall
furnish the Artist with a copy of maintenance records upon her request.
Specific procedural details are contained in the Standard Operating Procedure
#32 attached hereto.
5. The Artist, or her agents, shall be permitted to inspect the florets during the
one -year additional warranty period.

PGA Flyover Sculpture Remediation Plan (REVISED)
Background: There are sixteen florets in the four towers that are part of the PGA Blvd
Flyover art work. The floret framing is constructed from l .inch and' /. inch diameter 316
SS round bars that are welded to a triangular shaped base frame that is fabricated from 304
SS rectangular tubing. The floret is covered with 316 SS woven wire cloth that is "sewn" to
the floret framing using 316 SS wire.
There are four florets in each tower that are bolted to a carbon steel fabricated pedestal.
Each pedestal was abrasively blasted to "near white" condition and then painted with a
three step moisture cured urethane paint system, Coronado Coroguard.
Although the woven wire cloth was sold as 316 SS by the supplier, on detailed inspection
of the art work, there are regularly spaced wires that are not 316 SS, which are corroding
and staining the surrounding stainless steel components and the coated carbon steel
pedestal.
Removal: Ross Sculpture Studios / Oceaneering proposes the following:
Remove the florets from each tower, without affecting the light fixtures.
Palletize and ship the florets to Oceaneering's manufacturing facility.
Documentation: Upon arrival, Oceaneering will photographically record the stained
conditions on the floret.
Remediation Process:
Oceaneering will choose one floret ( "test floret ") to determine the most effective
remediation procedure, utilizing the following process:
1. Wash floret down with fresh water.
2. Wash floret stains using a mixture of Tide laundry soap powder and pumice
on a wet cloth.
3. Brush on a mild version of industrial pickling gel (contains nitric acid and
hydrofluoric acid) on the 316 SS stainless steel woven wire cloth in the area of the
vertical and .horizontal line stains and the adjacent stainless steel components that
are also showing signs of staining. We will continue going up in strength until the
desired results are achieved.
4. The gel will remain on the floret for a minimum of 10 minutes and up to 60
minutes for each coating. This process should erode away the random, errant wire
in the woven wire cloth and also remove all staining on the adjacent components,
both 304 SS and 316 SS.
5. The process will be repeated until the random, errant wire is totally removed.
6. The pickling paste will be applied to the heat tint areas on the 304 SS floret
base, as well as the surface areas that contain embedded iron.
7. The entire floret will be cleaned with mild soap and water using a low
pressure washer.
8. At the conclusion of the above process, the test floret will be shipped to a
Maryland located independent test firm for analysis of the remediation results. This
analysis will consist of ASTM A -380, specifically the ASTM A 380 -06 Standard
Practice for Cleaning, Descaling, and Passivation of Stainless Steel Parts,
Equipment, and Systems, Section 7.2.5.1- Water - Wetting and Drying method.
9. PBG and Mateo are invited to attend the test, as Oceaneering and Cormat
will also be present. Both Cormat and Mateo will then report their findings on the
analysis.
10. If it is determined by Cormat and Mateo that the analysis results indicate
successful remediation, the remaining fifteen florets will be treated using the same
process.
a. If Cormat and Mateo cannot come to an agreement on the findings of
the analysis, the City of Palm Beach Gardens and Ross Sculpture Studio (as
assisted by Oceaneering) will confer on further actions with respect to the
floret remediation.
11. The florets will be shrink- wrapped or protected by other means to prevent
contamination in transit.
12. While the florets are removed from the site, Oceaneering will wash down
the spheres with fresh water that will be furnished to the project site by the City of
Palm Beach Gardens.
13. Concurrently with the above, Oceaneering will, on the project site,
mechanically remove the corroded spots and any loose paint on the pedestals. These
areas will be treated with the equivalent rust inhibiting primer and then touched up
with a top coat from the original moisture cured urethane paint system.
Re- Installation: After all of the florets have been processed, Oceaneering will reinstall the
florets in the towers. In addition, Oceaneering will apply 3M 5200 Marine Sealant to the
faying surfaces between the florets and the pedestal, as well as around the ground wire
connections on the pedestal to prevent water intrusion.
Duration of Remediation: For estimation purposes, we estimate that the above
remediation plan will take a total of six to eight weeks: one week for removal of the florets,
five to seven weeks for the remediation (including the test floret remediation and analysis),
and one week for installation. Oceaneering will be able to initiate this remediation plan
based on the start date of November 28, 2007.
Maintenance:
The following maintenance schedule is recommended:
Every two months, the PBG maintenance staff should spray the entire
sculpture with fresh water with low pressure. It is recommended that the sphere is
the first component to be sprayed, followed by the florets and then conclude by
spraying the floret base and pedestal. As the sphere may continue to drip water
onto the lower elements of the sculpture, it is also recommended that some time
should pass before spraying down the lower elements of the sculpture to ensure the
sphere has adequately finished dripping. During the spraying of the sculpture, it is
recommended to cover the light fixtures.
WARRANTY OF QUALITY AND CONDITION
Wendy M. Ross /Ross Sculpture Studio LLC represents and warrants to the City of Palm
Beach Gardens that:
1. The remediation of the florets as provided for in the remediation plan set forth
in Exhibit A to the Memorandum of Agreement between the City, of Palm Beach
Gardens and Wendy M. Ross /Ross Sculpture Studio dated fibal iy ,
2008, addressing remediation of the florets, will be performed in 'a professional
manner.
2. The florets, as remediated and reinstalled, will be free of defects in material
and workmanship, including any defects in the floret screens caused by:
a. "inherent vice" qualities which cause or accelerate corrosion of the wire
in the florets which led to the staining that previously occurred, or
b. Negligence in the reinstallation for the florets.
This Warranty will extend for a period of one year from the date of
reinstallation of the florets, provided that the City has performed the
maintenance described in paragraph 4 of the Memorandum of Agreement
3. Maintenance of the florets will not require procedures other than those
described in the remediation plan set forth in Exhibit A and as generally
described under paragraph 4 of the Memorandum of Agreement.

Intent:

Scope:
The scope of this work is to assure that the recommended maintenance schedule is
followed as provided by the art work consultant dated November 12, X007,
Procedures:
1. Every two (2) months, Facilities Maintenance staff will spray the art with fresr
water using low pressure. Work will begin from the top (sphere), followed by the
florets, and conclude spraying the floret base and pedestal. It will be necessary t(
allow the sphere to finish dripping prior to spraying the florets and floret base an(
pedestal.
2. Cover all light fixtures adjacent to the art work to assure no water intrusior
occurs.
3. All maintenance activities will be entered on the daily work log every time thi;
work is completed to include the following information: date(s) of activities, time o
day, staff utilized, work hours, maintenance of traffic signs /cones /barricades, an(
equipment needed to perform work,
4. Provide photographs of the art work, .upon completion of the above maintenancE
activities.
5. The Facilities Maintenance Superintendent will assure that all record keeping ant
documentation will filed in', the Public Works Division and copies provided to the
City Manager's office.

BACKGROUND
On May 1, 2008, the City Council adopted Ordinance 5, 2008 and Resolution 26, 2008,
for the master site plan amendment of the North County Government Center Planned
Community Development. Concurrently with the PCD master site plan, the City Council
adopted Resolution 27, 2008, which consisted of a site plan approval for the construction
of a 14,612 square -foot addition to the North County Regional Library.
DISCUSSION
Elayna Toby Singer, Palm Beach County, appeared before the Art in Public Places
Advisory Board for a workshop on November 20, 2007, to discuss with the Board the
idea of placing the public art inside the expansion of the North County Regional Library.
The Board was unanimously pleased with the idea and encouraged the applicant to move
forward with their Call to Artists and related scope of work for the intemal/functional
public art.
On February 19, 2008, Elayna Toby Singer presented three artists and examples of their
work; Garth Edwards, Maureen Melville, and Gary L. Moore. The Board recommended
Garth Edwards to the Palm Beach County's Public Art Committee, which appointed
Garth Edwards as the final artist and unanimously approved his proposed art/architecture,
integrated design.
In accordance with Section 78- 261(d) of the Land Development Regulations entitled
Requirements for art or fee in lieu of art, all budgets for new construction of private and
public developments shall include one percent (1 %) of the total budget for vertical
construction as a fee for art in public places. The subject fee shall be utilized by the
developer for the provision of artwork on the project site, or the developer may choose to
contribute one percent (1 %) of the total vertical construction costs directly to the City for
the provision of art on public property.
Vertical construction costs for the North County Regional Library are estimated at
$6,563,479 which includes the 1% allocation for public art. The budget for the proposed
AIPP program is $65,654. The public art allocation breaks out as follows: $900 ($300
each) to honoraria for the three semi - finalist artists, $13,100 for the design fee to finalist,
and remaining $51,564 for materials, fabrication and installation.
PROPOSED ART IN PUBLIC PLACES AND LOCATION
The artist Garth Edwards (please see attached artist resume), is proposing a gardenesque,
small town atmosphere reflected in the library's indoor architectural and interior design
components, including the carpeting, furniture, fabrics and public art installation. This is
based on the research of John D. MacArthur's vision of street lines with flowers and
trees. The library will be designed so that patrons "stroll" down a central "street" and axis
that links the old library with the new expansion. Similarly, circulation paths or side
"streets" are designed to draw patrons to different "neighborhoods" or sections of the

library. As patrons progress through the "garden town," floral motifs and organic leafy
shapes guide them from one area to the next. The public art components are central to
this experience and were designed to integrate into three key areas: 1) the central axis of
"town" where a colorful vine beautifies the environment; 2) the youth/family
"neighborhood" patrons are drawn into a colorful garden passage; and 3) when family
patrons are ready to leave, they will "stop" at the youth book check out desk which
provides a final destination before exiting the garden passage (please see designs
attached in the PowerPoint presentation).
STAFF RECOMMENDATION
Staff is recommending approval of the subject petition with the following condition of
approval:
1. The Applicant shall submit digital photographs of the installed artwork within
sixty (60) days of completion. (Planning and Zoning)
2. Prior to the acceptance of the art for the North County Regional Library, the
Applicant shall submit a copy of its logo and any mission statement of its
organization, with authorization for the City to use such information in future
publications. The artist name, title of artwork, and description shall be included.

BACKGROUND
The Doubletree Hotel PUD was originally approved as a Holiday Inn/MacArthur's
Vineyard in 1968. The development order was amended in 1997 by way of Ordinance 14,
1997 to allow for a rezoning to PUD, and an expansion/renovation of the hotel.
Furthermore, Resolution 128, 2006, amended the PUD to allow for a 12,900 square -foot
pharmacy with two drive -thru lanes, a 154,191 square -foot self - storage building on the
northern portion of the PUD. The most recent amendment to the Doubletree Hotel PUD
was approved by City Council on February 21, 2008, which allowed for the addition of a
15,358 square -foot Executive Meeting Center on the southern portion of the PUD.
DISCUSSION
The artist, Mark Fuller, representing the owner of the property, appeared before the Art in
Public Places Advisory Board for a workshop on May 20, 2008.
In accordance with Section 78- 261(d) of the Land Development Regulations entitled
Requirements for art or fee in lieu of art, all budgets for new construction of private and
public developments shall include one percent (1 %) of the total budget for vertical
construction as a fee for art in public places. The subject fee shall be utilized by the
developer for the provision of artwork on the project site, or the developer may choose to
contribute one percent (1 %) of the total vertical construction costs directly to the City for
the provision of art on public property.
Under the provisions of Section 78- 261(d)(1)a.l. of the City's Land Development
Regulations entitled Deposit of funds, prior to the issuance of a building permit the
petitioner is required to place $30,597 into an escrow account, which represents an
estimate of one (1 %) percent of the estimated total cost of vertical construction on site,
which the applicant has done. The budget for the proposed AIPP program is $30,597.

PROPOSED ART IN PUBLIC PLACES
The artist is proposing an artwork that will utilize recycled, recyclable and salvaged
materials, as well as solar powered lighting. The artwork is entitled "ArcSolar" and will
consist of two structural aluminum arc forms. The primary and taller arc will be 10 feet
in height and the shorter arc will be 48 inches. The main arc will have four columns
approximately 30 inches in height. The columns will be composed of recycled louvre
glass and crushed bottle glass, and will be internally illuminated by LED lights. A solar
ovonic panel membrane will be mounted on the primary arc which will provide the power
for the nine diode LED lamps that will be concealed within the arc structure, beneath
each glass column. (Please see attached project description and images).

PROPOSED LOCATION FOR ART
The applicant is proposing one (1) location for the public art:
1. The proposed art is placed on the south side of the Doubletree Hotel PUD, within
an island near the entrance of the Hotel, as this proves to be the most appropriate
and visible location.
The proposed location is consistent with Land Development Regulations Section 78 -262
as follows:
• Visibility: The proposed public art location is visible to both internal and external
pedestrian and vehicular traffic.
• Lighting: The art will be internally illuminated in a way so that only the glass
columns are illuminated. The intention of the artist is to create the effect that the
glass columns are floating in the air.
STAFF RECOMMENDATION
Staff is recommending approval of the subject petition with the following conditions of
approval:
1. The Applicant shall submit digital photographs of the installed artwork within
sixty (60) days of completion. (Planning and Zoning)
2. Prior to the acceptance of the art for the Doubletree Executive Meeting Center,
the Applicant shall submit a copy of its corporate logo and any mission statement
of its organization, with authorization for the City to use such information in
future publications. The artist name, title of artwork, and description shall be
