4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
5 BEACH GARDENS, FLORIDA, REGARDING CITY-OWNED
6 PROPERTY LOCATED AT 3704 BURNS ROAD, PALM BEACH
7 GARDENS, FLORIDA, MORE COMMONLY KNOWN AS THE PUBLIC
8 WORKS PROPERTY; CHOOSING TO RETAIN THE PROPERTY IN
9 CITY OWNERSHIP FOR FUTURE USE BY THE CITY; AUTHORIZING
10 AND DIRECTING THE CITY MANAGER TO TAKE ALL STEPS
11 NECESSARY TO BEST UTILIZE THE SUBJECT PROPERTY TO
12 BEST SERVE THE CURRENT AND FUTURE NEEDS OF THE
13 COMMUNITY AND THE RESIDENTS OF THE CITY OF PALM BEACH
14 GARDENS; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER
15 PURPOSES.

18 WHEREAS, the City owns property at 3704 Burns Road , known as the Public
19 Works Property, that is approximately 2.07 acres in size; and
20
21 WHEREAS, the City hired Anderson & Carr, Inc. to perform an appraisal of the
22 property to determine a fair market price, and they determined that, subject to certain re-
23 zoning assumptions and the existing conditions, the market value of the fee simple
24 interest in the parcel, as of February 21 , 2017 , was $2,260,000; and
25
26 WHEREAS, subsequently , the City hired Anderson & Carr, Inc. to conduct a
27 competitive public sale of the property; and

29 WHEREAS, the City has previously executed two different contracts with two
30 different potential buyers in two separate attempts to sell the property; and
31
32 WHEREAS, the previous two deals failed to close, as the respective buyers both
33 chose to cancel their contracts within the due diligence period ; and
34
35 WHEREAS, in light of the difficulty selling the property , the City has re-evaluated
36 its future space needs and has determined that retaining the property is the more fiscally
37 responsible option; and

39 WHEREAS, the City Council deems approval of this Resolution to be in the best
40 interests of the health , safety, and welfare of the residents and citizens of the City of Palm
41 Beach Gardens, and the public at large.

45 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
46 OF PALM BEACH GARDENS, FLORIDA, that:

1 SECTION 1. The foregoing recitals are hereby affirmed and ratified .

3 SECTION 2. The City Council, by majority vote , hereby directs the City Manager
4 to remove the property from the market, retain the property in City ownership for future
5 use by the City, and to take all steps necessary to best utilize the subject property to best
6 serve the current and future needs of the community and the residents of the City of Palm
7 Beach Gardens.

9 SECTION 3. This Resolution shall become effective immediately upon adoption.
