HomeMy WebLinkAboutResolution 49-17 - Creating the 2017 Charter Review Committee1 RESOLUTION 49, 2017 2 3 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM 5 BEACH GARDENS, FLORIDA, CREATING THE 2017 CHARTER 6 REVIEW COMMITTEE; PROVIDING A PURPOSE, POWERS, 7 DUTIES, MEMBERSHIP, AND MEETINGS; PROVIDING AN 8 EFFECTIVE DATE; AND FOR OTHER PURPOSES. 9 10 11 WHEREAS, Section 22-1 of the Charter of the City of Palm Beach Gardens 12 provides : "As often as the council may deem necessary, but in any event, not less 13 frequently than every five years, the terms and provisions of this Charter shall be 14 reviewed ."; and 15 16 WHEREAS, on November 12, 2010, the City Council directed the City Attorney to 17 review and recommend amendments to the City Charter, in whole and/or in part , resulting 18 in proposed Charter amendments, which were presented to the electors of the City on 19 November 6, 2012; and 20 21 WHEREAS, Section 2-83, Code of Ordinances, provides that the City Council may, 22 by resolution, create a committee whose purpose is to advise the City Council on an item 23 of a special nature and whose creation is for a stated period of time, at the end of which 24 time the committee will no longer exist; and 25 26 WHEREAS, Section 2-83, Code of Ordinances, further provides that the resolution 27 creating such committee shall specify the purpose, powers, and duties of the committee, 28 and shall specify the number, qualifications , and terms of office of the members thereof; 29 and 30 31 WHEREAS, the City Council deems approval of this Resolution to be in the best 32 interest of the health, safety, and welfare of the residents and citizens of the City of Palm 33 Beach Gardens and the public at large to establish a Charter Review Committee. 34 35 36 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 37 OF PALM BEACH GARDENS, FLORIDA, that: 38 39 SECTION 1. The foregoing recitals are hereby affirmed and ratified. 40 41 SECTION 2. Creation. 42 43 There is hereby created the 2017 Charter Review Committee. Purpose. 2 3 The primary purpose of the 2017 Charter Review Committee is to review the terms 4 and provisions of the City of Palm Beach Gardens Charter and to make written 5 recommendations to the City Council concerning any proposed amendments considered 6 appropriate for review according to the following schedule: 7 8 Final report due: October 12, 2017 9 10 SECTION 4. Powers and Duties. 11 12 The Committee will be directed to carry out the following powers and duties: 13 14 (1) Review the terms and provisions of the City Charter. 15 16 (2) Prepare and submit recommendations to the City Council. 17 18 (3) Attend all meetings and provide comment to the City Council when solicited. 19 20 SECTION 5. Membership. 21 22 (a) Membership will consist of five regular members. 23 24 (b) Each Councilmember will be entitled to appoint one member to the committee 25 and may provide two to three names for consideration. Each appointment 26 shall be subject to and conditioned upon approval by a majority vote of the 27 entire Council. 28 29 (c) The guidelines for membership may include: 30 • Be a property owner for a minimum of five years. 31 • Shall not be currently serving on a City or County board or committee. 32 • Able to attend both daytime and evening meetings. 33 • Be a registered voter in the City. 34 • May not be a lobbyist. 35 • Have knowledge of municipal functions, municipal chargers, the Florida 36 Constitution, and the Florida Statutes pertaining to municipal law . 37 • Should not present a conflict of interest on any subject matter discussed , 38 reviewed , or decided upon . 39 40 SECTION 6. Meetings. 41 42 Meetings shall be at the call of the chairperson , beginning the week of August 7, 43 2017 , allowing seven weeks for the Committee to meet and prepare the final report for 44 Council consideration. 45 46 SECTION 7. This Resolution shall become effective immediately upon adoption. Page 2 of 3
